c! . ~()A GC Environmental, Inc., a California corporation (hereinafter "Consultant"), and the City of
f" I ~ Santa Ana, a charter city and municipal corporation organized and existing under the
Constitution and laws of the State of California (hereinafter "City").
RECITALS
A. The City desires to retain a consultant having special skill and knowledge in the field of
environmental engineering and consulting.
B. Consultant represents that Consultant is able and willing to provide such services to the
City.
C. In undertaking the performance of this Agreement, Consultant represents that it is
knowledgeable in its field and that any services performed by Consultant under this
Agreement will be performed in compliance with such standards as may reasonably be
expected from a professional consulting firm in the field.
NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the
terms and conditions hereinafter set forth, the parties agree as follows:
1. SCOPE OF SERVICES
Consultant shall perform those services as set forth in Exhibit A to this Agreement.
2. COMPENSATION
a. City agrees to pay, and Consultant agrees to accept as total payment for its services,
the rates and charges identified in Exhibit A. The total sum to be expended under this
Agreement, shall not exceed $ 10,000.00 during the term of this Agreement.
b. Payment by City shall be made within thirty (30) days following receipt of proper
invoice evidencing work performed, subject to City accounting procedures. Payment need not
be made for work which fails to meet the standards of performance set forth in the Recitals
which may reasonably be expected by City.
3. TERM
This Agreement shall commence on the date first written above and terminate on December 5,
2003, or project completion, whichever occurs first, unless terminated earlier in accordance with
Section 12, below. The term of this Agreement may be extended upon a writing executed by the
Executive Director of the Community Development Agency and the City Legal Counsel.
4. INDEPENDENT CONTRACTOR
Consultant shall, during the entire term of this Agreement, be construed to be an
independent contractor and not an employee of the City. This Agreement is not intended nor
shall it be construed to create an employer-employee relationship, a joint venture relationship, or
to allow the City to exercise discretion or control over the professional manner in which
Consultant performs the services which are the subject matter of this Agreement; however, the
services to be provided by Consultant shall be provided in a manner consistent with all
applicable standards and regulations governing such services. Consultant shall pay all salaries and
wages, employer's social security taxes, unemployment insurance and similar taxes relating to
employees and shall be responsible for all applicable withholding taxes.
5. INSURANCE
Prior to undertaking performance of work under this Agreement, Consultant shall
maintain and shall require its subcontractors, if any, to obtain and maintain insurance as
described below:
a. Commercial General Liability Insurance. Consultant shall maintain commercial
general liability insurance naming the City, its officers, agents, volunteers, and employees as
additional insured(s) and shall include, but not be limited to protection against claims arising
from bodily and personal injury, including death resulting therefrom and damage to property,
resulting from any act or occurrence arising out of Consultant's operations in the performance of
this Agreement, including, without limitation, acts involving vehicles. The amounts of insurance
shall be not less than the following: single limit coverage applying to bodily and personal injury,
including death resulting therefrom, and property damage, in the total amount of $1 ,000,000 per
occurrence. Consultant shall supply City with a fully executed additional insured endorsement in
substantially the form attached hereto as Exhibit B upon execution of this Agreement and shall
be approved in form by the City Attorney.
b. Business automobile liability insurance, or equivalent form, with a combined single
limit of not less than $1,000,000 per occurrence. Such insurance shall include coverage for
owned, hired and non-owned automobiles.
c. Worker's Compensation Insurance. In accordance with the provisions of Section 3300
of the Labor Code, Consultant, if Consultant has any employees, is required to be insured against
liability for worker's compensation or to undertake self-insurance. Prior to commencing the
performance of the work under this Agreement, Consultant agrees to obtain and maintain any
employer's liability insurance with limits not less than $1,000,000 per accident.
d. If Consultant is or employs a licensed professional such as an architect or engineer:
Professional liability (errors and omissions) insurance, with a combined single limit of not less
than $1,000,000 per claim.

