ORDINANCE AMENDING CHAPTER 14 OF THE MUNICIPAL CODE REGULATING HOURS OF SALE OF FIREWORKS Placed on first reading at the May 5, 2008 City Council meeting and approved by a vote of 7-0. ORDINANCE NS-2766 - An ordinance of the City Council of the City of Santa Ana amending section 14-55 of the Santa Ana Municipal Code relating to hours of sale of Safe and Sane fireworks. EXCUSED ABSENCES -None **END OF CONSENT CALENDAR** WORK STUDY SESSION W.S.A. CODE OF ETHICS AND CONDUCT FOR THE CITY OF SANTA ANA'S ELECTED AND APPOINTED OFFICIALS -City Attorney and Clerk of the Council Offices Jose Sandoval, Chief Assistant City Attorney, presented a brief overview of the process related to the creation of Code of Ethics for the City of Santa Ana as presented to the City Council for their review. Rita Gallardo, Chief Assistant Clerk of the Council, introduced JoAnne Speers, Executive Director of the Institute for Local Government. Highlights of this presentation are as follows: • Discussed rule-based versus values-based ethics codes and the elements of a value-based code and why value-based codes are preferred over rule based codes Discussed the draft values chosen by Commissions/Boards and the Ad-Hoc Committee: Integrity & Honesty, Responsibility/Protecting the Public's Interest, Fairness/Accountability, Respect, and Proper & Efficient Use of Public Resources CITY COUNCIL MINUTES 140 MAY 19, Zook WORK STUDY SESSION • Discussed the legal context and the scope of ethics laws; list of "do's" rather than "don'ts" important to consider; reflects aspirations for conduct based on community's standards; adds another source of guidance for public officials • Three parts to consider for code: code of ethics, expressions of values (code of conduct), and implementation strategy • Implementation strategy for the Code of Ethics: Goal: become part of the culture of ethics in public service in Santa Ana, must be publicized, and will be the standard by which public officials are measured in the City • Ms. Speers complimented the process the City of Santa Ana used to formulate the Code of Ethics Councilmember Martinez left the meeting at 6:25 p.m. W.S.B. FISCAL YEAR 2008-2009 CITY BUDGET OVERVIEW -Finance & Management Services Agency Catherine Standiford, Assistant City Manager, presented an overview of the 2008-2009 City's budget. Highlights of this presentation are as follows: Discussed the economic outlook of the City including slower growth, housing slump and energy costs impacting tax revenues, and, noted that construction and financial markets will be weakest sectors in Orange County Reviewed the City's revenue sources and appropriations, Council/community priorities including public safety, improved transportation infrastructure, deferred Park maintenance, ensured long-term financial stability, improved public access to City Council meetings, and continued funding for expanded library services; proposed workforce changes; modified miscellaneous fees Budget also includes an emphasis on expenditure controls and maintaining funding of all front-line programs and services Public Hearing for the budget will be held at the next Council meeting to be held on June 2, 2008 Materials related to the budget are available for review on the City's website and in the Clerk of the Council's office Mayor Pulido and Councilmember Sarmiento left the meeting at 6:55 p.m. PUBLIC COMMENTS ON ISSUES OF PUBLIC INTEREST -None CITY COUNCIL MINUTES 741 MAY 19, 2008 CITY MANAGER AND COUNCIL COMMENTS 90.A. CITY MANAGER'S REPORT -None 90.B. CITY COUNCILMEMBER COMMENTS Councilmember Tinaiero Thanked staff for their presentation of the City's budget and commented on the number of employees who will retire in the upcoming year which will have an impact on the budget Councilmember Benavides Encourages the community to become involved in the City's budget process and reminded the public that materials for the budget are available for review; Reminded the community of the June 2, 2008 Public Hearing for the adoption of the City's budget Councilmember Bustamante • Congratulated budget staff for their efforts on the budget and stated that over the years, the City's administration has done a good job of managing the fiscal health of the City Mavor Pro Tem Alvarez Thanked employees for a job well done throughout the City of Santa Ana Reminded the community of the next graffiti clean-up to be held on May 31, 2008, in the area of the Windsor Village North Neighborhood, located near Willits and Fairview ADJOURNMENT - 7:24 p.m. Rita Gallardo Chief Assistant Clerk of the Council CITY COUNCIL MINUTES 142 MAY 19, 2008
