RECOMMENDED ACTION
Adopt a resolution designating six ward seats and one city-wide seat on
the various Boards, Commissions and Committees of the City.
DISCUSSION
On December 21, 2006, the Secretary of State accepted and filed five
Charter amendments ratified by the Santa Ana voters at the election on
November 7, 2006. Charter Amendment CC amended portions of Section
901 of the Charter related to membership on boards and commissions.
Subsection (e) of Section 901, as amended, requires the City Council to
formally designate seven seats on all boards, commissions and
committees. Six of the seats are to be designated by ward and the
respective members will be nominated by the councilmember representing
that ward, and one seat is designated as a city-wide seat to be
nominated by the Mayor.
The primary purpose of this amendment to Charter Section 901 was to
formalize the long-standing Council practice of nominating and
appointing board and commission seats by ward. The Clerk of the
Council has for many years maintained the rosters of the boards and
commissions with such designation. The ward designations outlined in
Exhibi t A of the attached resolution reflect the current roster of
members and are enumerated solely for the purpose of calculation of
terms as provided in the revised Charter Section 901. The terms of
office for all the incumbents listed in the Exhibit for Wards 2, 4, and
6 have expired, and the respective councilmembers would have to re-
nominate the incumbent listed or make a new appointment for the terms
beginning following the 2006 election. The terms for the incumbents
listed in Exhibit A for Wards 1, 3, and 5 will expire in 2008.

The Charter amendment further specified that one of the seats on each
board or commission would be a city-wide seat having a two year term
which coincides with that of the Mayor. Due to this change, the terms
of those incumbents nominated by the Mayor which were to expire in 2008
instead expired upon Measure CC going into effect and the Mayor would
have to re-nominate the incumbent listed on Exhibit A or make a new
appointment for a two year term.

RESOLUTION NO. 2007-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ANA DESIGNATING SIX WARD SEATS AND ONE
CITY-WIDE SEAT ON VARIOUS BOARDS, COMMISSIONS
AND COMMITTEES OF THE CITY.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS
FOLLOWS:
Section 1. The City Council of the City of Santa Ana hereby finds, determines
and declares as follows:
A. At the 2006 General Municipal Election, the voters of the City of Santa
Ana approved Measure CC, which amended portions of Section 901 of the
Santa Ana City Charter related to membership on boards and
commissions.
B. Subsection (e) of Section 901, as amended, calls upon the City Council to
formally designate seven seats on all boards, commissions and
committees, six by ward (to be nominated by the council member
representing that ward) and one as a city-wide seat (to be nominated by
the Mayor).
C. The purpose of this amendment to Charter Section 901 is to formalize the
long-standing informal City Council practice of nominating and appointing
board and commission seats by ward.
D. Because of this informal practice, the Clerk of the Council has, for many
years, maintained the rosters of the boards and commissions with such
designation. The current roster of members and the corresponding ward
or city-wide status (in the case of persons nominated by the Mayor) is
attached hereto as Exhibit A.
E. The best means of carrying out the mandate of Measure CC is to formally
continue the seat designations as set forth in Exhibit A, with the exception
that the seat designated as City-Wide shall have a two year term to
coincide with that of the Mayor. As such, the terms of those incumbents
nominated by the Mayor whose terms were to expire in 2008 instead
expired upon Measure CC going into effect and will be subject to
reappointment.

Section 2. Effective with those terms beginning following the 2006 General
Municipal Election, there shall be on those boards, commissions and committees of the
City identified in Exhibit A to this Resolution, one seat designated for Ward 1 through
Ward 6, the members to be nominated and appointed as set forth in Section 901 of the
Santa Ana City Charter. Additionally, there shall be an additional seat on said bodies
designated as a "city-wide" seat, the member of which is to be nominated by the Mayor
and appointed as called for in Section 901 of said charter. For those bodies set forth in
Exhibit A with more than seven members, the other members shall be nominated and
appointed as called for in the Charter, Municipal Code or other organic document or
statute for such body.
Section 3. This Resolution shall take effect immediately upon its adoption by
the City Council, and the Clerk of the Council shall attest to and certify the vote adopting
this Resolution.