e. The following requirements apply to the insurance to be provided by Consultant
pursuant to this section:
(i) Consultant shall maintain all insurance required above in full force and
effect for the entire period covered by this Agreement.
(ii) Certificates of insurance shall be furnished to the City upon execution of
this Agreement and shall be approved in form by the City Legal Counsel.
(iii) Certificates and policies shall state that the policies shall not be canceled
or reduced in coverage or changed in any other material aspect without
thirty (30) days prior written notice to the City.
f. If Consultant fails or refuses to produce or maintain the insurance required by this
section or fails or refuses to furnish the City with required proof that insurance has been procured
and is in force and paid for, the City shall have the right, at the City's election, to forthwith
terminate this Agreement. Such termination shall not effect Consultant's right to be paid for its
time and materials expended prior to notification of termination. Consultant waives the right to
receive compensation and agrees to indemnify the City for any work performed prior to approval
of insurance by the City.
6. INDEMNIFICATION
Consultant agrees to and shall indemnify and hold harmless the City, its officers, agents,
employees, consultants, special counsel, and representatives from liability: (I) for personal
injury, damages, just compensation, restitution, judicial or equitable relief arising out of claims
for personal injury, including health, and claims for property damage, which may arise from the
direct or indirect operations of the Consultant or its contractors, subcontractors, agents,
employees, or other persons acting on their behalf which relates to the services described in
section I of this Agreement; and (2) from any claim that personal injury, damages, just
compensation, restitution, judicial or equitable relief is due by reason of the terms of or effects
arising from this Agreement. This indemnity and hold harmless agreement applies to all claims
for damages, just compensation, restitution, judicial or equitable relief suffered, or alleged to
have been suffered, by reason of the events referred to in this Section or by reason of the terms
of, or effects, arising from this Agreement. The Consultant further agrees to indemnify, hold
harmless, and pay all costs for the defense of the City, including fees and costs for special
counsel to be selected by the City, regarding any action by a third party challenging the validity
of this Agreement, or asserting that personal injury, damages, just compensation, restitution,
judicial or equitable relief due to personal or property rights arises by reason of the terms of, or
effects arising from this Agreement. City may make all reasonable decisions with respect to its
representation in any legal proceeding.
7. CONFIDENTIALITY
If Consultant receives from the City information which due to the nature of such
information is reasonably understood to be confidential and/or proprietary, Consultant agrees
that it shall not use or disclose such information except in the performance of this Agreement,
and further agrees to exercise the same degree of care it uses to protect its own information of

like importance, but in no event less than reasonable care. "Confidential Information" shall
include all nonpublic information. Confidential information includes not only written
information, but also information transferred orally, visually, electronically, or by other means.
Confidential information disclosed to either party by any subsidiary and/or agent of the other
party is covered by this Agreement. The foregoing obligations of non-use and nondisclosure
shall not apply to any information that (a) has been disclosed in publicly available sources; (b) is,
through no fault of the Consultant disclosed in a publicly available source; (c) is in rightful
possession of the Consultant without an obligation of confidentiality; (d) is required to be
disclosed by operation oflaw; or ( e) is independently developed by the Consultant without
reference to information disclosed by the City.
8. CONFLICT OF INTEREST CLAUSE
Consultant covenants that it presently has no interests and shall not have interests, direct
or indirect, which would conflict in any manner with performance of services specified under
this Agreement.
9. NOTICE
Any notice, tender, demand, delivery, or other communication pursuant to this
Agreement shall be in writing and shall be deemed to be properly given if delivered in person or
mailed by first class or certified mail, postage prepaid. or sent by telefacsimile or other
telegraphic communication in the manner provided in this Section, to the following persons:

