THIS FIRST AMENDMENT TO AGREEMENT, is entered into on January 2,
2007, by and between Midori Gardens ("Contractor") and the City of Santa Ana, a
charter city and municipal corporation of the State of California ("City").
RECITALS:
A. The parties entered into Agreement #A-2005-115, dated July 1, 2005, (hereinafter
"said Agreement") by which Contractor has provided landscape maintenance for the
City parks.
B. In accordance with the terms and conditions of said Agreement, the parties wish to
amend the Scope of Services to clarify their intention that Contractor will provide
services for new landscaping of the City.
WHEREFORE, in consideration of the covenants contained in said Agreement, and
subject to all the terms and conditions of said Agreement, except those amended in this
First Amendment to Agreement, the parties agree as follows:
Section 1, SCOPE OF SERVICES, shall be amended to include in Exhibit A,
Attachment 1, the new landscape by the Fire Station Trailer, as part of the standard
weekly maintenance at Centennial Park.
2. City agrees to pay, and Contractor agrees to accept as total payment for the additional
landscape maintenance at the Fire Station Trailer, $475.00 per month.
3. Except as hereinabove amended, all terms and conditions of said Agreement shall
remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to
Agreement on the date and year first written above.

Carla forwarded your call regarding the amendment including Centennial Park maintenance. The City will pay an additional
amount but the total of the contract is not increased. The additional $475 is included in the contingency approved by Council
with the agreement. The original agreement provides for additional services as approved by the Executive Director.
Therefore, Council approval is not required for this amendment.
