AGREEMENT
THE CITY OF SANTA ANA, a Municipal Corporation and THE CITY OF
FOUNTAIN VALLEY, a Municipal Corporation, both situated in the County of
Orange, State of California, do hereby enter into the following agreement:
WITNESSETH
WHEREAS, City of Santa Ana and City of Fountain Valley contem-
plate the installation of a traffic control signal system and highway light-
ing to provide for the orderly movement of traffic at the intersection of
Edinger Avenue with Newhope Street, within the City of Santa Ana and the
City of Fountain Valley.
WHEREAS, the City boundary line lies within the right of way
of Edinger Avenue; and
WHEREAS, City of Santa Ana has the north leg (Newhope Street)
and a large portion of Edinger Avenue entering the intersection within the
City limits of Santa Ana; and
WHEREAS, City of Fountain Valley has the south leg (Newhope
Street) and a small portion of Edinger Avenue entering the intersection
within the City limits of Fountain Valley; and
WHEREAS, both cities desire to specify the proportionate share
of the construction and maintenance costs to be paid by each City; and
WHEREAS, both cities desire to specify the city responsible for
the construction and maintenance of said traffic control signal system and
highway lighting;
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
SECTION I
For and in consideration of the covenants and conditions to
be kept and performed by the City of Fountain Valley, the City of Santa Ana
agrees :
a. To furnish traffic control signal system and highway light-
ing hereinabove mentioned, through construction by contract with contractors
licensed by the State of California, said contract to be carried out in ac-
cordance with the provisions of the Government Code, and to be completed in
conformity with plans and specifications as approved by City of Santa Ana and
City of Fountain Valley.
b. To bear the City of Santa Ana's share of the expense of
preparation of plans and specifications and construction engineering costs ,
such share to be 61.67% of the Total preliminary and construction engineer-
ing costs.
c. To bear the City of Santa Ana's share of the construction
costs required to complete the traffic control signal system and highway
lighting referred to herein, such share to be 61.67% of the total construction
costs.
d. To acquire and pay for all costs involved in securing all
rights of way and to pay for all costs for all road work within the City of
Santa Ana necessary for the construction of the traffic control signal system
and highway lighting.
e. City of Santa Ana shall maintain and operation the entire
traffic control signal system and highway lighting as constructed.
f. City of Santa Ana will relocate traffic signal equipment
as required in the future by further development of adjacent properties
either within the City Limits of Santa Ana or Fountain Valley.
SECTION II
For and in consideration of the covenents and conditions to be
kept and performed by the City of Santa Ana as set forth in this Agreement,
the City of Fountain Valley agrees:
a. To reimburse City of Santa Ana promptly upon rendition of
statement therefor, City of Fountain Valley's share of expense of preparation
of plans and specifications, construction engineering costs and construction
costs required to complete the traffic control signal system and highway light-
ing, such share to be 38.33% of the total preliminary and construction engineer-
ing costs and construction costs.
b. To reimburse the City of Santa Ana promptly upon rendition
of statement therefore, City of Fountain Valley's share 38.33% of the Total
subject intersection's traffic signal system and intersection lighting main-
tenance and operational expenses.
c. To acquire and pay for all costs involved in securing all
rights of way and to pay all costs for all road work within the City of
Fountain Valley necessary for the construction of the traffic control signal
system and highway lighting.
d. To reimburse City of Santa Ana for the actual costs of
relocating, by City of Santa Ana Public Works personnel or designated con-
tractor, any traffic signal facilities requested to be moved by the City of
Fountain Valley that are located within the City of Fountain Valley, location
to include present boundaries and future changes , if any.
WITNESS WHEREOF, the parties hereto have caused this Agreement
to be executed by their respective officers, duly authorized by the City of
Fountain Valley this 21st day of October , 1969, and by the City
