REINSTATING REGULATIONS CONCERNING PARKING OF COMMERCIAL VEHICLES ON RESIDENTIAL PROPERTY Public hearing to consider an ordinance repealing Section 2 of Ordinance No. NS-2419 and reinstating the previous language of Section 41-607(h) of the Santa Ana Municipal Code pertaining to parking commercial vehicles on residential property Legal Notice published in the Orange County Register on April 7, 2000 Introduction of public hearing by Mayor Pulido Presentation of staff report by Captain Bruce Carlson, Santa Ana Police Department and Planning and Building Agency Executive Director Uptegraff Presentation of written communications by Clerk of the Council Healy: None The public hearing opened at 6:20 P.M. and was suspended at 6:22 P.M. to allow for administering the Oath of Office to Youth Commissioner Allison Conley OATH OF OFFICE Administered by the Clerk of the Council to Allison B. Conley, representative to the Youth Commission The public hearing relative to parking of commercial vehicles on residential property resumed at 6:23 p.m. The following individuals spoke on the issue of reinstating previous ordinance language pertaining to parking commercial vehicles on residential property: Dave Lopez, Robert Henson, Otto Bade,John White, Winston Covington, Bill Todd, Desi Reyes, and Evangeline Gawronski. Mr Bade submitted a petition signed by residents or business owners opposed to the ordinance . The public hearing closed at 6:38 p.m. Council debate ensued. Robyn Uptegraff, Executive Director, Planning and Building Agency noted that the Council had previously remanded this matter to the Planning Commission for the purpose of looking at all the options related to commercial vehicle parking. Council discussion continued and Councilmembers debated the desirability of adopting the ordinance prior to a comprehensive review by the Planning commission. CITY COUNCIL MINUTES 126 APRIL 17, 2000 129 PUBLIC HEARINGS Several Councilmembers expressed support for adopting the ordinance to give code enforcement staff an additional tool and to reinstate previous code provisions. All members who spoke supported aggressive enforcement of residential parking restrictions for larger commercial vehicles. Councilmember Franklin asked City Attorney Fletcher if the City could selectively enforce an ordinance, and if the City could prosecute some offenders and not others. The City Attorney responded that the ordinance could not be selectively enforced but discretion in enforcement could be used. He noted that the ordinance would reinstate language that had previously been included in the Municipal Code and normally would be enforced on a complaint basis. City Manager Ream added that all seven Council members have historically indicated to him that they do not want the small commercial vehicles cited, and that the City would continue to enforce the ordinance as it had in the past. Councilmember McGuigan stated that she supported the concerns expressed by the neighborhoods, however, believed that the Planning Commission should complete its review before the Council adopts any ordinance. Motion 1. Place ordinance on first reading and authorize publication of title. ORDINANCE NO. NS-2425 - An ordinance of the City Council of the City of Santa Ana repealing Section 2 of Ordinance No. NS-2419 and reinstating the prior language of Section 41-607(h) of the Santa Ana Municipal Code — Planning and Building Agency and City Attorney's Office 2. Refer entire matter related to parking Commercial vehicles on residential streets and on private residential property to the Planning Commission for a comprehensive review of the issues and alternative solutions, and request that the Planning Commission submit its findings and recommendations to the City Council. WEB PRESENTATION Gerardo Mouet of the City Manager's Office. Mr. Mouet gave a brief update on the status of the City's web page, and described the proposed new look for the Departments home pages, including the new common navigation bar. He explained that the objective was to go online with the new web site by April 21, 2000, and to complete content development for all web site components by December 2000. WS.B. 2000/2001 DEPARTMENTAL PRIORITY OBJECTIVES Planning and Building Agency Executive Director Robyn Uptegraff and Parks, Recreation & Community Services Executive Director Cleve Williams gave presentations to the City Council relative to their respective departmental priority goal objectives for Fiscal Year 2000-2001.
