Re: First Amendment to Side Letter (A-2023-194-15A) Bella Terra Residential Community and
Temple Project—Initial Study/Mitigated Negative Declaration
Pursuant to Section 1 ("Scope of Services") of Agreement No. A-2023-194-15 entered into by PSOMAS
("Consultant") and the City of Santa Ana, dated November 7, 2023, and the above referenced Side Letter
Agreement between the parties dated March 24, 2025, Consultant hereby accepts this amendment to said
Side Letter Agreement for the continued assignment of on-call environmental and planning services for the
project listed above.Consultant shall continue to provide and complete services by June 30,2026. All other
terms and conditions of said Agreement remain unchanged and in full force and effect.

Psomas appreciates the opportunityto submit a Scope of Work(SOW),Cost Estimate, and
Schedule for preparation of an Initial Study/Mitigated Negative Declaration (IS/MND)for the
proposed Bella Terra Residential Community and Temple (Project or proposed Project), located in
Santa Ana (City).The services for all tasks related to the IS/MND, as scoped herein, assume an end
date of December 31, 2025.The City of Santa Ana is the Lead Agency on the environmental
document.
Psomas is a full-service environmental,engineering, construction management,and land survey
firm. Psomas' Environmental and Resource Management Group provides California Environmental
Quality Act(CEQA)and National Environmental Policy Act(NEPA) documentation; biological
resources surveys and assessments; regulatory services and permitting; habitat restoration
planning; cultural resources assessments and monitoring; air quality, greenhouse gas emissions,
and noise analyses; and Geographic Information Systems (GIS) mapping and spatial analyses.
Psomas proposes a Project team with CEQA expertise in in-fill re-development residential projects
to assist the City and the Project team with preparation of an IS/MND for the proposed Project. I,
Alia Hokuki,AICP, am a Senior Project Manager and Vice President with over 29 years of experience
in preparing environmental documentation pursuant to CEQAfor a variety of project types,
including residential and nonresidential in-fitl projects. In addition, I will operate as the main point
of contact and Principal-in-Charge to the City and Project team with the responsibility of ensuring
work is completed on schedule and within budget.Jessica Hitchcock will be the Project Manager,
and we will work closelythrough completion of the Project.
We will be supported by a team of highly qualified and experienced in-house staff, and
all technical analyses included in this SOW will be conducted by Psomas'technical
staff.We assume a Hydrology and Water Quality Management Plan,a Geotechnical

Investigation, and a Phase I Environmental Site Assessment(ESA) may be prepared by the
Applicant's team and will be provided to Psomas for use in the environmental document.
Attachment A includes our proposed SOW for preparing and processing an IS/MND;Attachment B
includes the Cost Estimate for ourwork effort; and Attachment C includes the Schedule for the
Project.