A party may change its address by giving notice in writing to the other party. Thereafter,
any notice, tender, demand, delivery, or other communication shall be addressed and transmitted
to the new address. If sent by mail, any notice, tender, demand, delivery, or other
communication shall be effective or deemed to have been given three (3) days after it has been
deposited in the United States mail, duly registered or certified, with postage prepaid, and
addressed as set forth above. If sent by telefacsimile, any notice, tender, demand, delivery, or
other communication shall be effective or deemed to have been given twenty-four (24) hours
after the time set forth on the transmission report issued by the transmitting facsimile machine,
addressed as set forth above. For purposes of calculating these time frames, weekends, federal,
state, County or City holidays shall be excluded.
10. EXCLUSIVITY AND AMENDMENT
This Agreement represents the complete and exclusive statement between the City and
Consultant, and supersedes any and all other agreements, oral or written, between the parties. In
the event of a conflict between the terms of this Agreement and any attachments hereto, the
terms of this Agreement shall prevail. This Agreement may not be modified except by written
instrument signed by the City and by an authorized representative of Consultant. The parties
agree that any terms or conditions of any purchase order or other instrument that are inconsistent
with, or in addition to, that terms and conditions hereof, shall not bind or obligate Consultant nor
the City. Each party to this Agreement acknowledges that no representations, inducements,
promises or agreements, orally or otherwise, have been made by any party, or anyone acting on
behalf of any party, which are not embodied herein.
11. ASSIGNMENT
Inasmuch as this Agreement is intended to secure the specialized services of Consultant,
Consultant may not assign, transfer, delegate, or subcontract any interest herein without the prior
written consent of the City and any such assignment, transfer, delegation or subcontract without
the City's prior written consent shall be considered null and void. Nothing in this Agreement
shall be construed to limit the City's ability to have any of the services which are the subject to
this Agreement performed by City personnel or by other consultants retained by City.
12. TERMINATION
This Agreement may be terminated by the City upon thirty (30) days written notice of
termination. In such event, Consultant shall be entitled to receive and the City shall pay Consultant
compensation for all services performed by Consultant prior to receipt of such notice of termination,
subject to the following conditions:

a. As a condition of such payment, the Executive Director may require Consultant to deliver
to the City all work product completed as of such date, and in such case such work product shall be
the property of the City unless prohibited by law, and Consultant consents to the City's use thereof
for such purposes as the City deems appropriate.
b. Payment need not be made for work which fails to meet the standard of performance
specified in the Recitals of this Agreement.
13. DISCRIMINATION
Consultant shall not discriminate because of race, color, creed, religion, sex, marital
status, sexual orientation, age, national origin, ancestry, or disability, as defined and prohibited
by applicable law, in the recruitment, selection, training, utilization, promotion, termination or
other employment related activities. Consultant affirms that it is an equal opportunity employer
and shall comply with all applicable federal, state and local laws and regulations.
14. JURISDICTION - VENUE
This Agreement and all questions relating to its validity, interpretation, performance, and
enforcement shall be government and construed in accordance with the laws of the State of
California. This Agreement has been executed and delivered in the State of California and the
validity, interpretation, performance, and enforcement of any of the clauses of this Agreement
shall be determined and governed by the laws of the State of California. Both parties further
agree that Orange County, California, shall be the venue for any action or proceeding that may
be brought or arise out of, in connection with or by reason of this Agreement.
15. PROFESSIONAL LICENSES
Consultant shall, throughout the term of this Agreement, maintain all necessary licenses,
permits, approvals, waivers, and exemptions necessary for the provision of the services
hereunder and required by the laws and regulations of the United States, the State of California,
the City of Santa Ana and all other governmental agencies. Consultant shall notify the City
immediately and in writing of her inability to obtain or maintain such permits, licenses,
approvals, waivers, and exemptions. Said inability shall be cause for termination of this
Agreement.
16. MISCELLANEOUS PROVISIONS
a. Each undersigned represents and warrants that its signature hereinbelow has the power,
authority and right to bind their respective parties to each of the terms of this Agreement, and shall
indemnify City fully, including reasonable costs and attorney's fees, for any injuries or damages to
City in the event that such authority or power is not, in fact, held by the signatory or is withdrawn.

b. All Exhibits referenced herein and attached hereto shall be incorporated as if fully set
forth in the body of this Agreement.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement the date and

GC EnvirOnmental, Inc. (GCE) is pleased to submit the enclosed proposal to the City of
Santa Alia (City) for Environmental Services including Phase I environmental site
assessment and lead and asbestos sampling and analysis for properties acquired or to be
acquired by the City.
GeE is extremely well qualified to perform the requested semces and is anxious to work
with the Community Redevelopment Agency. Our proposal was prepared and organized
in the reqUested format and contains all required infonnation.
GCE is .a full-semce environmental engineering and cODSulting firm specializing in
environmental site assessments, soil and groundwater sampling, testing and analyses, and
site remediation and closure. Key project professionals have conducted hundreds of site
assessmeilts throughout Southern California, and are more than qualified to provide
additional enviromnental semces to the City, if required. All work on the project will be
performed by qualified personnel and in accordance with applicable state and fcdera11aws
and regulations. .

