Dear Santa Ana City Council, My name is Annika van der Hoek, and I live in Santa Ana. I was diagnosed with Crohn's Disease, a type of Inflammatory Bowel Disease (IBD), when I was 12 years old. I am the vice president of the Take Steps Youth Leadership Committee, a group of high school advocates that are committed to creating a difference in the IBD community. Through the Take Steps Youth Leadership Committee, I've worked to empower other young people with IBD to share their stories and advocate for themselves. As a committee, we aim to raise awareness, fund research, and build a stronger community for those living with Crohn's disease and ulcerative colitis. I would love the opportunity to attend a City Council meeting to share my personal experience and help raise awareness about IBD within our community. My goal is to help others understand the realities of living with this invisible illness and highlight ways Rancho Santa Margarita can support those affected. We've been quite busy since my last visit to an Arts Commission meeting, and I wanted to update you on the success of our 16t" OC Film Fiesta and let you know about some recent programs and great events we have coming up. First off, I am happy to announce that MASA is celebrating its 10th Anniversary this year! Keep your eyes open for special 10th Anniversary programming! In September, we partnered with VAALA to host their Youth in Motion video program. In October, we presented the 16t" OC Film Fiesta, which continued our commitment to present films by US and international Latine, BIPOC, AAPI, and MENASA filmmakers, students, women, LGBTQ+, first-time directors and Orange County filmmakers. We had filmmakers visit from Fresno, Utah, Arizona, Mexico City and Argentina. Special guests included Chicano film legend Pepe Serna (Scarface, Buckaroo Banzai, American Me, Car Wash), and Rossana de Leon, one of the stars of Eugenio Derbez's Apple TV+ series Acapulco. I wanted to share a wonderful review we received from Argentine filmmaker Sebaztian Baz, Writer/Director/Producer of the short film Sombras Chinas, which we screened. Dear Santa Ana Arts Commissioners, This year, Arts OC, the City of Santa Ana and United Artists of Santa Ana submitted a proposal to the California Arts Council's Cultural Districts program to designate Historic Main Street as a California Cultural District. The proposal was selected as a semi-finalist, and a site visit was scheduled for October 23, to include a meeting with Main Street arts leaders and a tour of arts organizations. A few days before the visit, we learned that Alicia Rojas was mobilizing people to protest the meeting and was preparing a letter to the CAC to shoot down the proposal. My first response was to request a meeting to hear their concerns. I was told this was not an option, so the difficult decision was made to pull the proposal from competition rather than risk portraying Santa Ana in a negative light. I have obtained a copy of this letter, which was signed mainly by Alicia's clique of friends and family, and having read it, I want to call the Commission's attention to the fact that it is based on numerous key inaccuracies and falsehoods. These include: 1. The letter attacks the reputation of Arts OC and asserts that Arts OC was a partner in Downtown Inc's famously reviled 2017 proposal to this program. The letter goes to great length to list the failures of that proposal. The problem is, it was Grand Central Art Center, not Arts OC, who was a lead partner on the 2017 proposal. To infer any relationship between the 2017 proposal and this one is nonsense. It must be noted that John Spiak, who is a signer on the letter submitted to the CAC, was director of Grand Central in 2017. It is alarming that he would put his name on a letter assigning blame to Arts OC, a highly respected organization, for a proposal that his own organization was a lead partner on. This one substantial error alone delegitimizes Ms. Rojas' letter and raises concerns about how this issue was presented to the signers for support. 2. The letter falsely misrepresents the proposal's statement regarding UASA's involvement with the organizations mentioned. In her letter, Ms. Rojas avows "Several organizations listed as "partners" or collaborators have never worked directly with United Artists of Santa Ana (UASA)."This is a misrepresentation. What the proposal actually says is "United Artists of Santa Ana's members have worked directly with numerous organizations in the district,"which is true of the organizations mentioned in the proposal. Ms. Rojas' letter contains too many inaccuracies, aspersions, falsehoods, misrepresentations and personal attacks than there is time to discuss here, but I wanted to bring this to the Commission's attention to set the record straight and defend ourselves. i The letter to the California Arts Council makes numerous attacks against United Artists of Santa Ana and its members, and we attest that this stems from Ms. Rojas' ongoing vendetta against UASA since she resigned from the organization and unsuccessfully tried to destroy it in 2013. Since that time, she has engaged in numerous attempts to defame the reputation of its members, including lies, smear tactics and letter campaigns such as this one. United Artists of Santa Ana members are respected in Santa Ana's arts and culture community and contribute positively to it, despite Ms. Rojas' obsessive desire to damage our reputation and erase our contributions. This points to perhaps the real motivation behind Ms. Rojas attack of this year's cultural district proposal, because the proposal she lambastes in her letter bears no