Sullivan and 2602 W. Fifth streets) RECOMMENDED ACTION Adopt a resolution approving Conditional Use Permit No. 76-38-MOD-1 to allow the expansion of an existing self-storage facility and to modify previously approved conditions, as conditioned. EXECUTIVE SUMMARY Extra Space Properties 103, LLC (“Applicant” and “Property Owner”), is requesting approval of Conditional Use Permit (CUP) No. 76-38-MOD-1 to modify the existing CUP approval in order to allow the expansion of the existing mini-warehouse facility, commonly known as self-storage, at 212-280 N. Sullivan and 2602 W. Fifth streets (“Project”). This request is made pursuant to Sections 41-472.5(p) and 41-649 of the Santa Ana Municipal Code (SAMC), which allows for self-storage facility use with a CUP and modifications to approved entitlements, subject to review and approval by the Planning Commission. Staff is recommending approval of the proposed expansion of the existing self-storage facility, as it is consistent with the General Plan land use designation, supports several General Plan goals and policies, and aligns with the vision for the West Santa Ana Boulevard Focus Area. The Project encourages economic growth by creating jobs and attracting investment, while its design ensures compatibility with the surrounding neighborhood and enhances the area’s physical character. The proposed expansion has been carefully developed to minimize impacts on the surrounding community. The Project will provide improved storage options for residents and businesses, serving as a valuable amenity that addresses local needs and enhances convenience and quality of life for the community. DISCUSSION Project Description The Applicant proposes to redevelop a portion of the existing Extra Space Storage site at 212-280 N. Sullivan and 2602 W. Fifth streets. The Project involves demolishing an existing one-story, 1,214-square-foot building currently used as the rental office and manager’s apartment. A new three-story, 84,197-square-foot self-storage building will be constructed in its place, incorporating a 1,246-square-foot rental office and a 750-square- foot manager’s apartment. No changes are proposed to the facility’s hours of operation. CUP No. 76-38-MOD-1 – Extra Space (212-280 N. Sullivan and 2602 W. Fifth streets) December 8, 2025 Page 2 of 9 5 4 2 9 The rental office will continue to operate Monday through Saturday from 9:30 a.m. to 6:00 p.m. with customer access to storage units available daily from 6:00 a.m. to 8:00 p.m. Architecture and Design The new building features a modern industrial design with a stucco finish, corrugated metal panels, metal canopies and trim, storefront and spandrel glass, and metal roll-up doors. Spandrel glazing will be installed on elevations visible from the street, adding façade articulation and visual breaks to the building planes. The extensive use of glass and aluminum windows also promotes transparency, bringing natural light into the interior spaces and reducing the perceived mass of the structure. Complementary stucco and metal finishes add texture and contrast, ensuring that the building retains its visual quality and resilience over time. On-Site and Off-Site Improvements Site improvements include enhancing the existing landscaped buffer along Sullivan Street with additional plantings to strengthen visual screening and improve overall site appearance, as well as adding a five-foot planting strip along Fifth Street, where landscaping is currently absent. The existing tubular steel fencing along Fifth Street will remain, while the fencing along Sullivan Street will be removed and replaced with new tubular steel fencing at the southern and northern ends of the proposed building to match existing fencing style on site. In addition, the chain link fence along the southerly property line visible from Sullivan Street will be removed and replaced with a six-foot-tall concrete masonry unit (CMU) block wall that will extend west into the site and connect with the existing CMU wall along the southern property line. Along the northerly property line on Sullivan Street, a 15-foot-wide landscaped area will be established against the existing six-foot-tall CMU wall separating the site from the adjacent residence. The landscaped area will feature Berkeley Sedge groundcover, 24-inch box Pacific Wax myrtle trees, and Dwarf Bottlebrush shrubs to provide visual separation and enhance the overall site appearance. New wall pack lighting will be installed along the rear and sides of the proposed building to ensure adequate safety and visibility. The fixtures will be shielded to provide downward illumination, minimizing impacts on the abutting residence. The Project will provide a total of 21 parking spaces, including four electric vehicle-capable stalls and two bicycle parking spaces, exceeding City requirements. Landscaping The landscape plan proposes new 24-inch box Crape Myrtle, Brisbane Box, Pacific Wax Myrtle, London Plane, and African Sumac trees while preserving the existing mature trees on site. Supplemental plantings include Blue Glow Agave, Dwarf Bottlebrush, Variegated Flax Lily, Heavenly Bamboo, Lilac Vine, Berkeley