RECITALS: A. The parties entered into Agreement N -2006 -037, dated May 1, 2006, (hereinafter "said Agreement ") by which Consultant has provided tree lighting maintenance for the Artist Village Tree Lighting Program. B. In accordance with the terms and conditions of said Agreement, the parties wish to amend the Scope of Service, increase compensation to pay for new services and extend the term of said Agreement for an additional six -month period. WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this Third Amendment to Consultant Agreement, the parties agree as follows: Section 1, SCOPE OF SERVICES, shall be amended to include the installation of 50 banners on light poles in downtown Santa Ana, as set forth in Exhibit A -3, attached hereto and incorporated by this reference. 2. Section 2.a., COMPENSATION, shall be increased by $5,000.00 for a total amount not to exceed $20,000.00 during the term of said Agreement. 3. Section 3, TERM, shall be amended to extend the termination date to June 30, 2008. 4. Insurance certs and exhibits Dear Lucy, Attached are signed pages of the new agreement between the City of Santa Ana and Display City, Inc. One interesting note is that my company Display City, Inc. provides a great deal of specialized services, lighting, design, installation, electrical, fabrication, removal, annual storage etc. Because of this I use a small network of specialized contractors that I personally manage. Very similar to a General Contractor one might say. For the lighting installation, service and banner installations I use a company called Exterior Products, Inc that has worked with me for five years. My liability insurance is for Display City, Inc as I am always on the job and the workers comp on these projects will be from Exterior Products, Inc. We have this same setup last year and I do the same with several other neighboring cities. I just wanted to point that out because it is slightly unique.
