Authorize the City Manager and Clerk of the Council to execute the
attached amendment to the agreement with the Municipal Water District of
Orange County subject to non-substantive changes approved by the City
Manager and City Attorney to provide water-related educational services
to Santa Ana schools for a one year term, with the option to extend for
a second one year term in an amount not to exceed $52,000 for the first
year and $30,000 for the second year.
DISCUSSION
The City has been offering a water education program to Santa Ana
schools since 1996. This program has been developed and made available
to kindergarten through high school grades through a contract with the
Municipal Water District of Orange County.
The program consists of visits to the schools to give presentations,
complete with visual aids and handouts. The program has been recognized
for excellence, well received by the schools in Santa Ana, and is a
recognized component on the list of best management practices for
ensuring acceptable levels of water conservation.

ENVIRONMENTAL IMPACT
There is no environmental impact associated with this action.
FISCAL IMPACT
Funds for the present fiscal year in the amount of $52,000 are
available in the Water Quality and Measurement Activity (account no.

FIRST AMENDMENT TO AGREEMENT
TO PROVIDE EDUCATIONAL SERVICES
THIS FIRST AMENDMENT TO AGREEMENT is entered into on March 2, 2009,
by and between the MUNICIPAL WATER DISTRICT OF ORANGE COUNTY,
hereinafter referred to as "MWDOC" and the CITY OF SANTA ANA, hereinafter referred
to as "CITY".
RECITALS:
A. The parties entered into that certain Agreement A-2008-303, dated November 17,
2008 (hereinafter "said Agreement") by which MWDOC has provided educational
services to Santa Ana schools on water related issues.
B. Due to bookkeeping errors, the agreement for educational services has been using
current year funding to pay prior year services. That error has been corrected and
said Agreement includes only $8,000 to pay for educational services during the
2008/09 school year.
C. In accordance with the terms and conditions of said Agreement, the parties wish to
increase the compensation available for the provision of such services to continue to
provide services during the current term of said Agreement.
WHEREFORE, in consideration of the covenants contained in said Agreement, and
subject to all the terms and conditions of said Agreement, except those amended in this
First Amendment to Agreement, the parties agree as follows:
1. Section 3 COMPENSATION TO MWDOC shall be amended to increase available
compensation by $22,000 for the 2008/09 school year. Total compensation to be
paid for prior educational services and current year educational services shall not
exceed $52,000.00 during the 2008/09 school year.
2. Except as hereinabove amended, all terms and conditions of said Agreement shall
remain in full force and effect.
