Adopt a resolution authorizing the Agency to execute the Race-Neutral Implementation Agreement with Transportation. Adopt a resolution authorizing the City Engineer to execute future agreements with Caltrans regarding changes in Title 49 of the Code of Federal Regulations. DISCUSSION Every year the Public Works Agency lS required to update the Disadvantaged Business Enterprise (DBE) program annual goal which involved federally funded projects administered by The California Department of Transportation (Caltrans). As part of the funding approval, the City is required to update the annual DBE Goal. However, recent changes in Titles 49 of the Code of Federal Regulations require the City to execute a Race-Neutral DBE Implementation Agreement to meet the local agency's responsibilities under the Caltrans race-neutral DBE Program. To comply with this new DBE program, a Race-Neutral DBE Implementation Agreement must be executed by an authorized official in order to make certain that new DBE Program procedures have been followed and that the requirements of Title 49 Code of Federal Regulations have been met. A resolution is needed to authorize the City Engineer of the Public Works Agency to execute the Race-Neutral DBE Implementation Agreement and all future changes in Title 49 of the Code of Federal Regulations. 55A-1 Resolution Authorizing The City Engineer to Execute Agreement June 5, 2006 Page 2 ENVIRONMENTAL IMPACT In accordance with the California Environmental Quality Act, the proposed request is not considered a project. RACE-NEUTRAL DISADVANTAGED BUSINESS ENTERPRISE IMPLEMENTATION AGREEMENT AND ANY FUTURE AGREEMENTS WITH THE CALIFORNIA DEPARTMENT OF TRANSPORTATION REGARDING CHANGES OR AMENDMENTS TO TITLE 49 OF THE CODE OF FEDERAL REGULATIONS BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The City Council of the City of Santa Ana hereby finds, determines and declares as follows: A. The Public Works Agency has been required to update the Disadvantaged Business Enterprise (DBE) Program annual goal which involved federally funded projects administered by the State of California Department of Transportation ("Caltrans") on an annual basis. B. Recent changes in Title 49 of the Code of Federal Regulations require the City to execute a Race-Neutral DBE Implementation Agreement in order to meet the local agency's responsibilities under the new Race-Neutral DBE Program. C. In accordance with the new DBE Program, as with the previously adopted DBE Program, a resolution is needed to designate the City Engineer as the DBE Liaison Officer, and to authorize the City Engineer to execute the Race-Neutral Implementation Agreement and any future amendments or agreement changes regarding Title 49 of the Code of Federal Regulations, Part 26. Section 2. The City Council hereby designates the City Engineer as the DBE Liaison Officer and authorized the City Engineer, and the City Attorney, to execute the Race-Neutral DBE Implementation Agreement with the State of California Department of Transportation, as required by Title 49 of the Code of Federal Regulations, Part 26. Section 3. The City Council hereby authorizes the City Engineer, and the City Attorney, to execute any amendments or agreement changes with the State of California Department of Transportation required by Title 49 of the Code of Federal Regulations, Part 26. Resolution Page 1 of 2 55A-3 Section 4. In accordance with the California Environmental Quality Act, the proposed request is not considered a project, therefore no further action is required. Section 5. This Resolution shall take effect immediately upon its adoption by the City Council, and the Clerk of the Council shall attest to and certify the vote adopting this Resolution.
