FIRST AMENDMENT TO
CONSULTANT AGREEMENT
A- 2008 -050
THIS FIRST AMENDMENT TO CONSULTANT AGREEMENT is entered into
on March 3, 2008, by and between Ann Christoph Landscape Architect ASLA, a sole
proprietor ( "Consultant ") and the City of Santa Ana, a charter city and municipal
corporation of the State of California ( "City ").
RECITALS:
A. The parties entered into that certain Agreement #A- 2006 -270, dated October 2, 2006,
(hereinafter "said Agreement ") by which Consultant has provided architectural design
and consulting services in relation to the Tierra de las Pampas exhibit at the Santa
Ana Zoo at Prentice Park.
B. In accordance with the terms and conditions of said Agreement, the parties wish to
amend the Scope of Services to provide for additional landscape architect services in
relation to the Zoo exhibit and a new amphitheatre at Santiago Park and to increase
compensation to pay for additional requested services.
WHEREFORE, in consideration of the covenants contained in said Agreement, and
subject to all the terms and conditions of said Agreement, except those amended in this
First Amendment to Consultant Agreement, the parties agree as follows:
1. Section 1, SCOPE OF SERVICES, shall be deleted in its entirety and replaced with
the following:
"Consultant shall provide architectural, civil engineering and landscaping design
services resulting in contract documents for the Tierra de Las Pampas Exhibit at the
Santa Ana Zoo, as set forth in City's Request For Proposal dated 8 -9 -06, Consultant's
Proposal dated September 1, 2006, both incorporated by reference, Scope of Work,
attached as Exhibit A to said Agreement, as supplemented by Proposal dated January
25, 2008, including additional design services and construction support services,
attached hereto as Exhibit A -1 and incorporated by this reference.
Consultant shall prepare a landscape plan and construction documents for the
amphitheatre at Santiago Park, as set forth in Consultant's Proposal dated January 18,
2008, attached hereto as Exhibit A -2, and incorporated by this reference."
2. Section 2.a., COMPENSATION, shall be deleted in its entirety and replaced with the
following:
"a. City agrees to pay, and Consultant agrees to accept as total payment for its
services in relation to the Tierra de las Pampas exhibit those amounts set forth in
Consultant's Proposals dated January 25, 2008 (Ex. A -1). The total sum to be
expended for services related to Tierra de las Pampas exhibit shall not exceed
$109,350.00.
For landscape design and construction document services related to the Santiago Park
Amphitheatre, the City agrees to pay and Consultant agrees to accept a total of
$46,120.00 as set forth in Consultant's Proposal dated January 18, 2008 (Ex. A -2)."
3. Except as hereinabove amended, all terms and conditions of said Agreement shall
remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to
Consultant Agreement on the date and year first written above.

RE: Proposal for Landscape Architectural Services for landscaping and restoration at the
Santiago Nature Reserve
Dear Mr. Gabriel:
I enjoyed meeting with you, Kevin Eaton and Patrick Mitchell at Santiago Nature Reserve,
to see the Center nearing completion, and to view the surrounding area to receive native
landscaping and restoration. At our meeting of December 12, I was asked to reevaluate
the scope of work and the fee. This is the resulting submittal.
I am enthusiastic about the prospect of working with you to bring about the natural
setting that we all envision to enhance your nature reserve educational programs and to
bring nature back within the urban surroundings.
The design team will be led by myself - -Ann Christoph, landscape architect FASLA - -and I
will be the principal client contact person, project designer and coordinator. Other
professionals on the project design team are Margot Griswold, Earthworks, restoration
ecologist, Paul Kandarian, Southland Energy Consultants, electrical design; and Art Guy,
Borthwick Guy Bettenhausen, Irrigation Consultant. Information on project team
members is attached.
On the following pages we have outlined a reduced scope of work to design this 1.8 acre
natural park area, depicted in the site plan (attached) that has a construction budget of
$265,000.