In response io the Community Redevelopment Agency of the City of Santa Ana's [herein

GCE's scope of work for Phase I ESA, will be completed in general accordance with the ASTM
1527-2000 ESA standard. Should preliminary results of Phase 1 ESA indicate areas of
environmental concerns at any of these properties, , GCE will communicate the results and our
recommendations to the City for additional work. GeE's proposed scope of work and cost for the
Phase I ESA are presented in this proposal.
Lead and asbestos sampling and testing will be performed by AHERA.certified staff and shaH
comply with: HUD guidelines. A brief description of the lead and asbestos sampling and testing
cost is provided in this proposal.
We understahd that soil sampling and testing may by required as a part of this proposal. A detailed
scope of work and cost for soil sampling and testing can not be provided in this proposal because of
unknown conditions of the properties at this time. However, if warranted by site condition based
on the Phas6 I ESA, GeE will communicate the results and our recommendations to the City for
additional wOrk based on the suspected presence and nature of hazardous materials at the site, and
will provide the City with a scope of work and cost for approval.
The following sections provide brief descriptions of scope of works for Phase I ESA and asbestos
and lead sampling and analysis.

We will condUct a site visit to observe field conditions indicating recognizable environmental

Task 4.0 Final Report of Findings
A report of findings wiil be prepared for each properly which willlnclude the information obtained
from the Phase I environmental site assessment. The report will include photographs and pertinent
regulatory a&enCY documentation reganding the site. The report will discuss fmdings and
reconunendations. .
1.1 Asb~tos Lead Material Sampling and Analysis
In addition i,o Phase I :eSA. the single and multi.family residential properties will be checked for
the presence of asbestos and lead in for the purpose of establishing health and safety
requirementS during demolition and disposal requirements.
GeE underStand that these properties are presently occupied, but will be vacant at the time of
sampling, and that these properties need to be checked for the presence of asbestos and lead prior
to demoliticin and disposal of the construction debris.

Asbestos Sampling aniAnalysls
The propertieis are located within the jurisdiction of the South Coast Air Quality Management
District (SCAQMD). The SCAQMD requires at least 3 samples from each type of construction
material (i.e., different type of flooring or ceiling material) used in the buildings. Based on the
assumption that up to 3 different types of construction materials have been used in each unit
(roof, ceiling, flooring).. GCE estimates that at least 9 samples will need to be collected from the
ceiling, roof, 'and floo~g of the single family propertie~ for analysis. GCE assumes up to four
units for the multi-family properties and a common roof; therefore, 27 samples will be collected
from each multi-family. residential property for analysis. The actual number of samples may be
different bas~ on our site visit. .
The samples will be collected by a GeE AHERA-certified staff. The samples will be analyzed
using US EPA Method 6001R-93-116.
The results cif the survey will be provided to the City in the a letter report, or as a part of the
Phase I ESA report, whichever the City prefers. The approximate sampling locations will be
marked on the floor plan for the dwelling, provided by the City, and will be included in the
report. The ~rt will. also include a brief discussion of our findings, copies of the laboratory
reports and chain of custody documents.
Lead Sampling and Analysis
At this time the State of California does not have any requirements for pre-demolition waste
survey and sampling. Therefore to provide the City with an estimated cost, GeE assumes three
types of cOnstruction materials and bulk sampling after demolition to characterize the
construction debrislwaste.
GeE estimates that at least 30 samples will need to be collected from the units for analysis. The
actual number of samples may be different based on our site visit.
The samples will be collected by a qualified staff, and will be analyzed for total lead using
US EPA Method 7420,
The results of the survey will be provided to the City in a letter report, or 8S a part of the Phase I
ESA report,' whichever the City prefers. The approximate sampling locations will be marked on
the floor pliln for the dwelling, provided by the City, and will be included in the report. The

Barring unforeseen ci~umstances and lengthy response time from agencies, GeE plans to complete
the scope of worle fo~ Phase I ESA and lead and asbestos sampling and testing and submit our
report for each property in approximately three to four weeks. Included in each report will be our

conditions. Prelirninaryresults will be communicated to the City prior to submittal of the reports.

