THIS THIRD AMENDMENT TO CONSULTANT AGREEMENT is entered
into this 28°i day of June, 2006, by and between Paul Fetters dba The Training Spot, a
California corporation ("Consultant') and the City of Santa Ana, a charter city and
municipal corporation of the State of California ("City").
RECTI ALS:
A. The parties entered into Agreement N2002-150 dated October 4, 2002, (hereinafter
"said Agreement") by which Consultant has provided health and fitness classes to the
City's Police Department.
B. In accordance with the terms and conditions of said Agreement, the parties wish to
renew said Agreement for an additional one-year term.
WHEREFORE, in consideration of the covenants contained in said Agreement, and
subject to all the terms and conditions of said Agreement, except those amended in this
Third Amendment to Consultant Agreement, the parties agree as follows:
1. Section 3, TERM, shall be extended for an additional one-year term, through June
30. 2007.
2. Section 5.a. "Commercial General Liability Insurance", shall be deleted in its
entirety. The services to be provided do not require the provision of such insurance.
IN WITNESS WHEREOF, the parties hereto have executed this Third Amendment to
Consultant Agreement on the date and year first written above.
