AGREEMENT TO REIMBURSE FUNDS
FOR FY06 URBAN AREAS SECURITY INITIATIVE (UASI)
THIS AGREEMENT is entered into this 18th day of December 2006, which date is
enumerated for purposes of reference only, by and between the CITY OF ANAHEIM, a
municipality of the State of California, hereinafter referred to as "ANAHEIM", and the CITY OF
SANTA ANA, hereinafter referred to as "SANTA ANA."
RECIT ALS:
A. Since 2004, the United States Department of Homeland Security (DHS), through the
State of California Governor's Office of Homeland Security (OHS) as the State
Administrative Agency (SAA), designated the cities of Anaheim and Santa Ana
(hereinafter referred to as "the Cities") as core cities and awarded each jurisdiction grants
under the Urban Area Security Initiative ("UASI").
R The 2006 UASI Grant program consolidated the Anaheim Urban Area and the Santa Ana
Urban Area into one combined entity, the Anaheim/Santa Ana Urban Area.
C. The Cities wish to continue their collaborative effort with respect to terrorism
preparedness and have jointly designated ANAHEIM to provide the financial oversight
for the 2006 UASI Grant funds. The Cities have entered into a Memorandum of
Understanding regarding the 2006 UASI program, attached hereto as Attachment 1.
NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the
terms and conditions hereinafter set forth, the parties agree as follows:
1. ANAHEIM shall be designated the Single Point of Contact for purposes of
administration and financial management of the FY06 UASI Grant funds.
2. ANAHEIM shall reimburse SANTA ANA for funds expended by those jurisdictions
within the Santa Ana Urban Area, for purchases of equipment, services and training
authorized under the FY 2006 UASI, in an amount not to exceed $5,990,000.
3. SANTA ANA agrees that expenditures beyond those authorized by the
Anaheim/Santa Ana Urban Area will not be reimbursed through the FY 2006 UASI
Grant.
4. Upon receipt of a reimbursement application, ANAHEIM, as soon as practical and
not to exceed thirty (30) days, shall submit the request to the Office of Homeland
Security for Reimbursement. Reimbursement shall be provided within seven (7) days
after ANAHEIM receives funds from OHS.
5. For a period of three years SANTA ANA shall retain all documents, papers and
records relevant to the expenditures of the Santa Ana Urban Area. For the same time
period, SANTA ANA shall make said documents available to ANAHEIM and the
DHS and OHS, for examination.
6. SANTA ANA shall provide to ANAHEIM all records and information requested by
ANAHEIM for inclusion in quarterly reports and such other reports or records as
ANAHEIM may be required to provide to DHS/OHS.
7. This Reimbursement Agreement shall remain in effect until mutually amended or
terminated by the Cities.

1.Slnce 2004, the federal Oepartm.ent of Homeland Se<:urity (DHS), throUgh the State
of Cafifomla's Office of Homeland Security (OHS) as the State Administrative
Agency (8M), has designated the Cities of Anaheim and Santa Ana (hereafter
referred to sa "the Citi8$") as Urban Areas and awarded ~ jurisdiction grants
under the Urban Areas Sea.n1ty Initiative (UASl). Thus far, two grant cycles have
been awarded. to the Cities (2004 and 2005), with each cycle having a performance
period of approximately two years. In each of these grant cydes, DHS awarded the
funds and subsequenUy required a Homeland Security Strab:Jgy from eaoh of the
Urban Areas. Anahehnand Santa Ana submitted ajtiint Strategy which ultimately
formed the basts for Orange County's overall terrorism preparedness efforts. In
addition, DHS required anlnltlll Strategy Implementation Plan (tS1P) as an overview
of how the Cities planned to spend UASI grant funds. The Strategy and the ISIP
were approved for bo1h grant cycles and project development and implementatio n is
on..gotng.
2. The Cities elected to define each Urban Ar&a broadly to include all jurisdictions in
the county. as wen 89 key disciplines. such as Health, Law. Fire, Emergency
Management and others as defined by DHS. Thus far. the grants hava been
individually awarded to. and managed In all respects by, each City (Anaheim and
Santa Ana). The Cities have collaborated with the County of Orange and elf other
jurisdictions to fonn a true partnership that has gamered acclaim from OHS, OHS
and Congress. The Citie& have formed a tNe partnership with all stakeholder$ in
the county and have coI1aborated to enhance ovefalI preparedness lewJ$. at all
times focusing on mitigating risk and improving oonsequenC8 mSinagement for the
most critical infrastructure and targets as ultimately Identified in tne Countywide
Strategic Plan fur Terrorism Preparedness.