5.0 COMPANY RESOURCES

professionals including geologists, engineers, environmental assessors, technicians and draftsmen,
but also include local. area network (LAN), persolUll computers, CADO computers, numerous
engineering imd environmental software programs, and access to computerized databases. GCE's

clients with top qua1ityworkplans, designs and reports. An organizational chart defines the lines of
responsibilitY for GCE staff and the proposed project team. (See Figure 1).

The proposed Project Manager for the City of Santa Ana is Ms. Farideh Kia. Ms. Kia has over
17 years experience in environmental field and hazardous waste management. Her expertise is in
conducting ilnd managing Phase I Environmental Site Assessments, geologic and hydrogeologic

landfill and oil field development. Her expertise in performing evaluation of property conditions,
remediation of contaminated sites as well as both landfill operations and oil field closures makes
her particularly effective in managing a wide range of projects. Her rcsponsibilities include, but
are not limited to, directing field personnel, performing review, analyses of data accumulated and
preparation of final repOrts for review by Local Enforcement Agencies (LEAs). Ms. Kia heads
up GeE's Environmental Division, staffmg environmental projects including site assessments,
site characterizations, remedial activities and permitting.
Ms. Kia will utilize in-house environmental professionals and company resources to assure
timely completion of the project. Mr. Richard Prosser, P.E. will be utiliu:d in the role of

Mr. Richard: Frizzell, R.O.: Mr. Frizzell is a Registered Geologist with over twelve years of
experience hi environmental sciences including Phase I Environmental Site Assessments (ESAs),
Remedial Action Plans (RAPs), remediation system installation, Phase II soil and groundwater
assessments; underground storage tank (UST) removal and closures, Solid Waste Assessment
Tests (SWATs), groundwater, surface water and vadose-zonc water issues as related to landfills,
landfill siting, Environmental Impact Reports (ElRs) related to landfill feasibility, and closure
and expansion plans.. He has been responsible for field operations and supervising field
technicians during a groundwater assessment at active and closed landfill sites including
Superfund sItes throughout southem California. He has experience in completing site-specific
Health and Safety Plans and has acted as the site Health and Safety Officer on numerous projects.
Additional cixperienceincludes working knowledge of environmental regulations including but
not limited to CCR Title 22 and 23; CFR Title 40, Subtille D, and South Coast Air Quality
Management District (SCAQMD) Rule 1166.
Ms. Enid CQhn, REA, AHEM: Ms. Cohn has over sixteen years professional experience,
including teli years experience in performing asbestos surveys and monitoring asbestos abatement
projects, penonning environmental site assessments (ESAs) for industrial, commercial. and
residential properties; managing and preparing environmental impact studies (EISs) and reports
(EIRs) for hazardous :materials handling. offshore oil development, and other projects; and
regulatory c6mpliance evaluations. Ms. Cohn is a State of California Certified Asbestos Consultant
which enables her to conduct sampling for asbestos-containing materials, develop Operations and
Maintenance Plans, prepare abatement specifications, and oversee asbestos abatement activities.
Ms. Cohn maintains certifications under the federal Asbestos Hazard Emergency Response Act
(AIIERA) as a Management Planner, Building Inspector, Contractor/Supervisor/Competent Person,
and Project Pesigner.
Mr. Brian Millage: Mr. Millage is a geographer with experience in environmental projects
including performing site visits, aerial photograph review, background research, chain-of-title