resemblance to the proposal we submitted. Additionally, we have already spoken to one person Ms. Rojas contacted who now understands that a supposed problem with the proposal was misrepresented to him. It is widely-known that Ms. Rojas mobilizes her clique, whether they are friends, family or City Commissioners with a conflict of interest, to viciously attack her enemies and gushingly promote her projects for her own personal gain. We witnessed these same tactics used to divide our community when Ms. Rojas left UASA in 2013, and we recognize them at work in this situation. As such, it is my opinion that the actual purpose of the defamatory letter to the California Arts Council was to cause reputational and financial harm to its targets. Regardless of whether the inaccuracies and falsehoods in the letter to the CAC were intentional and designed to misrepresent the situation, or were the result of a sloppy and reckless process, the attack on the intended targets was focused and clear. I hope this adds to your understanding of the context and possible motives for Ms. Rojas' letter and attacks on United Artists of Santa Ana and its members. Finally, I wanted to let you know that we have formed a Historic Main Street Cultural District Steering Committee, and we look forward to interfacing with the City and the Arts Commission as we proceed with the important work of creating a Historic Main Street Cultural District that serves the needs of the diverse artists, organizations and businesses on Historic Main Street. We especially acknowledge that this funding—originally approved by City Council in 2022—only moved forward earlier this year after it was brought to your attention that the Arts & Culture Office had not acted on it for nearly three years. However, we must also share our serious concerns regarding the contracting process and the most recent RestoreART agreement sent to us on November 19, 2025, which again requires artists to waive all federal VARA (Visual Artists Rights Act) protections. We cannot sign a contract that asks us to surrender rights granted by federal law. RFP Timeline & Communication Failures The RestoreART RFP was finally released in March 2025, years after funding was approved. The RFP awarded additional points for community engagement, yet because the Arts & Culture Office failed to adhere to its own timeline—and provided no communication with artists—several of our planned community engagement activities are no longer feasible. Despite being selected and approved by the Arts & Culture Commission in June 2025, the first contract was not sent until August. Three Contracts, Repeated Errors, and Rights Waivers The first August contract: • included incorrect grantee names, • required us to waive our VARA rights. We immediately emailed our concerns to Tram Le, Michael Garcia, and Marc Morley. Tram Le replied apologizing for sending the wrong contract, acknowledging the errors. A second corrected contract was sent soon after: • with our accurate names, • without a VARA waiver. We signed that version on August 19 and waited for the fully executed copy. To our surprise, on November 19, we received a third contract, again requiring: • new signatures, and • a full VARA waiver, identical to the one already acknowledged by staff as incorrect. This demonstrates a concerning lack of review, accuracy, and understanding of VARA rights within the Arts & Culture Office. Historical Evidence of the City's Pattern We are also attaching the Orange County Register article "The Art of Neglect" (August 26, 1999), featuring artist Sergio O'Cadiz standing before his partially destroyed civic art mural at Santa Ana City Hall. The article shows how major portions of his concrete relief mural were demolished during City construction without his knowledge, without notification, and without consent—a direct violation of the moral rights later codified in VARA. (Reference: article images, pages 1-2) In addition, as widely reported by Voice of OC in 2024, Santa Ana nearly lost another important cultural artwork: the Chicano Gothic mural at Memorial Park. The City moved forward with construction plans that placed the mural at risk of demolition, and only community outcry prevented its destruction. This controversy highlights exactly why VARA exists and why federal protections should never be waived in a City-led restoration program. Additional Santa Ana Mural Losses Across the Decades Many murals from the 1970s and 1980s—including several created by Orange County and Santanera artist Marina Aguilera, along with other young muralists of that era—have been whitewashed, sandblasted, or destroyed over the years. For example: • Marina Aguilera's 1976 mural at the Salvador Park handball courts, the very mural she won the RestoreART grant to restore, was sandblasted by the City in the early 1980s. • Another of Marina's murals, painted in 1974 outside the Salvador Park community center in the pool area, was painted over with beige paint around the early 1980s. The original artwork is still under all the many layers of paint that have been applied throughout the years. These losses further underscore the historic pattern of public art destruction in Santa Ana and the critical need for the City to protect, rather than erase, the rights of its artists. Our Request We ask City Council to please direct the City Manager and City Attorney to issue a new contract that: 1. Removes the VARA waiver entirely, 2. Complies with federal law and standard public art practices, and 3. Respects artists' rights, property rights, and our cultural legacy. We remain committed to serving the City through our restoration work.
