HOUSING AGREEMENT
SUBJECT; Housing agreement between the Santa Ana Police Department Jail Bureau and the
California Youth Authority. This is an amendment of the agreemcnt originally entered in to on
January 5, 2001. This amendment shall become effective October 1,2006.
The Santa Ana Police Department Jail Bureau agrees to house California Youth Authority
(CY A) parolees arrested in Orange County (Our Hold Only- WIC 9 1767.3) for the State of
California. This agrecmcnt is baBed upon the following conditions:
1. This agreement is under the authority of WIC 9 1753.3, subsection (b), which allows thc
Director of the Youth Authority to enter into an agreement with a city to pcrmit the
transfer of wards and parole violators to a city facility.
2. CY A agrees to compensate the City of Santa Ana for the costs of housing of state
parolees at the "Daily Jail Rate", set by the Legislature and the Budget Act.
3. The City of Santa Ana Police Department Jail Bureau, agrees to providc CY A a monthly
invoice in compliance with the Daily Jail Rate Manual by thc 10"' of each month. The
bill is duc and payable at the time received and is past due 30 days after receipt.
4. The CY A agrees to reimbursc the City of Santa Ana, separate from the Daily Jail Rate,
for emergency medical costs, routine and non-routine as addressed in the "Daily Jail Rate
Manual."
5. If a CY A parolee develops medical problcms after booking that requires medical serviccs
not available in tbe Santa Ana Jail, CY A will immediately dispatch a Parole Agcnt to tbe
Santa Ana Jail for Transportation and necessary guard services. If emcrgency treatmcnt
is necessary, City shall transport the parolee for immediate mcdical treatment and provide
guard scrvices pending the arrival of a Parole Agent. All such emergency transportation
and medical charges shall be borne by CY A.
6. The Santa Ana Police Department Jail Bureau employs Correctional Officers pursuant to
Penal Code 9 830.55 who have the authority and responsibility for maintaining custody
of the wards and parole violators. The Correctional Officers shall have no right to carry
or possess tireanns in the performance of their duties, except, under the direction of the
superintendent of the facility, while engaged in transporting prisoncrs, guarding
hospitalized prisoners, or suppressing riots, lynchings, escapes, or rescues in or about the

Santa Ana Police Department Jail Facility. The Correctional Officers shall have the
necessary training required in Penal Code ~ 830.55(c).
7. The CYA agrees to pick up and transpurl these parolees to the California Youth
Authority on a weekly basis.
8. The City of Santa Ana and CY A agree to establish written guidelines for:
. Emcrgency medical Treatment
. Call-outs; and
. Such ulher procedures as identified by the parties
9. Failure of CY A to fulfill their responsibilities on any of these issues as well as failure to
pay the housing bills in a timely manner may result in termination of the acceptance of
parolee inmates by the Cily of Santa Ana.
10. The contact person for the City of Santa Ana in all matters related to the acceptance and
housing of parole inmates shall be Russell Davis, Jail Administrator, or his designee.
I hereby agree to the terms as uutlined in this Agreement.
