Koo & Associates ("Consultant') and the City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). RECITALS A. The Parties entered into Agreement A-2005-012, dated January 18, 2005, hereinafter referred to as "said Agreement', to provide structural plans, specifications and estimates for three City bridges and a cantilever bike trail structure; and B. The Parties hereto now desire to amend the term to allow for the work to be completed WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter contained and made, and subject to all of the terms and conditions of said Agreement as hereby amended, the parties hereto do hereby agree as follows: Section 4, "TERM", is hereby deleted in its entirety and replaced with the following: "Agreement shall commence on the date first written above and terminate on completion of the services set forth in Section 1, above, unless terminated earlier in accordance with Section 13, below." 2. Except as hereinabove modified, the terms and conditions of said Agreement remain unchanged and in full force and effect.