SCOPE OF WORK
BELLA TERRA RESIDENTIAL COMMUNITY AND TEMPLE PROJECT
INITIAL STUDY/MITIGATED NEGATIVE DECLARATION

PROJECT UNDERSTANDING
The 2.465-square-foot Project site consists of three lots at 4006,4010, and 4018 West Hazard
Avenue, in Santa Ana. Local access and regional access are provided by North Harbor Boulevard
and State Route(SR 22), respectively.The Project site is within a built-out and urbanized portion of
the City of Santa Ana and is surrounded by residential development on all sides.The lots are
developed with three single-family detached homes and their detached garages/accessory
buildings,which will be demolished to accommodate the proposed Project.
The Bella Terra Residential Community and Temple(Projector proposed Project) involves
amending SD-53 to facilitate the construction of a 3,200-square-foot religious facility(temple)and
the development of 12 fee simple lots,ranging from 3,460 to 4,501 square feet. Each lot will
include a two-story,single-family residence,with homes varying in size from 1,576 to 2,563 square
feet,and a two-car attached garage.
The Project site has a General Plan Land Use designation of Low-Medium Density Residential(LMR)
and a Zoning designation of Specific Development No. 53(SD-53).The SD-53 will be amended to
accommodate development of the proposed Project.
ENVIRONMENTAL ANALYSIS APPROACH
Based on the Request for Proposal(RFP),either an Initial Study/Mitigated Negative Declaration
(IS/MND), an Addendum to the IS/MND for a project previously proposed on the site,or a
Subsequent IS/MND will be prepared for the proposed Project.The Project site was entitled in 1988
for the development of 17 fee simple lots, detached single-family homes,and a "tot lot".The City
has acknowledged that limited information exists regarding the previous IS/MND and associated
technical studies. Considering the previous IS/MND and associated technical studies may not be
available, and because an Addendum to an IS/MND or a Subsequent IS/MND need to reply on an
existing certified IS/MND, Psomas believes the said document types will not be feasible CEQA
options for the proposed Project.Therefore, Psomas proposes to prepare a stand-alone IS/MND for
the Bella Terra Project.
Psomas will prepare the IS/MND in accordance with CEQA(California Public Resources Code,
Sections 21000 etseq.)and the State CEQA Guidelines(California Code of Regulations, Title 14,
Section 15000 etseq.).Additionally, Psomas will take into account the City's requirements and
specifications.
SCOPE OF ENVIRONMENTAL SERVICES
Below is the SOW for the proposed Project IS/MND based on our understanding of the Project and
the information contained in the City's RFP.The SOW includes the following tasks:

TASK 1 PROJECT INITIATION
Subtask 1.1 Kick-Off Meeting
Psomas will attend a virtual or in-person kick-off meeting with the City,the Applicant,and the
Project team,as appropriate.This meeting will provide an opportunity to discuss the approach to
preparing the environmental document;further define the SOW; identify and discuss the key
community issues and concerns,as applicable;and identify information needs.The Project
schedule will be discussed,and key milestones defined. It is assumed that available Project
information will be provided at this meeting. It is also assumed that the technical studies prepared
bythe Applicant will be provided to Psomas for use in the environmental document.
If requested, Psomas will prepare and electronically submit the meeting minutes from the kick-off
meeting to the Cityfor review and comment. Upon receipt of comments,the meeting minutes will
be revised and distributed.
Subtask 1.1 Deliverables

Subtask 1.2 Data Collection and Site Visit
Psomas will prepare a Data Needs Request to obtain data related to Project construction activities
and operations that will be needed for the technical analyses prepared for the environmental
document.Work can typically proceed on tasks that are not dependent on forthcoming
information. Psomas will review existing City documents, including but not limited to the Santa Ana
General Plan (2022);the General Plan Final Recirculated Draft EIR (2021) (General Plan EIR);the
Zoning Ordinance;and other pertinent documents.
Additionally, Psomas will conduct a site visit to assist in the description of the environmental
setting and to photographically document the site and surrounding area.

Upon receipt of Project information, Psomas will draft a Project description,which will include
details related to short-term construction activities and long-term land uses and operations of the
Project.The draft Project Description will be submitted electronicallyto the City for review and
comment.Once approved bythe City,the Project description will be distributed to the Project
team to initiate technical analyses.

