Brief Background
•CA state assembly bill 481 signed by the Governor on
September 30, 2021
•Created government code sections 7070-7074
•The legislature’s intent was for law enforcement to provide
greater transparency regarding the funding, acquisition, and
use of “military equipment.”
•More specifically, it is designed to provide greater oversight
concerning receiving decommissioned equipment through the
Federal Department of General Services, Defense Logistics
Agency program (“10-33 Program”)

Legal Requirements:
•Government code 7071:
•“A law enforcement agency shall obtain approval of the governing
body, by an ordinance adopting a military equipment use
policy…prior to engaging in any of the following:
•Requesting military equipment made available under the 10-33 program
•Seeking funds for military equipment
•Acquiring military equipment either permanently or temporarily
•Collaborating with another LE agency in the deployment or use of
military equipment
•Using new or existing military equipment

Legal Requirements
•Government Code 7071:
•No later than May 1, 2022, a LE agency
seeking to continue the use of military
equipment acquired before January 1, 2022,
shall commence a governing body approval
process
•The Police Department presented to the City
Council on May 3, 2022, which approved the
Department’s Military Equipment Policy

Conclusion:
•City Council adopted the military equipment ordinance
in May 2022,approving the PD’s Policy
•The PD has completed three annual reports,which
are on our website
•During the reporting periods,military equipment has
only been utilized as a force option eight times
•On average,military equipment is deployed to .030%
of CFS
•Reporting mechanisms continue to improve,ensuring
greater transparency.