Sedge, and Fine Leaf Myoporum to provide year-round visual interest and drought-tolerant coverage. The sustainable, low- maintenance plant palette is designed to complement the proposed industrial building form and improve the aesthetic quality of the site’s visible frontages. The 2602 W. Fifth Street parcel was developed circa 1974 with seven one-story steel frame metal storage buildings through administrative approval, without requiring a CUP. On July 17, 1972, City Council adopted Ordinance No. NS-1123, requiring a CUP for commercial uses, including enclosed storage, within the M1 zoning district. Subsequently, the 280 N. Sullivan Street parcel was later developed following Planning Commission approval of CUP No. 76-38 to expand the adjacent 2602 W. Fifth Street self-storage use into the existing recreational vehicle (RV) storage yard. This approval authorized construction of five one-story CMU buildings totaling 32,400 square feet, one wood- framed one-story building containing a rental office and on-site manager’s residence, and 38 off-street parking spaces. The parcel was previously used as a storage yard, salvage yard, and vehicle storage before redevelopment for self-storage and RV storage purposes. The adjoining 212 N. Sullivan Street parcel was later acquired circa 1992 to expand by-right RV storage, increasing the capacity of RV parking spaces from 38 to 127. On April 15, 2002, City Council adopted Ordinance No. NS-2494, amending the Zoning Code to place additional limitations on certain land uses within industrial zones. These amendments introduced specific restrictions applicable to new self-storage facilities within 500 feet of arterial streets. The Ordinance’s recitals emphasize case-by-case evaluation of those proposed uses to ensure consistency with the City’s economic and fiscal goals, protect land traditionally designated for manufacturing uses, and ensure that potential development impacts are effectively mitigated. Extra Space Storage acquired the entire project site in 2022 from the prior owner. The facility has operated continuously as self-storage and RV storage since its original development in 1974 and subsequent expansions in 1977 and 1992, with uninterrupted service and no change in use. Extra Space Storage is a national self-storage company founded in 1977 that operates more than 4,000 facilities across the United States. It offers a range of unit sizes and vehicle storage to serve both residential and commercial customers. Within Santa Ana, Extra Space Storage operates three facilities: the subject site located at 212-280 N. Sullivan and 2602 W. Fifth streets, 511 S. Grand Avenue, and 1030 E. Fourth Street. Project Analysis Conditional Use Permit for Expansion Requests for CUP modification are governed by SAMC Sections 41-649 and 41-638. A CUP may be granted when it can be demonstrated that the proposed project will not adversely impact the community. If these findings can be made, it is appropriate to grant the CUP; conversely, the inability to make these findings would result in denial. CUP No. 76-38-MOD-1 – Extra Space (212-280 N. Sullivan and 2602 W. Fifth streets) December 8, 2025 Page 5 of 9 5 4 2 9 The proposed Project will modernize the facility and upgrade the on-site manager’s residence. It has been designed to be context-appropriate, maintaining the area’s industrial character while introducing contemporary design features for a visually engaging appearance that complements the surrounding neighborhood. Careful attention has been given to site planning and building design to minimize potential impacts to the adjacent residence. A 15-foot-wide landscaped planter containing evergreen Pacific Wax Myrtle trees, which typically reach heights of 15 to 30 feet, will extend along the CMU property line wall for approximately 133 feet from the street, providing visual separation and screening between the new building and the adjacent residence. Except for the manager’s apartment, the north elevation incorporates spandrel and storefront windows with faux storage units behind them. These features are located more than 70 feet from the property line and therefore would not create privacy impacts on the adjoining residence. The facility is designed to maintain a quiet environment for the surrounding community, due to the minimal outdoor activity and lack of truck deliveries required for businesses like industrial and active commercial uses. The majority of self-storage units in the new building will be accessed from the interior with exterior-accessible units and new loading area along the rear of the building, away from the street. Due to the site’s existing configuration, the project cannot accommodate the full 10-foot landscaped yard along Fifth Street required under current M1 development standards. Instead, a five-foot landscaped strip will be provided along this frontage consistent with the condition of approval from CUP No. 76-38. The reduced landscaped area will be offset by enhanced landscaping along the site’s primary frontage on Sullivan Street, both on private property and within the public right-of-way. The Project’s design, low-noise