RECOMMENDED ACTION
Direct the City Attorney to prepare and authorize the City Manager and
Clerk of the Council to execute a legal services agreement with the law
firm of Carpenter, Rothans & Dumont with a maximum hourly rate of
$170.00.
DISCUSSION
The City Attorney's Office provides legal services to the City, its
officials and employees, primarily through staff attorneys. However, it
is sometimes necessary to retain outside counsel for specialized fields
of practice and cases that have extraordinary staffing requirements.
Under the direction of the City Attorney's Office, the law firm of
Carpenter, Rothans & Dumont will provide litigation legal services to
the City of Santa Ana.
The hourly rate charged by Carpenter, Rothans & Dumont is $170.00 and
has been guaranteed for a two year period. This rate is extremely
competitive for a firm with Carpenter, Rothans & Dumont's trial
experience and expertise. A thorough search for additional counsel was
conducted and multiple firms were considered. However, Carpenter,
Rothans & Dumont appears to be the premier candidate. The initial
assignment for the firm shall be by firm principal Steven Rothans for
defense of a police liability matter.

FISCAL IMPACT
Funds for the services are available in the FY 06-07 Personnel Services
Account (account no. 80-180-6191).
