In reviewing the final documents for the amendment to include Section 2080l~.5
(pre-membership service credit), we discovered that we fai d._~_.raug-.
paragraph 8 (e)_providing ~o-r -the--payment of $5.00 per member covered under
the 159 survivor program from the contract. We must apologize for this
oversight.
Since the city has been paying for the survivor benefit as a percentage of
member payroll (0.229/) since July 1, 1963, we have prepared documents which

the documents executed and returned to this system as soon as possible.

AND THE
CITY COUNCIL
OF THE
CITY OF SANTA ANA
The Board of Administration, State Employees' Retirement System, hereinafter
referred to as Board, and the City Council of the City of Santa Ana, hereinafter
referred to as Public Agency, having entered into a contract under date of
November 25, 1946 effective July 1, 1917, and as amended effective October 1, 1951,
February 1, 195>.~, September 1, 1956, July 1, 1959, November 1, 1960 and September
1, 1963, which provides for participation of Public Agency in said System, Board
and Public Agency hereby agree as follows:
1. Paragraphs 8 (b) and 8 (e) shall be stricken from said contract and
the following paragraph 8 (b) shall be substituted therefor:
8 (b) 6.922 percent of total salaries paid by Public Agency each
month to its employees who are and hereafter become members
of said Retirement System on account of the liability for
all current service benefits provided that only salary earned
as members of said system shall be included in said total
salaries.
2. This amendment shall be attached to said contract and shall become
effective on the 1st day of September 1963

We have your letter of June 17 in which you transmitted the documents for
the amendment to contract which provides for the crediting of pre-membership
service.
In our telephone conversation last week I told you that final action must
be by ordinance in all agencies which have the authority to act by ordinance
because actions under the retirement law must be subject to the peoples
right of referendum. Therefore.. we are returning the documents and enclosing
the following:
1. Amendment to contract; in duplicate. Please sign and return two
copies to this system.
2. Ordinance, Form 128, in duplicate, approving amendment to contract.
This ordinance must be adopted by affirmative vote of two-thirds
of the members of the governing body no earlier than twenty days
after the adoption of the Resolution of Intention. The number of
days and publications are to be inserted in Section 3 of the form
to comply with local requirements. One copy is to be completed
and returned to this system.
3. Certification of Final Action by the Governing Body, Form 130.
(To be completed and returned to this system.)
Our Membership Division is suggesting that since requests are already being
received for the pre-membership credit that you notify your employees that
the requests will not be acknowledged until the final documents are in and
the effective date firm.

This will acknowledge receipt of your governing body's Resolution of Inten-
tion to amend your contract with this system to include pre-membership
service. We are sending to you the following documents in order to
accomplish the proposed amendment:
1. Amendment to contract, in duplicate. Please sign and return
two copies to this system.
2. Ordinance, Form 128, in duplicate, approving amendment to
contract. This ordinance must be adopted by affirmative vote
of two-thirds of the members of the governing body no earlier
than twenty days after the adoption of the Resolution of In-

Effective date of the amendment cannot be earlier than the first of the
month following the effectivity of final action of your governing body.
The amendment has been prepared using the agency contribution rates which
will become effective on July 1, 1963. However, the current service rate has
been increased by 0.150 to cover agency cost for the pre-membership service
which you are now providing by this contract amendment.

RETIREMENT FUND CONTRIBUTIONS BY EMPLOYEES HIRED PRIOR TO AUGUST 19b1
Employees hired prior to August 1961 were not permitted to participate
in the retirement system during the first six months of their employment.
The Association recommends that City Council pass legislation under the
provisions of Section 20804.5 of the State Code which will enable these
employees to make a contribution to the retirement fund in an amount
equivalent to what they would have paid had they been permitted to be
participating members during the first six months of their employment.
Favorable action by the Council would permit these employees to increase
their period of service by six months for retirement purposes,
It is our understanding that the additional cost to the City would be
minimal in relation to the benefits gained by the employees concerned.