operation, and building placement ensure there will be no adverse noise impacts and that the facility will not negatively affect the surrounding community. To address lighting concerns, staff is recommending a condition of approval requiring that all lights utilize shielded fixtures and dimmers that are designed to minimize glare and eliminate upward or off-site light spill. Moreover, the Applicant would be required to improve lighting throughout the entire site, beyond the immediate vicinity of the new building, to ensure adequate security. A photometric study has been provided to demonstrate compliance with City standards and to ensure that no measurable lighting impact extends to residential uses (Exhibit 6). Although the Project site is within 500 feet of an arterial street and under current zoning code standards would not be permitted as a new facility, this use was established and has continuously operated since prior to the adoption of proximity limitations. Moreover, the use is permitted at the subject site by the existing CUP, CUP No. 76-38. The facility expansion complies with the 2022 General Plan update, which changed the site’s land use designation from Industrial to Flex-1.5, reflecting the City’s shift toward clean industrial and commercial-flex uses such as self-storage. The Project activates the Industrial/Flex area through building beautification and promotes redevelopment with compatible, clean manufacturing and maker-type spaces. The updated design supports the revitalization goals of the Focus Area and aligns with the City’s vision for a modern industrial and creative flex district. With operational safeguards, design features, and conditions of approval in place, the Project supports the continuity of existing business operations and provides a context-appropriate transitional buffer to the adjacent CUP No. 76-38-MOD-1 – Extra Space (212-280 N. Sullivan and 2602 W. Fifth streets) December 8, 2025 Page 6 of 9 5 4 2 9 residence, ensuring compatibility with surrounding uses and no significant impact to public health, safety, or welfare. Modification to CUP No. 76-38 Conditions of Approval The Applicant requests removal of the CUP No. 76-38 condition requiring “permanently maintained landscape areas as indicated on plot plan,” specifically the internal three-foot- wide landscape planters along the rear and side property lines. Compliance with this condition would result in minimal buffering because these areas have limited street visibility, originally proposed with low vegetation, and are located next to other industrial uses. Removal of the internal planters would not alter the site’s visual character or its compatibility with surrounding development, given their interior location, lack of public visibility, and adjacency to similar industrial uses. In lieu of this condition, the Project includes a ten-foot-wide landscape strip along Sullivan Street, where no street frontage landscaping was previously required. Additionally, the Project will provide a planter adjacent to the residential property on Sullivan Street, expanding the width from the originally required 3 feet to 15 feet and increasing the total required landscaped area from nearly 900 square feet to 2,000 square feet. Proposed landscaping for the site would include selected tree species to provide improved visual screening and buffering between the self-storage facility and the residential use as well as enhancing the street frontage. Furthermore, current zoning regulations do not require landscaping between industrial properties, as buffering between similar uses is unnecessary and landscape standards instead focus on enhancing street frontages and transitions to residential areas. Neighborhood Compatibility Staff has reviewed the Applicant’s request and has determined that the proposed partial demolition and new construction to expand the existing facility will not be detrimental to the health, safety, and welfare of the community. The new design and landscaping along Sullivan and Fifth streets will make the area more attractive and safer. The improvements promote compatibility with surrounding land uses, and contribute to the investment in the neighborhood, enhancing its visual appearance and livability. By maintaining a quiet, low- impact use, it will serve as a buffer between residential and industrial uses as the neighborhood redevelops. The Project supports the neighborhood’s character, safety, and long-term vitality – in line with the city’s goals for vibrant, accessible, and cohesive urban neighborhoods with a mixture of residential and non-residential land uses. Conditions of approval have been included for this project that will ensure it remains in compliance with the SAMC and does not become an attractive nuisance or disrupt the surrounding land uses. General Plan Consistency The Project has been designed to complement the scale of surrounding residences and aligns with multiple goals and policies outlined in the General Plan, including those related to Land Use, Economic Prosperity, Housing, and Urban Design, as follows: CUP No. 76-38-MOD-1 – Extra Space (212-280 N. Goal HE-2: Housing Supply