SCOPE OF WORK
TASK 1- Pre - Design Meeting
A. Meet with City Project Manager and park staff, review project requirements,
objectives, schedule, design procedures, project approach, and working methodology.
(1 meeting)
B. Obtain documents and information to be provided by City.
TASK 2 — Preliminary Landscape Plan
A.Program Analysis, Site Information, and Field Review
1. Review architectural drawings and site drawings prepared by Dougherty and
Dougherty for the building construction.
2. Receive CAD files of site survey that the City has already had prepared.
3. Review City as -built information regarding irrigation, drainage, utilities, etc. Plot
known underground utilities on base sheet using information supplied by City.
4. Walk site, record existing features, views, access, site conditions to be resolved.
Restoration ecologist will walk site and take soil samples. Assess pedestrian and
service circulation patterns and access for persons with disabilities. Summarize
information and implications on an in -house sketch document.
5. Confirm the following program with staff in the initial meeting. The program, as
explained on the site, is summarized as follows:
Part 1 Restoration
• Site is to be restored as a natural park, emphasizing native grasslands and
featuring a small area as a vernal pool. The area around the Wildlife and Habitat
Center to be landscaped as a native plant garden.
• The area should accommodate nature walks, school visits, and campfire talks.
• There will be an irrigation system throughout for plant establishment, with
provisions for separate systems adjacent to the building. These systems would be
for permanent irrigation, while the irrigation system in the remainder of the area is
planned to be infrequently used after the initial establishment period.
Part 2 Amphitheater and related site improvements
• An outdoor amphitheater to seat approximately 60 people is to be included.
• The amphitheater is to be rustic in character, using materials such as fallen logs,
recycled concrete, and boulders. It should have a fire pit and presentation area, It
should be simple in design and is not to include audio - visual equipment, cabinets,
overhead structures, etc.

Part 2 Amphitheater and related site improvements (continued)
• There should be electrical service to the amphitheater. Low level site lighting is
planned, with possible relocation or separate switching of the existing light near
the amphitheater site.
• Decomposed granite pathways are to be provided bringing people from the
parking area to the building and to the amphitheater. There will also be a
walkway paralleling the stream bed that can also be used by service vehicles.
• Small group campsites to be relocated. These sites will include a flat tent site pad,
a table and a barbeque /fire pit.
• Steel bollards, steel gate, and monument sign are to be removed. Wood gates and
wood fencing and with stone pilasters would be installed instead.
• Storm drain and other site utilities must be taken into account in the design.
B. Planning Services
1. Prepare base sheet/ site plan.
2. Prepare landscape plan sketch for City staff review.
3. Present two alternative designs/ materials for the amphitheater design.
4. Design site layout to include restoration considerations as recommended by
restoration ecologist, Margot Griswold.
5. Review planting list and planting concepts with City Staff.
6. Respond to comments and prepare final preliminary site/ landscape plan.
(Allow 2 meetings with City Staff during this phase)
TASK 3 - Development of Construction Drawings
A. Landscape Architecture
The landscape architect will provide the following services:
1. Coordination with sub - consultants and design oversight
2. Site demolition plan
3. Site construction plan with construction notes and dimensioning based on the
building and existing site features.
3. Landscape grading plan. Note: This would not include grading quantities,
drainage appurtenances, civil engineering, or civil engineering grading notes.
4. Concept lighting and light fixture suggestions
5. Design details for amphitheater, pathways, and fencing
6. Work with restoration ecologist to finalize design and specifications for
restoration areas.

B. Restoration Design— Restoration Ecologist, Margot Griswold of Earthworks, will
provide criteria and instructions for the restoration areas. Her services will include:
1. Evaluate the setting for the vernal pool. Based on the soils analysis, methods
will be determined to create the water - holding capacity of the vernal pool.
2. Research the feasibility and regulatory processes involved in introducing
animal species to the vernal pool habitat.
3. Provide species lists, planting and seeding specifications, and maintenance
guidelines for grassland and vernal pool habitats.
C. Irrigation Design
Art Guy of BGB, Inc. will provide irrigation plans and details. His services will include:
1. Meeting with park maintenance staff to establish preferred irrigation
equipment list, potential point of connection, available static pressure, mainline
routing, existing valve and other irrigation equipment locations.
2. Review options for irrigation techniques for establishment of grassland.
3. Prepare irrigation plans and details.
D. Paul Kandarian, Southland Energy Consultants will provide the following services:
1. Electrical design, energy compliance documentation, single line diagrams and
panel schedules.
TASK 4 - Complete Construction Documents
A. Prepare technical specifications in book format to meet City requirements. City to
provide boilerplate sections and bid form.
B. Prepare estimate of probable construction cost.
C. Drawings to be signed and stamped by the appropriate design professional.
Submittals:
Submit drawings at 907o and 1007o. Respond to City plan check comments.
Allow 2 meetings with City Staff during this phase
TASK 5 - Biddin& Services during bidding will be provided on an hourly basis
when requested by City.
TASK 6 - Construction Support Services, such as performing site visits and
reports will be provided on an hourly basis when requested by City.
TASK 7 - Post - Construction Support Services, such as performing follow -up site
visits, making recommendations and writing reports will be provided on an
hourly basis when requested by City.

