FIRST AMENDMENT TO RECREATION SERVICES AGREEMENT
AA be 1--)c` THIS AMENDMENT TO RECREATION SERVICES AGREEMENT is entered
into this I" day of January, 2010, by and between Claudia Carbonell (hereinafter
"Provider "), and the City of Santa Ana, a charter city and municipal corporation
organized and existing under the Constitution and laws of the State of California
(hereinafter "City").
RECITALS
A. The parties entered into Agreement N- 2009 -134, in November, 2009 (hereinafter the
"Agreement ") by which Provider has provided classes through the City's leisure class
program.
B. In accordance with the terms and conditions of said Agreement, the parties wish to
extend the term.
WHEREFORE, in consideration of the covenants contained in said Agreement, and
subject to all the terms and conditions of said Agreement, except those amended in this
First Amendment to Recreation Services Agreement, the parties agree as follows:
1. Section 3, TERM shall be amended to extend the term through June 30, 2011.
4. Except as hereinabove amended, all terms and conditions of said Agreement shall
remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this Sixth Amendment to
Recreation Services Agreement on the date and year first written above.

EXHIBIT A
SCOPE OF SERVICES
• Provider shall provide parent/child participation classes. Participants will play
with a variety of toys, sing, play with musical instruments, have juice time and
participate in craft time.
• Provider shall offer two classes, one for 10 months to two year olds (lhour), and
another class for children two to four years old (1 hour 15 minutes).
• Provider shall conduct the classes, once a week during each five -week session.
• A parent must accompany and participate with each child.
• Provider will provide musical instruments, toys, props, juice /snack, craft supplies
and other appropriate materials and supplies needed to conduct the class.
• If Provider allows others to teach classes, those teachers must be over 21, hold a
valid instructor rating and be covered by Provider's insurance. Provider shall
provide City with documentation of compliance with the foregoing
CLASS SIZE
• Each class must have a minimum of 8 registered and paid parent /child
participants and a maximum of 20.
• If the minimum registration has not been reached by the first class, the class may
be cancelled by the City, without any compensation owed to Provider.
CLASS FEES
The class fee is:
• $32 per parent/ 10 month — 2 year old child per 5 -week session.
• $35 per parent/2 -4 year old child per 5 -week session.
• Each parent /child participant shall pay the instructor a $5.00 materials fee.
No refunds shall be made to participants after the first week of classes unless the class is
cancelled by the Parks, Recreation and Community Services Agency.
The City shall collect class fees from each parent/child participant during the registration
period. Provider shall not collect fees but shall refer all interested participants to City for
registration.
City agrees to pay Provider seventy percent (70 %) of the total fees within fifteen (15)
working days after completion of the class session. City shall retain thirty percent (30 %)
of the fees collected. Provider shall not waive fees.
Provider agrees that City representative shall be entitled to audit Provider's records to
insure compliance with this Agreement.
City shall prepare a class roster. Only registered participants may participate in class.

The limits of insurance apply separately to each event insured by this policy as if a separate policy of insurance has been issued for that event.
"Who is insured" is amended to include, as an insured, the person or organization shown in this schedule, but only with respect to liability arising out of the
ownership, maintenance or use of the premises used by the named insured (event holder). This insurance does not apply to: Any `occurrence" which takes place
after the event holder ceases to be a tenant in that premises.