TASK 2 TECHNICAL ANALYSES/STUDIES
Subtask 2.1 Proposed Technicaj-Analyses
Several technical analyses will be prepared as part of the IS/MND sections by Psomas' in-house
technical experts in support of an adequate environmental document, consistentwith CEQA
requirements.These analyses include Air Quality and Greenhouse Gas (GHG) Emissions,Cultural
and Tribal Cultural Resources, Energy, Noise, and Transportation.The scopes are provided below.
Air Quality and Greenhouse Gas Emissions
Psomas will prepare air quality and greenhouse gas(GHG)analyses to evaluate the potential
impacts related to the Project. Based on information provided, Psomas will draft reasonable worst-
case scenarios for anticipated construction activities(i.e., most intensive please,type of
construction, construction start and completion dates, anticipated soil export and import,
equipment mix)and long-term operations to be used as the basis of the air quality modeling.
Psomas will calculate the Project's construction and operational criteria pollutant regional(mass)
emissions using the latest version of the CaIEEMod air pollutant emissions model. Model results
will be compared with the SCAQMD's CEQA mass emissions thresholds.SCAQMD Localized
Significance Thresholds Look-Up Tables will be used to analyze exposure of nearby off-site
sensitive receptors; as such, no site-specific dispersion modeling is proposed as part of this scope
of work. It is expected that the Project would not generate traffic congestion at a major intersection
at a magnitude that would cause a local carbon monoxide(CO) "hotspot"due to the lack of motor
vehicle trips and traffic congestion.Thus, no dispersion modeling is included in this Scope of Work
for CO analysis.The analysis will include an evaluation of Project conformity with the Air Quality
Management Plan for the South Coast Air Basin, as well as an analysis of Project consistoncy with
relevant GHG reduction plans.A discussion of potential mitigation measures may be included if
Project emissions result in air quality or greenhouse gas emission impacts.The findings will be
provided in the Air Quality and GHG sections of the environmental document.
Cultural,Resources and Tribal CuLturall
Background Research. Psomas will submit a request to the California Historical Resources
Information System. (CHRIS)at the South-Central Coastal Information Center(SCCIC)to conduct a
records search for the Project site, including a 1/2-milo search radius.The SCCIC currently
estimates one month from the date of request to receive the results of the records search.
Additionally, Psomas will request the Native American Heritage Commission (NAHC)conduct a
search of the Sacred Lands File(SLF)database for the Project site.The NAHC currently estimates
four weeks from the date of request to receive the results from the Sacred Lands File database.
Psomas will also request a paleontological resources records search and literature review for the
site from the Vertebrate Paleontology Section of the Natural History Museum (NHM)of Los Angeles
County.The NHM provides a letter summarizing information on geological formations and known
paleontological localities(if any)near the Project site,and a determination of the paleontological
sensitivity of the geologic units underlying the site.The NHM currently estimates three weeks from
the date of request to receive the results of the records search.
it V' ' . Psomas will also complete one visit to the Project site.This SOW assumes that no
cultural resources,either newly identified or previously recorded,will be encountered in the
Project site that will require documentation and/or evaluation. If cultural resources are identified,a
Side Letter Amendment will be required.This process would require re-submission to legal for review
and signatures.

Tribal Consultation. If requested by the City, Psomas will provide tribal consultation support as
needed to the City to fulfill the agency-to-agency consultation requirements of Assembly Bill 52(AB
52) and Tribal Cultural Resources (TCR)as well as Senate Bill(SB 18).
AB 52 requires a Lead Agency to provide formal notification to tribal representatives that are
traditionally and culturally affiliated to the geographic area where a Project is located.This task
assumes the preparation of up to eight letters on the City letterhead; one round of review by the
City; and up to four hours of telephone consultation in concert with the City,as needed to consult
with Tribes.The tribal representatives have 30 days to request consultation upon receiving the AB
52 notification letter, and they have 90 days to request consultation for SB 18. Psomas can provide
further support related to AB 52 and SB 18 consultation,such as additional meetings, minutes, or
additional site visits, subject to a Side Letter Amendment.This process would require re-
submission to legal for review and signatures.
The results of the records searches,site walk, and tribal consultations will be compiled and
described in the appropriate sections of the required environmental document. If potential
significant impacts to resources are identified, Psomas will recommend mitigation measures to
addressthose impacts.
This scope of work does not include evaluations of historical properties. Evaluation of properties
will require a Side Letter Amendment.This process would require re-submission to legal for review
and signatures.
Ener
Psomas will develop an Energy Analysis for the Project,which will include a discussion of the
regulatory setting,energy demands, Project energy efficiency measures, impact assessment, and
mitigation measures, if necessary.The regulatory setting will include a discussion of the local,
State,and federal policies and regulations that applyto the Project.The discussion of Project
related energy demands wilt include quantification of anticipated energy consumption from the
Project's construction and operations phases.Construction phase energy demand is due to diesel
and gasoline consumption used during the development of the Project.The operations phase of
the Project would consume energy related to lighting and heating needs as well as vehicle trips.
Potential impacts will be assessed relative to Project consistency with the Energy Element of the
City of Santa Ana General Plan and State of California Energy Efficiency Standards.An
environmental analysis section for Energy will be prepared to discuss the findings of the
quantitative energy analysis.Quantification sheets detailing Project energy consumption will be
provided as an appendix.
Noise
Psomas will prepare a noise and vibration analysis to evaluate potential impacts attributable to the
Project. Psomas will visit the Project site to identify existing noise sources and to measure existing
noise levels at the Project site boundaries.A total of eight short-term noise measurements (20
minutes each)will be collected from at least four different locations to characterize ambient noise
levels at each of the site boundaries. Psomas will model construction noise levels at the nearest
sensitive land uses using the Federal Highway Administration's Roadway Construction Noise
Model(RCNM) based on information provided in the Data Needs Request.Analysis of potential
vibration impacts will be assessed based on methods established by the Federal Transit
Administration (FTA).