RE: Revised Proposal for Design Services for Tierra de las Pampas Exhibit at the Santa
Ana Zoo.
Dear Mr. Gabriel:
We have enjoyed working with the city on the preliminary phase of planning for the
Tierra de las Pampas exhibit, including the anteater, guanaco and rheas areas. Our
preliminary budget estimates have been reviewed by the city, and we are now submitting
a revised proposal for preparation of contract documents for bidding and construction of
the project, based on a simplified project and reduced scope of work.
The plans will be based on the client- approved design, attached. However, the features of
the plan have been modified as outlined below:
Anteater Area
1. Delete all ornamental rock -like concrete forms, termite mounds and water features
except for one pond for the anteater enclosure.
2. Design the anteater exhibit area as one large enclosure instead of three smaller
enclosures. A separate off - exhibit isolation enclosure will be included.

3. The barrier for the anteater enclosure is to be similar to the arrangement at the Phoenix
Zoo which includes two fences - -a welded wire fence slanted inward to contain the
anteaters, a planted buffer and a barrier for the public.
4. Delete the estancia concept (antique plaster, wrought iron detailing) on the anteater
management building.
5. No custom shelters for the anteaters will be included. The existing tunnel play feature
will be used for one shelter.
Rhea and Guanaco Area
1. Delete the animal enclosures, estancia /storage building, and trellis gathering area.
Keep pampas ranch gate and fencing design perimeter.
2. Keep foot print of the presently designed building and corral area free of planting and
irrigation to allow space for future animal shelters and enclosures. It is planned that zoo
staff will choose modular corral shelters, fencing and gates to be installed independent of
this contract. Water, power, utilities will be stubbed to corral locations under this
contract.
3. The retaining wall / moat between the guanaco / rhea area and the train will remain, but
will continue through the area where the water feature was to have been installed.
Pathways and Look -out Points
1. The pathway through the exhibit will be stabilized decomposed granite with an
uneven edge. The shape of the walkway will be coordinated with the signing designs by
the signing consultant (under separate contract). There will be no or minimal change in
grade to the existing pathway.
2. There will be no seat walls at the look -out points. Benches that reflect the freeform
wood shapes of the pampas fencing will be used instead.
3. In the area of the butterfly garden, enlarge the decomposed granite paving for use as a
concession, eating area. Integrate planted areas so that the paved area seems to be nestled
among the shrubs and part of the exhibit.
The construction documents will be prepared for the project to be completed in one
phase.

Project Design Team
The project design team continues the same professionals who worked on the preliminary
design for Tierra de las Pampas - -Ann Christoph, Landscape Architect, FASLA; Tony
Alves of GPRA, Architects and Dr. Phil Rundel, biological consultant. Added to the team
for preparation of contract documents will be the technical consultants: Southwest Group,
mechanical and electrical engineering; Neno Grguric, Structures, Inc., structural
engineering; Steve Ray, RHA Engineering, Civil Engineer; and Art Guy, Borthwick Guy
Bettenhausen, Irrigation Consultant Information on project team members is attached.

The architect, GPRA, will provide architectural services, with sub - consultants for
structural, mechanical, plumbing and electrical systems for the buildings and gates. In
addition the electrical engineer sub - consultant will provide site electrical. The architect's
scope of work includes:
1. Concrete masonry anteater night building per attached.
2. Pampas gateway at the Rhea/ guanaco area.
D. Irrigation Design
Art Guy of BGB, Inc. will provide irrigation plans and details. His services will include:
1. Meeting with Zoo maintenance staff to establish preferred irrigation equipment
list, potential point of connection, available static pressure, mainline routing,
existing valve and other irrigation equipment locations.
