HomeMy WebLinkAboutMETROPOLITAN WATER DISTRICT OF SOUTHERN CALIFORNIA (3) -2005NOV 2 3 Z~~1~ N-2005-079-001 o ; ~i~v~/ ~~~,~~-Cz~ Tcm ~-~ AMENDMENT No. 1 TO THE WATER CONSERVATION FUNDING AGREEMENT NO. 66657 BETWEEN THE METROPOLITAN WATER DISTRICT OF SOUTHERN CALIFORNIA AND City of Santa Ana There is now in effect an Agreement between The Metropolitan Water District of Southern California (Metropolitan) and the City of Santa Ana (Santa Ana) entered into as of 1/1/2005, hereinafter referred to as Agreement. WHEREAS, under this Agreement Metropolitan assists member agencies in implementing a variety of water conservation measures, which includes providing funding to retrofit devices with more efficient models. WHEREAS, Metropolitan's Board approved the Region-wide Commercial /Industrial / Institutional Conservation (CII) Program in January 2004, in which Santa Ana can participate pursuant to this First Amendment. THEREFORE, the parties desire to amend the Agreement with this First Amendment as follows. Pursuant to Section S: Incentive Amount and Payment there will be added the following paragraph: 5.5 Metropolitan funding for specified incentives administered through the CII program shall be in the form of a conservation credit on Metropolitan's water service invoice to Member Agency. In recognition of receiving these incentives, Member Agency pledges to increase efforts to achieve landscape and commercial conservation, and support these programs through local cost share. Metropolitan's financial obligation for funding will be for the time period specified and/or until funds are exhausted on that item or a determination by Metropolitan's Board not to provide a specified incentive. This amendment allows broader participation by your agency in Metropolitan's long- term regional CommerciaUlndustriaUInstitutional (CII) conservation retrofit program by providing a mechanism to credit your agency through Metropolitan's monthly water charge for specified CII incentives.
