Authorize the City Manager and Clerk of the Council to execute the
attached amendment to the agreement with Ann Christoph in the amount of
$72,170 for a total contract in the amount of $155,470, subject to non-
substantive changes approved by the City Manager and City Attorney to
provide architectural services at the Santa Ana Zoo at Prentice Park and
Santiago Park.
DISCUSSION
On October 2, 2006, the City Council approved an agreement with Ann
Christoph to provide architectural services for the Santa Ana Zoo's
newest exhibit, Tierra de las Pampas. These services include design of
new exhibit space for rheas and guanacos and a new anteater exhibit.
Through the design development process, staff has identified several
necessary scope additions. To implement these changes, additional
architectural design services in the amount of $26,050 are required.
Additionally, the City applied for and received grant funds for two
projects adjacent to the new Santiago Park Wildlife and Wetlands
Interpretive Center. The Land and Water Conservation Fund grant for the
Santiago Park Nature Reserve Amphitheatre was approved by City Council on
May 1, 2006 in the amount of $150,000. This project includes the
construction of an amphitheatre adjacent to new interpretive center to
supplement its educational program. This agreement amendment will provide
for $31,356 of design services for this project.
On November 7, 2005, the City Council approved a Habitat Conservation
Grant from the State of California in the amount of $50,000. These funds
will be used for the restoration of native habitat around the
interpretive center. A restoration ecologist is required to ensure the
habitat restoration is implemented appropriately. This agreement
amendment will provide for $14,764 of design services for this
restoration project.

To maintain consistency with the Tierra de las Pampas Exhibit design and
provide the architectural and restoration ecology services at Santiago
Park, staff recommends amending the agreement with Ann Christoph in the
amount of $72,170 for a total contract of $155,470.
ENVIRONMENTAL IMPACT
In accordance with the California Environmental Quality Act, the proposed
project has been determined to be adequately evaluated in previously
prepared Negative Declaration No. 2002-304.
FISCAL IMPACT
Funds are available in the Habitat Conservation Fund grant (account no.
169-268-6631, project no. 06-6411) and Land and Water Conservation Fund
grant (account no. 156-247-6631, projects 07-6002 and 08-6010.

FIRST AMENDMENT TO
CONSULTANT AGREEMENT
THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT is entered into
on March 3, 2008, by and between Ann Christoph Landscape Architect ASLA, a sole
proprietor ("Consultant") and the City of Santa Ana, a charter city and municipal
corporation of the State of California ("City").
RECITALS:
A. The parties entered into that certain Agreement #A-2006-270, dated October 2, 2006,
(hereinafter "said Agreement") by which Consultant has provided architectural design
and consulting services in relation to the Tierra de las Pampas exhibit at the Santa
Ana Zoo at Prentice Park.
B. In accordance with the terms and conditions of said Agreement, the parties wish to
amend the Scope of Services to provide for additional landscape architect services in
relation to the Zoo exhibit and a new amphitheatre at Santiago Park and to increase
compensation to pay for additional requested services.
WHEREFORE, in consideration of the covenants contained in said Agreement, and
subject to all the terms and conditions of said Agreement, except those amended in this
First Amendment to Consultant Agreement, the parties agree as follows:
1. Section 1, SCOPE OF SERVICES, shall be deleted in its entirety and replaced with
the following:
"Consultant shall provide architectural, civil engineering and landscaping design
services resulting in contract documents for the Tierra de Las Pampas Exhibit at the
Santa Ana Zoo, as set forth in City's Request For Proposal dated 8-9-06, Consultant's
Proposal dated September 1, 2006, both incorporated by reference, Scope of Work,
attached as Exhibit A to said Agreement, as supplemented by Proposal dated January
25, 2008, including additional design services and construction support services,
attached hereto as Exhibit A-1 and incorporated by this reference.
Consultant shall prepare a landscape plan and construction documents for the
amphitheatre at Santiago Park, as set forth in Consultant's Proposal dated January 18,
2008, attached hereto as Exhibit A-2, and incorporated by this reference."
2. Section 2.a., COMPENSATION, shall be deleted in its entirety and replaced with the
following:
"a. City agrees to pay, and Consultant agrees to accept as total payment for its
services in relation to the Tierra de las Pampas exhibit those amounts set forth in

Consultant's Proposals dated January 25, 2008 (Ex. A-1). The total sum to be
expended for services related to Tierra de las Pampas exhibit shall not exceed
$109,350.00.
For landscape design and construction document services related to the Santiago Park
Amphitheatre, the City agrees to pay and Consultant agrees to accept a total of
$46,120.00 as set forth in Consultant's Proposal dated January 18, 2008 (Ex. A-2)."
3. Except as hereinabove amended, all terms and conditions of said Agreement shall
remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to
Consultant Agreement on the date and year first written above.
