Highlights of this presentation are as follows: . NICE committee held several sessions to discuss the issues . NICE committee reviewed approaches in other communities, conferred with the Grocers Association and met with affected merchants . The problem is not just grocery carts but includes other merchants groups . Carts are abandoned throughout the City . Once abandoned by commercial patrons, carts can be picked up by transients or others . Abandoned and misused carts create negative impression, leads to the impression that things are "out of control", and affects ability to attract and maintain residents, businesses . Expense of cart retrieval borne by the City . Potential safety concerns with children when they ride or play in carts . Carts are abandoned in the neighborhoods . A sign is affixed to each cart that identifies the owner of the cart or the retailer or both, notifies the public that unauthorized removal of a cart or possession of a cart is a violation, and, lists a valid phone number or address for the return of a cart o Physical measures . Disabling devices installed & maintained on carts . Security Guards . Confining carts to inside building unless accompanied by an employee . Bollards and chains to prevent removal from premises . Security deposit by customer for cart use . Santa Ana reguiations should have two components: containment and provisions for cart retrieval by merchants . For maximum flexibility, merchants should be required to submit a plan for both containing and retrieving carts . Containment options include: security personnel, physical construction barriers, electronic locking system, and, carts restricted to in-store use . Retrieval plan will require that carts have contact name/number of each merchant; contact name/number for retrieval contractor . Plan will delineate pick-up routes and frequency; retrieval contractors will provide a weekly report for all stores utilizing their service, and retrieval contractors will agree to random checks by City staff to verify information CITY COUNCIL MINUTES 281 AUGUST 21, 2006 WORK STUDY SESSION . Other considerations: o Deposit system o Creating other ways for patrons to transport merchandise o Labeling carts o Requiring new businesses to install and or implement containmenVretrieval plans o Timeframes for compliance . After Council direction staff will develop procedures for submitting cart containmenVretrieval plans, potential fees to offset staff time; and other administrative procedures Following the staff presentation several individuals addressed Council supporting implementation of an ordinance to regulate use of shopping carts. Speakers noted that the presence of shopping carts in the residential neighborhoods not only creates blight, but also creates a potential safety concern if children are allowed to ride in the carts. The following residents addressed this issue: Mary Guzman, Mark Guzman, George Collins, Bruce Smith, Tim Rush, Steve McGuigan, Debbie McEwen, Julie Stroud, Glen Stroud, Dave Hoen, Judy Edge, Vicky Yamamoto, and Tish Leon. Steve Garcia, representing Superior Warehouse, and Joe Cabrera representing Northgate Markets supported an ordinance which would assist vendors in containing shopping carts on store premises. Council discussion ensued and all members expressed the need for an ordinance that aggressively addresses the issues of cart containment and retrieval. Councilmembers requested that the Neighborhood Improvement and Code Enforcement Council Committee consider the suggestions made by residents and the Council, and develop language for a new ordinance. COMMENTS 90A PUBLIC COMMENTS Steve McGuigan noted that the City needed to review the vending machine ordinance and amend what needs to be changed so that we can implement vending regulations right away. Pat McGuigan thanked the Council for considering the shopping cart ordinance. She also noted that the Santa Ana Winds had a 35th reunion of band members, and conducted an afternoon concert on the Federal Courthouse lawn. CITY COUNCIL COMMENTS Councilmember Alvarez . Reported that the Santa Anita neighborhood held its first neighborhood concert which was very well attended and very successful Councilmember Solorio .