Results: Groundwater remediation deemed complete when TeE and PCE
concentrations were reduced to below MCL concentrations
A preliminary site assessment was performed at one of The Lincoln Property Company's
former hck maintenance facilities. The fonner underground storage tanks (USTs) had
contained both unleaded gasoline and diesel during the time they were actively used for
hazardoUs materiai storage. It was reported upon removal of the tanks, contaminated soils
sunounqing the USTs were excavated and the excavation was closed.
The assessment included soil borings and well installation. Up to six feet of product (diesel)
was rep9rted in swell. A network of wells was installed SUtI'Ounding the tank excavation,
delineating the extent of contamination and verifying the existence of regional polychlorinated
solvent Contamination in the groundwater. A remediation system was designed consisting of an
ORS probe scavenger dual pwnp system, a Gnmdfos single pump system, holding tanks, and
granulated activated carbon filtration. Floating product was skimmed from the groundwater
surface and pumped through double-walled pipes Into a SOC-gallon product-recovery tank. The
product-recovery llink had a secondary containment vessel and was equipped with a high-level
shutdo~n probe. When necessary, product was removed from the tank by vacuum truck and
transported to a wlisto-oil reprocessor. The unit was in operation under NPDES permit from the
Califoniia Regional Quality Control Board--Los Angeles Region. The system removed over
2,000 gallons of free.phase product. Over 4,000,000 gallons of petroleum hydrocarbon and
polychlorinated solvent contaminated groundwater were treated using carbon filters. Groundwater

An inventory reconciliation disclosed that the fuel storage tank had leaked thousands of gallons,
and an initial assessment by the client suggested that the fuel had leaked into the surrounding
soil. A sUbsurface exploration was conducted to evaluate the borizontal and vertical extent of
the contalnination. : Soil borings were drilled and subsequently converted into groundwater
monitoriljg wells. Laboratory analyses indicated that both the soil and groundwater were
contaminAted. Vapor ex:traction wells and a thermal oxidation system was designed and
installed io treat the petroleum hydrocarllon contaminated soil. The thermal oxidation system
was pemlitted and approved by the South Coast Air Quality Management District (SCAQMD),
and the Santa Ana Regional Water Quality Control Board (SARWQCB). The system was
operating: for 1.5 years and showed a 99.9 percent reduction in contaminants in the soil and
groundwilter. Remediation was completed and a closure report was submitted to the RWQCB.

Major Issues: Soil and Groundwater Contamination
Retulta:Repoitfor Closure has been submitted to the RWQCB
Upon removal of the Underground Storage Tanks (USTs), a site 6&sessment study was initiated.
The focUs of the project was to assess the extent of soil and groundwater contamiaation, and
initiate a groundwater monitoring program at the site. Based on the results of the investigation,
it was asSessed that groundwater contamination was a regional problem, and not caused by the
USTs at the site. A remedial feasibility study was conducted and a work plan for cleanup of
contMni",.tNl soil was prepared. Additionally, the project involved a pilot vapor ex:traCtion test
and the t;lesign and installation of a vapor extraction system using a therma1lcatalytic oxidizer.
During the 18 months of operation, the system removed over 50,000 pounds of hydrocarbon
from the vadose zone. Confirmation borings were installed which indicated that soil remedia-
tion ~ successful. A site closure report was prepared and submitted to the RWQCB for
approva1~

GeE personnel mobilized immediately in response to the Office of the State ArchitectS (OSA's)
request rdr Emergency Response for closure by removal of a leaking UST at the University of
Califomi~ Irvine (UC!) Engineering Central Plant and Fleet Services facilities. Field
assessment activities completed for both of these sites included agency negotiation, UST
removal and preparation of a Remedial Action Plan (RAP) for both sites. The following are
specific t3sks completed at each of these locations.
En~neuin, Central Plant Facility: GeE personnel managed the site assessment operations at
UCI's Engmeering Centr4l Plant facility. Project included removal ofUSTs used for diesel fuel
storage; subsurface soil and groundwater quality assessment; Installation of groundwater
monitoriJig wells; collection of soil and groundwater for chemical analyses; and ambient air
monitoritlg and soil :samplc screening. The extent of groundwater contamination was assessed,
and diesel in the forin of free-phase product was identified as the contaminant. GCE completed
a Remedial Action Plan (RAP) outlining field activities and recommended product removal as a
preferred'option for groundwater clean up. The RAP was approved by the RWQCB. Most of
the prodUct has been removed from groundwater, and remediation has reached a steady state,
and a point of rniniinal return. GeE has recently submitted a request for site closure and is in
the proceSs of sche$ling a meeting with Regional Water Quality Control Board (RWQCB) and
Orange County Health Care Agency (OCHCA) to negotiate site closure on behalf of the client.
Siteclos\Ue has beei1 approved by OCHCA and awaits approval by R WQCB.
Fleet SirYices Fadlitv: GeE personnel initially managed the installation of groundwater
monitoriilg wells around the .Fleet Services facility. During the well installation, it was found
that the :soil and groundwater in the vicinity of the site's USIs was contaminated with
volatile organic hydrocarbon compounds. GeE completed a Remedial Action Plan (RAP)
outlining field activities and compiling requirements for a quarterly groundwater sampling
and monitoring program for the property. The RAP was approved by the RWQCB. GCE has
been supervising the ongoing quarterly groundwater sampling and monitoring presently being
conducted at this site.
Tn November 1998, GCE was contracted for the removal of the two usn at this facilit)'-~me
containej1 gasoline, the other stored diesel fuel. GCE oversaw the removal of contaminated soil
from the:UST excavation. The removal portion of the project also involved the removal of more
than 200 cubic yards of petroleum contaminated soil for treatment and recycling.
Since !hi: removal of the contaminate source, the size of hydrocarbon plume in groundwater
has steadily decreased. GeE has completed a feasibility study recommending the intrinsic
bioremediation, "No Further Action," as the most viable and cost-effective remedial option
for the site, as long as the hydrocarbon plume is shrinking. GCE has recommended sparging
as a secOndary alternative if site conditions change.

