MEMORANDUM OF UNDERSTANDING BETWEEN THE COUNTY OF ORANGE
AND THE CITY OF SANTA ANA REGARDING POLICE PATROL SERVICES
IN CIVIC CENTER
This Memorandum of Understanding ("MOU"), dated for
identification this 15 day of October , 1992, is entered
into by and between the COUNTY OF ORANGE, a political subdivision of
the State of California (hereinafter, "COUNTY"), and the CITY OF SANTA
ANA, a municipal corporation organized under the laws of the State of
California (hereinafter; "CITY");
WHEREAS, as used in this MOU, the term "Civic Center area" refers
to that geographical area, external to the buildings, in the City of
Santa Ana, California, bordered by Shelton Street on the West,
Sycamore Street on the East, Santa Ana Boulevard on the South, and
Civic Center Drive on the North; and
WHEREAS, CITY and COUNTY have a mutual interest in providing an
appropriate level of staffing for police services in the Civic Center
area; and
WHEREAS, CITY and COUNTY mutually control, and may authorize
expenditures from, that certain fund known as the Civic Center
Parking/Maintenance Fund (hereinafter, "the Fund"), which said Fund is
derived from the revenues of certain parking facilities in the Civic
Center area which are jointly owned and operated by the CITY and
COUNTY; and
WHEREAS, it is the intention of the parties hereto that CITY,
through its police department, will provide a specified level of

staffing for police services in the Civic Center area, and costs
therefor shall be reimbursed to CITY subject to the limitations and
conditions as are hereinafter set forth;
NOW, THEREFORE, IT IS MUTUALLY AGREED AND UNDERSTOOD as follows:
1. of Ong Levels.
CITY agrees to provide staffing levels for police services
in the Civic Center area as set forth in this paragraph. Seven (7)
Santa Ana police officers will provide visible patrol, including all
appropriate law enforcement services, in the Civic Center area five
days per week, Monday through Friday, excluding Saturdays, Sundays,
and all holidays observed by CITY. Such services will be provided
between the hours of 0530 and 2330 hours, as set forth below. When
any of these seven (7) officers are off work due to paid vacation or
paid sick leave, such officer shall not be replaced by another
officer. The hours and number of officers working each shift in the
Civic Center area are as follows:
0530 to 1400 hours - 2 officers
0630 to 1500 hours - 1 officer
1000 to 1830 hours - 2 officers
1500 to X330 hours - 2 officers
The foregoing hours may be adjusted by Santa Ana Police
Department managers, as necessary to adjust for criminal activity in
the Civic Center area. Each of the officers assigned to Civic Center
area patrol will undergo training one or two days per year, and on
those training days, such officers will not be available to perform
patrol services in the Civic Center area. However, on such training

days, the Santa Ana Police Department will provide a minimum of three
(3) officers to patrol the Civic Center area. All officer's performing
police services under this MOU will receive all State-mandated
P.O.S.T. training.
2. Sa ? day ?r? af;,,gIn addition to the services set forth above, CITY will
provide one (1) Santa Ana police officer to patrol the Civic Center
area on foot each Saturday between the hours of 0730 and 1530 hours.
The primary area of patrol responsibility for this officer will be
between Santa Ana 9oulevard and Civic Center Drive, and between
Sycamore Street and Flower Street, with an emphasis on patrolling the
area between Ross Street and Sycamore Street. This officer will work
on an overtime basis (i.e., the officer will work a Saturday shift in
addition to a regular work week), and will receive overtime
compensation for working this shift.

of providing police services in the Civic Center area pursuant to this
MOU, up to the maximum amount which is budgeted for police patrol
services in the annual Civic Center Parking/Maintenance rued budget,
as approved each year by mutual agreement of CITY and COUNTY. The
maximum amount budgeted for Fiscal Year 1992-93 is $530,900.00, and a
different amount may be budgeted in future fiscal yearn. The term
"actual costs of providing police services" refers to the costs
incurred by the CITY for the salaries and fringe benefits of the Santa
Ana police officers who are assigned to perform patrol services in the

Civic center area pursuant to this MOU. Any costs incurred by the
CITY in providing police services in the Civic Center area, over and
above the amount budgeted in the annual Civic Center
Parking/Maintenance Fund budget (which said amount is $530,900.00 in
Fiscal Year 1992-93 and may vary in future fiscal years), will be
borne and paid for by CITY.
4. Term of this MO 1.
This MOU is effective on and after July 1, 1992 (i.e., the
commencement of the Fiscal Year 1992-93), and will remain in effect
until terminated by either party, as set forth herein: Either CITY or
COUNTY may terminate this MOU effective at the end of any fiscal year
(i.e., June 30 of any year), by giving written notice of such
termination to the other party in writing, at least sixty (60)
calendar days prior to the end of the fiscal year.
5. Amendments.
This MOU can be amended at any time, but only by a written
amendment mutually approved by the City council of CITY, and the Board
of Supervisors of COUNTY.
6. I_ndemnifi a ion.
CITY shall indemnify, defend, and hold harmless the COUNTY
and the Orange County Civic Center Authority, and the officers anO
employees of both of those entities, for any acts, errors, or
omissions committed by or alleged to have been committed by the CITY

SERVICES IN THE SANTA ANA CIVIC CENTER: General Services Agency/
Facilities Operations Division requests approval of a Memorandum of
Understanding for police patrol services in the Santa Ana Civic Center.
MOTION: On motion by Supervisor Vasquez, seconded by Supervisor Roth,
the Board authorized execution of the Memorandum of Understanding with
the City of Santa Ana. MOTION UNANIMOUSLY CARRIED.

Direct the City Attorney to prepare and authorize the Mayor and the
Clerk of the Council to execute an agreement between the County of
Orange, the City of Santa Ana and the Civic Center Commission for
the City of Santa Ana to provide police patrol services in the
Civic Center.
DISCUSSION
The City of Santa Ana has provided police patrol services in the
Civic Center since FY 1991-92. Currently seven Santa Ana Police
Officers provide visible exterior patrol, including all appropriate
law enforcement services. The City is reimbursed for these
services through the Civic Center Parking/Maintenance Fund for the
actual costs of providing police services. The agreement provides
for reimbursement up to a maximum amount of $530,896.00 for FY
1992-93.
FISCAL IMPACT
Funds are available in the Civic Center Security Account (account
no. 74-244-various).
