7 by and between the Orange County Transportation Authority, 550 South Main Street, P.O. Box 14184,
8 Orange, California 92863-1584, a public corporation of the state of California (hereinafter referred to
9 as "AUTHORITY"), and City of Santa Ana, a charter city and municipal corporation, organized and
10 existing under the Constitution and laws of the State of California (hereinafter referred to as "CITY").
11 RECITALS:

A.
AUTHORITY utilizes CITY streets for its public transportation program, including the
13 bus system.

B.
AUTHORITY's busses have damaged two catch basins owned and maintained by the
15 CITY.

C.
The parties have agreed that CITY will repair the damaged catch basin and
17 AUTHORITY shall reimburse CITY its actual costs to make such repair, in an amount not to exceed
18 Ten Thousand Dollars ($10,000.00).
19 WHEREFORE, in consideration of the mutual and respective covenants and promises, and
21
20 subject to all the terms and conditions hereinafter set forth, the parties hereto agree as follows:

OBLIGATIONS OF CITY
a.
CITY shall select and pay a contractor to repair the catch basins, as set forth
23 in Exhibit A, attached to and, by this reference, incorporated in and made part of this reimbursement
25
24 Agreement.
b.
CITY shall submit an invoice to AUTHORITY evidencing the cost of the repairs
26 paid by CITY.

OBLIGATIONS OF AUTHORITY
2 AUTHORITY shall vvithin thirty (30) days of receipt of CITY's invoice, reimburse CITY
3 for CITY's costs to repair the catch basins_

Notvvithstanding any provisions of this Agreement to the contrary, AUTHORITY and
CITY mutually agree that AUTHORITY's not-to exceed payment obligation shall be Ten Thousand
Dollars ($10,000.00) vvhich shall include all amounts payable to CITY for repairs of the damaged catch
basins.

Cost Proposal for Catch Basin Repair
Project No. 06-6005 Storm Drain Construction and Street Improvement
Dear Mr. Girgis,
In response to your letter dated January 30, 2007 requesting a quote for repairing
damaged catch basins at south side of Santa Ana Boulevard and east of Ross Street,
and south side of Alton Street and east of Main Street, Accord Engineering, Inc. is
pleased to provide our quote for the subject services s as follows:
(1) Repair structural damages to the 10-foot catch basin at Santa Ana / Ross - $3,200
(2) Repair structural damages to the 15-foot catch basin at Alton / Main - $4,800
The above repairs include demolishing and removing damaged structures, and
rebuilding the catch basin per City Standard Plans 303 and 305A. The above quotes
are to be performed on a lump-sum basis. We assume performing both repairs
simultaneously and include a $500 discount on mob/demob efforts. If the job
requires multiple mob/demob or to be individually performed, please add $500 to the
quoted cost.
The above quote is good for 30 days. We can start the work in 5 working days from
the notice to proceed, and complete the work in about 8 working days (not including
concrete curing time).