current tec~ology, no level of assessment can show conclusively that a property or its structures

or liability for any claim, loss of property value, damage, or injury which results from pre-

2. InVoices will be issued on a monthly basis, or upon completion of a project, whichever is
sooner. The net ca.~h amount oflhis invoice is payable on presentation of the invoice.
3. FOr hourly wOrkers, time worked in excess of eight bours per day and weekend work will bc
charged at 1.5 times the hourly rate.
4. Per diem will 'be charged at a rate of $75 per day per person or expenses plus 15%, whichever
is: greater. Per diem will be eharged for all projects in excess of 50 miles from the GC

California Regional Water Quality Control Board. Groundwater remediation at the site was
conducted by another consultant simultaneously.

Performed investigation of soil and groundwater contamination, through drilling, well
installation and routine groundwater monitoring. Conducted a pilot vapor extraction test and a

Conducted geophysical, geologic and hydrogeologic survey for a future groundwater barrier

completed SWAT for this facility. The project included conducting two, 72-hoUT continuous
groundwater pumping tests and two slug tests using pressure transducers connected to a
computerized datalogger. Duties also included data analyses and computer modeling of aquifer

removin~ one UST; subsurface soil sampling for petroleum hydrocarbon compounds in the
areas of the UST.: product line, and dispenser; characterization of the contamination in the
subs.e; installation of one groundwater monitoring well; and groundwater sampling.
Althougll petroleUm contamination was found in soil and groundwater samples, the
concentrations were below the San Diego Regional Water Quality Control Board (SDRWQCB)
concentrations of concern, and the SDRWQCB issued a Letter of Closure.

representing a national bank that was considering foreclosure on these properties. Assisted in
the efficient management of the schedules of personnel and subcontractors to compete the
project. The assessment and characterization of both sites included geophysical surveys to
locate subsurface structureSj logging and sampling of near-surface and subsurface soil using
hydrauli~ push technology; review of analytical data; and completion of fina1 report. The result
of the assessment activities was that one site had trace concentrations of HYOCs beneath the
foundation slab, arid the other site had highly elevated HVOC concentrations in the soil
beneath a floor drain beneath the dry oleaners. The bank foreclosed on the site with trace
HVOC concentrations and re-negotiated the loan for the contaminated site.

("additional insureds") with regard to liability and defense of suits arising from the operations
and uses performed by or on behalf of the named insured.
2. With respect to claims arising out of the operations and uses performed by or on
behalf of the named insured, such insurance as is afforded by this policy is primary and is not
additional to or contributing with any other insurance carried by or for the benefit of the
additional insureds.
3. This insurance applies separately to each insured against whom claim is made or
suit is brought except with respect to the company's limits of liability. The inclusion of any
person or organization as an insured shall not affect any right which such person or organization
would have as a claimant ifnot so included.
4. With respect to the additional insureds, this insurance shall not be cancelled, or
materially reduced in coverage or limits except after thirty (30) days written notice has been