Psomas will also review the Project plans,design,and Traffic Memorandum to evaluate operational
noise impacts to offsite sensitive receptors (i.e.,the residential units located to the north, south,
east,and west). Onsite noise sources such as the operation of HVAC units and common
residential activities will be qualitatively evaluated against the standards contained in the City's
General Plan and Noise Ordinances. Increases in traffic noise on local roadways will also be
discussed and quantified. If mitigation measures are required to minimize noise and vibration
impacts, recommend measures will be coordinated with the City. Lastly,a discussion on aircraft
noise emanating from the John Wayne Airport will be included,even though the Airport is located
over five miles southeast of the Project site.A Noise section will be developed summarizing the
findings of the analysis,and the support data and calculations will be provided as an appendix.
Transportation
Psomas will provide a Traffic Memorandum for the Bella Terra development;a Traffic Impact
Analysis(TIA) is not anticipated to be required due to the size of the Project. The Project is
expected to generate 11 net peak hour trips and 128 net daily trips. Based on City of Santa Ana
guidelines,the Project will screen out of Vehicle Miles Traveled (VMT)due to its location in a low-
VMT area. Psomas will provide a Memorandum to document the screening and additional discuss,
as necessary. The Memorandum will include the following:
• A description of existing transportation facilities and traffic control in the immediate
Project vicinity
• A discussion of Project site access
• Trip generation estimates for the Project
• A discussion of VMT screening
• Res ponsos to the four CEQA transportation questions
A 24-hour count will be conducted on West Hazard Avenue along the frontage of the Project to assist
with the air quality and noise analyses. No analysis or traffic design is assumed in this SOW. If the
City determines that a TIA is required, a Side Letter Amendment will be required.This process would
require re-submission to legal for review and signatures.
5ubtask2.2 Peer Review of Existing Technical Studies
As indicated above,we assume a number of studies (i.e., Hydrology and Water Quality,
Geotechnical, and Phase I ESA) may have been prepared by the Applicant's consultants for the
Project. If these reports are available and provided to Psomas,we will conduct a review of each of
the studies for CEQA adequacy and prepare a Memorandum summarizing the comments and
recommendations, as necessary.

TASK 3 INITIAL STUDY/MITIGATED NEGATIVE DECLARATION
Subtask 3.1 AdministrativeDraft Initial Study/Mitigated Negative Declaration
Psomas will prepare an Administrative Draft IS/MND using the CEQA Environmental Checklist
Form (Appendix G). In compliance with Section 15063(d)of the State CEQA Guidelines,the IS will
contain the location of the Project site; a discussion of the environmental setting; a description of
the Project; identification of the Project's potential environmental effects;and a discussion of any
required mitigation.
The discussion of the environmental setting will be based on a review of existing information;
studies provided by the Applicant(if available)and analyses prepared by Psomas; review of aerial
photographs;and a site visit.The environmental analysis will include an explanation for all
checklist responses to provide an understanding of how the IS/MND conclusions were reached.
Project-spocific mitigation will be developed for impacts that are determined to be potentially
significant.
The findings of the technical analysis conducted by Psomas and included above in Subtask 2.1,will
be incorporated in the appropriate sections of the Administrative Draft IS/MND and the supporting
data will be included as appendices.All other topics in the Administrative Draft IS/MND (i.e.,
Aesthetics,Agricultural and Forestry Resources, Biological Resources, Land Use Planning, Mineral
Resources, Population and Housing, Public Services, Recreation, Utilities and Service Systems,
and Wildfire)will be analyzed and discussed qualitatively. It is noted that if a Phase I ESA is not
prepared bythe Applicant and not available for use in the Administrative Draft IS/MND, Psomas will
contract with Environmental Data Resources(EDR)to complete a radius search of hazardous
materials databases. Psomas will summarize the findings of the report in the Hazards and
Hazardous Materials section of the IS/MND and include the report as an appendix.
Upon completion,the Administrative Draft IS/MND will be submitted electronically to the City for
review and comment.
Subtask 3.1 DeUverables