3. Starting with the 2OQ6 grant cycle. and at the dlrectlQn of Congress, DHS has
redefined the criteria by which Homeland Security funds a~ awarded under the
UASt In addftiGn to population and population density, DHSmanda. that funds be
distributed based upon risk and need. The 2006 grant cycle atso m~;ut(S the first year
in whIch the National Preparedness Goal (the Goal) and the NatlOflal Priorities (the
Priorities) are fully in place. thus providing specifiC gU\danca to grant recipients In
terms of Target Capabilitles. critical tasks and preparedness levels. Th6$9 ch~$

when the investment Is justified will the money flow to the cities that are otherwise
eligible. This process ensures that not only is DHS aUocating funding based on risk
and need, but that the funding is being used to build the regional critical capabilities
consistent with the Goal and the Priorities.
4. The 2006 UASI grant cycle also makes two significant changes to the UASI struoture
and the application process. One, the Anaheim and Santa Ana Urban Areas have
been consolidated into one "Combined Entity;- and two, rather than award the funds
and then ask for an Implementation plan. DHS now requires close coordination with
the state Administrative Agency, and a series of Investment Justifications that will
define how the Urban Areas intend to spend any requested funds, and which wilt be
subject to peer review and other vetting processes to determine risk and need in
accordance with Congressional instructions. DHS will then determine whlch of the
Investments will be funded and at what level. This process ma.kes it clear that in
order for Orange County to receive funding under the UASI. it must continue to focus
on a regional and risk-based approach in developing Its Investment justifications.
This task will be easier for Orange County with the completion in December,2005 of
the Countywide Strategic Plan for Terrorism Preparedness commissioned by both
Urban Areas and funded with 2004 UASI funds.
5. OHS andOHS now also require that one of the two UASI jurisdictions be designated
as the Single Point of Contact for purposes of the grant appDcation and financial
management of the grant The Cities wish to continue their collaborative effort with
respect to terrorism preparedness. The 2006 grant gu\detines require formalization
of the current Orange County structure for determining the focus of grant fund
spending, which includes the use of the Urban Area Working Group (UAWG) to
obtain Input In developing Investment areas and specific projects to be funded. This
process and input, which is consistent with the process used in previous grant years,
win assj;st the City Managers from Anaheim and Santa Ana, as we. as Orange
County's Chi,ef E)(ecutive Officer, in making tfle final decisions with respect to grant
expenditures,
OBJECTIve AND SCOPE
In recognition of the 2006 Urban Araas Security Initiative grant purpo8e,guidelines, and
requirements, the atias of Anaheim and Santa Ana wish to continue their $tratsgic
partnership not only with each other, but also with the County of Orange. aU jurisdictions
in the county, and the stakeholder groups and disciplines that have thus far
characterized a successful and acclaimed effort to reduce risk, mitigate vulnerabmties
and manage consequences related to a terrorism incident or threat In addition, the
Citie$ wish to fulfill the requirements by DHS and Congress that all grant funds. be
cflStributed through a funding program dedicated to a risk-based set of priorities where
the Cities and their partners will develop Investment areas and projects that address the

highest risks, thus demonstrating their abftlty to effectivety and effit:lently spend grant
funds in a systematic and focuood manner.
Therefore, the Cities of Anaheim and Santa Ana agree as follows:
1. Inv9Stment areas and projects will be developed as in previous years, oonsi6tent
with Orange County's Homeland Security Strategy, and with Input from the Urban
Area Working Group.
2. The City of Anaheim will be designated liS the Single Point of Contact (SPC) for
the 2006 UASI.
3. The SPC responsibilities will include serving as the appflcation lead; financtal and
reporting management; and coordination of grant requirements with OHS and
DHS for the duration of the 2006 grant cycle.
4, Future SPC responsibiUties will be negotiated and agmed upoo by the Cities
when future grant cycles are announced.
5. This MOU has been submitted for review to OHS, which fully supports and
approves of such an arrangement.
6. The City of Santa Ana, on behalf oft and with approval from, ooth Cltiest wlll
retain an independent consultant to perform the foU owing tasks:
a. Coordinate with the UASI grant administrators and command staff from
Santa Ana and Anaheim, as well as Homeland Security Grant
administrators and command staff of the County of Orange in developklg
and drafting :a comprehensive Cooperation Agreement {CA)to formalize
the 2006 UASI grant management structure.
b. Assist the Cities In preparing the 2006 grant application, developing the
required Investment Justifications and proposed project lists for the 2006
UASI grant cycle.
c. Assist in managing the collaborative process, including meetings and
mediating possible disagreements among stakeholders. to ensure an
inclusive and objective approach to the development of projects and
Investment area6 consistent with grant requirements as well as OHS and
Congressional intent.

I am in receipt of the above agreeement. Does this need to go to council? (I have read and noticed that the City of Santa Ana
shall receive a reimbursement of $5.9M from the City of Anaheim. I realize the City is not paying out but due to the sum that
it's receiving does it need to go to council?)
