RESOLUTION NO. 2006-042
A RESOLUTION APPROVING THE SUMMARY VACATION
OF THE OFFER OF DEDICATION OF THE UNNAMED
STREET EAST OF JACKSON STREET BETWEEN
ELEVENTH STREET AND WASHINGTON AVENUE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS
FOLLOWS:
Section 1. The City Council of the City of Santa Ana hereby finds
determines and declares as follows:
A. The City of Santa Ana intends to vacate the offer of dedication for the
unnamed street east of Jackson Street between Eleventh Street and
Washington Avenue pursuant to and in accordance with the provisions of
Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the
State of Caiifornia.
B. The vacation of the unnamed street is a summary vacation because the street
lies within property under one ownership pursuant to the provisions of section
8334 of the Streets and Highway Code of the State of Caiifornia. All property
adjacent to said unnamed street are owned in fee by a developer, and said
property will be subdivided in accordance with Tentative Tract Map No. 16576
for 1101 through 1119 North Jackson Street, approved by Council on August
2,2004.
C The land being subdivided by Tract Map No. 16576 contains a strip of land
which is subject to a continuing offer of dedication to the City for future use as
Jackson Street. The offer was made by the previous subdivider on Tract Map
NO.1 022, which recorded on May 2, 1940. The City never accepted the offer
of dedication and instead obtained the right of way for and constructed
Jackson Street two hundred (200) feet west of the subject offered land. This
vacation will terminate all vehicular rights to this unnamed street
D. In accordance with the Caiifornia Environmental Quality Act, the proposed
vacation has been determined to be adequately evaluated in the previously
prepared Mitigated Negative Declaration ER No. 2003-133 adopted by
Council in 2004.
Section 2. The City Council of the City of Santa Ana hereby approves the
summary vacation of the unnamed street east of Jackson Street between Eleventh
Street and Washington Avenue, as more particularly described in Exhibit 1 attached
hereto and incorporated herein by reference. In addition, the City expressly rejects and
declines to accept any outstanding offer of dedication for said street.

Section 3. Said unnamed street shall not be deemed vacated until this
resolution is recorded.
Section 4. This Resolution shall take effect immediately upon its adoption by
the City Council, and the Clerk of the Council shall attest to and certify the vote adopting
this Resolution.