Subtask 3.2 Screencheck Draft and Draft Initial Study/Mitigated Negative Declaration
Following review of the Administrative Draft IS/MND by the City, Psomas will revise the document
to incorporate comments received and prepare the Screencheck Draft IS/MND.This task
anticipates that comments received will require only one set of revisions. Psomas will then
resubmit the document to the City for final approval prior to distribution.
Since the proposed Project requires submittal to the State Clearinghouse(SCH), a 30-day public
review period is required. Psomas will submit the IS/MND, includingthe appendices,the Notice of
Intent(NOI),the Notice of Completion (NOC),and the State Clearinghouse(SCH)Summary Form
to the SCH via CEQA Submit. Psomas will file the NOI to adopt an MND and the NOC with the
County Clerk.A notice is also required to be published in local newspapers or, at a minimum,
posted at the Project site. It is assumed that Psomas will prepare the notice,but the Applicant will
post it at the Project site and submit it to the newspaper for publication.

In addition to submittal to the SCH, electronic copies(USBs) of the IS/MND will be provided for City
staff(to be posted on Citywebsite).Additionally, Psomas will distribute the USBs and hard copies
of the NOI to public agencies, using a distribution list to be provided by the City. Further,the NOI
will be distributed to the property owners around the site(radius to be determined by the City),
based on a mailing list provided by the Applicant.

Subtask 3.3 Responses to Comments and Final Initial d /Miti ated Negative Decl r tion
Once the public review period has ended, Psomas will coordinate with the City to review the
comments received and to develop an approach for addressing the comments. Preparation of
responses to comments on an IS/MND is not required by CEQA but recommended to assist the
City in the decision-making process.All environmental comments on the Draft IS/MND will receive
responses.The Response to Comments(RTC)document will be submitted to the City for review
and then revised based on comments received and transmitted to the City.The City's decision-
making body must consider the proposed Final IS/MND together with any comments received
duringthe public review process.
A total of 40 hours of technical staff time is assumed to prepare the RTC document.Should a large
number of comments be received,the estimated budget for completing the RTC document may
need to be revised, and a Side letter Amendment requested.This process would require re-
submission to legal for review and signatures.One round of review by the City staff is assumed for
the Final IS/MND.
Psomas will prepare the Notice of Determination (NOD)for the Project,which will be signed by the
City upon certification of the IS/MND and action on the Project. Psomas will file the NOD with the
County Clerk and the SCH.This SOW does not include the filing fees for the County Clerk and the
California Department of Fish and Wildlife fee (if the fee is not waived by CDFW),which will be paid
by the Applicant at the time the NOD is filed.

Through the course of IS/MND preparation, if mitigation measures are identified,in compliance
with Section 21081.6 of the California Public Resources Code, Psomas will prepare a Mitigation
Monitoring and Reporting Program (MMRP)as part of the Final IS/MND document.The MMRP will
be prepared in matrix format and will provide the timing and responsibility for each mitigation
measure. It should be noted that, later duringthe public hearings,if the Planning Commission or
City Council modify the Project and/or recommend standard conditions of approval/mitigation
measures for the proposed Project, Psomas will revise the MMRP. However,substantial
modifications to the MMRP are not assumed in the SOW and fees for this Project.

Subtask4.1 Project Management
Psomas will be responsible for managing the CEQA process for document(Addendum or IS/MND).
This includes ongoing coordination with the City and Project team to ensure compliance with the
SOW and schedule and to ensure that information is disseminated,as necessary.
