HomeMy WebLinkAboutORANGE COUNTY SCHOOL OF THE ARTS (3)INSURANCE NOT ON FILE WORK MAY NOT PROCEED A-202�-487 CITY CLERK DATE: DEC 0 3 20A C"M (k) FIRST AMENDMENT TO AGREEMENT WITH ORANGE COUNTY SCHOOL OF fIGA<,)Vivevto'AD2) THE ARTS FOR A SCHOOL RESOURCE SERVICES OFFICER THIS FIRST AMENDMENT to the above -referenced agreement is entered into on November 4, 2025, by and between the Orange County School of the Arts ("OCSA") and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California ("City"). RECITALS A. The parties entered into Agreement No. A-2024-027 ("Agreement") dated February 20, 2024 to assign a Santa Ana Police Department ("SAPD") Officer as a School Resource Officer ("SRO") to OCSA to provide safety for students and staff on OCSA's campus. The term of the Agreement runs until March 31, 2027. The Agreement is current and in - effect. B. City and OCSA recognize the importance of ensuring the assigned SRO is collaboratively selected. In addition, the Parties would like a provision that allows the City to provide a substitute SRO to OCSA and outlines costs associated with scheduling the SRO on Fridays and other events as agreed upon by the parties. C. The parties now wish to amend the Agreement to add a provision to allow OCSA to provide input in selecting an SRO, allow for scheduling of an additional SRO on Fridays, as needed, and to increase the overall compensation to the Agreement. No other changes are contemplated by this Amendment. The Parties therefore agree: Section 6, QUALIFICATIONS/STANDARD OF CARE AND CONTROL, is hereby amended to add subsection 6.3 as follows: 6.3 SAPD and OCSA shall meet and confer at a mutually agreeable date, prior to the commencement of a new school year, to review potential candidate(s) to serve as an SRO officer or substitute SRO officer(s). SAPD will provide OCSA information about the proposed candidates. The parties agree to scheduling meetings with the potential candidates, to allow OCSA staff sufficient time and information to review and provide SAPD its input regarding the selection of the SRO and any substitute SRO officer(s). OCSA shall provide their comments and recommendations at a mutually agreeable date prior to the start ofOCSA's school year. OCSA agrees SAPD shall make the final selection of the SRO officer or substitute SRO officer(s). All information SAPD provides to OCSA about potential SRO candidates SRO shall be deemed confidential and OCSA shall not disseminate that information to any outside parties. 2. Section 5, Substitute Officer, is hereby amended and shall read as follows: 5. Substitute Officer a. In the event the assigned SRO is absent for any reason, SAPD will make every effort to provide a substitute SRO for that period of the absence. OCSA will not be responsible for any additional expenses associated with such substitution excluding overtime pay for coverage. The parties shall develop guidelines for the hours of substitute coverage in the event the assigned SRO is absent (e.g. sick, vacation, holiday, etc.) to minimize overtime expenses. b. As provided in Section 6.3, SAPD shall maintain a list of selected officers to act as a substitute SRO officer(s). Should SAPD be unable to provide a substitute SRO, SAPD shall immediately notify a designated representative of OCSA. c. As detailed in Exhibit A, Duties and Responsibilities, Section A.I, re Schedule, where an SRO is assigned to their forty (40) hours under a 4-day, I0-hour day weekly work schedule, OCSA may request a substitute SRO be assigned to work at OCSA for a full 8-hour shift on Fridays only. Such assignment shall be subject to overtime pay. Costs and details for scheduling shall be agreed upon, in writing, by the parties. Section 2.1, Compensation, is hereby amended to increase the overall compensation by $50,000 per year or $100,000 over the remainder of the term of the Agreement. 4. Except as modified by this First Amendment, all terms and conditions of the Agreement shall remain in full force and effect.