and Diversity – A diversity of quality housing, affordability levels, and living experiences that accommodate Santa Ana’s residents of all household types, income levels, and age groups to foster an inclusive community. Goal UD-1: Physical Character – Improve the physical character and livability of the City to promote a sense of place, positive community image, and quality environment. o Policy UD-1.1: Design Quality –Ensure all developments feature high quality design, materials, finishes, and construction. Goal UD-2: Sustainable Environment – Improve the built environment through sustainable development that is proportional and aesthetically related to its setting. o Policy UD-2.2: Compatibility and Use With Setting – Employ buffers and other urban design strategies to encourage the compatibility of new development with the scale, bulk, and pattern of existing development. Goal UD-3: Attractive Travelways – Create and maintain safe and attractive travelways through coordinated streetscape design. Approval of the proposed Project is consistent with the General Plan land use designation of Flex-1.5, which is intended to support context-appropriate development on sites with existing compatible uses. The Industrial/Flex designation allows a mix of clean industrial and creative uses, including office-industrial flex spaces, small-scale clean manufacturing, research and development, retail, artist galleries, and live-work units. The CUP No. 76-38-MOD-1 – Extra Space (212-280 N. Sullivan and 2602 W. Fifth streets) December 8, 2025 Page 8 of 9 5 4 2 9 expanded self-storage facility aligns with this intent by enhancing neighborhood vitality and providing a neighborhood-serving amenity for local residents. The Project advances Land Use Element Goals 2, 3, and 4 by promoting reinvestment in an aging property, ensuring the new three-story building is compatible in scale and massing with the surrounding neighborhood, serving as an effective buffer between residential and industrial uses, and improving the public realm through quality architecture and enhanced street-facing design. From an Economic Prosperity Element perspective, the Project supports Goals 1 and 3 by retaining and creating jobs through the expansion of the self-storage facility, and promotes a business-friendly environment by ensuring the continued improvement and maintenance in the community. It also supports Housing Element Goal 2 by upgrading the on-site manager’s apartment and providing secure, on-site storage amenities for residents in nearby higher-density housing who may lack sufficient onsite storage space. Finally, the Project’s quality architectural design and improved landscaped frontages support Urban Design Element Goals 1, 2, and 3, ensuring the facility contributes positively to the visual character and livability of the West Santa Ana Boulevard Focus Area. The landscaped buffers and site planning further ensure the Project serves as an effective transition between residential and industrial uses, while enhanced landscaping along Sullivan and Fifth streets helps to create visually appealing and sustainable travel corridors that strengthen the community’s image. Public Notification and Community Outreach Project notifications were posted, published, and mailed in accordance with City and State regulations. Copies of the public notice, including a 1,000-foot notification radius map, and the site posting are provided in Exhibit 8. In addition, staff contacted the provided contacted for the Artesia Pilar Neighborhood Association to ensure they were aware of the project and public hearing. At the time this report was printed, no issues of concern were raised regarding the proposed development. ENVIRONMENTAL IMPACT Pursuant to the California Environmental Quality Act (CEQA) and the CEQA Guidelines, the Project is exempt from further review, pursuant to Section 15332 (Class 32) of the CEQA Guidelines (In-Fill Development Projects) as it is consistent with the City’s General Plan, applicable policies, and Industrial zoning, located on an 5.72-acre site with a project area under three acres that is fully developed, surrounded by urban uses, and lacking suitable habitat for endangered or sensitive species. The Project would not result in any significant effects relating to traffic, noise, air quality, or water quality; and the site can be adequately served by all required utilities and public services. The above-mentioned analysis and use of a Class 32 categorical exemption is substantiated by the analysis provided as Exhibit 7 of this report. Based on this analysis, a Notice of Exemption, Environmental Review No. 2024-21, will be filed for this Project. CUP No. 76-38-MOD-1 – Extra Space (212-280 N. Sullivan and 2602 W. SULLIVAN AND 2602 W. FIFTH STREETS (APNS: 007-141-78, 007-141-79, AND 007-141-11) BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Planning Commission of the City of Santa Ana hereby finds, determines, and declares as follows: A. Extra Space Properties 103, LLC (“Applicant” and “Property Owner”), is requesting approval of Conditional Use Permit (“CUP”) No. 76-38-MOD-1 to modify the existing CUP to expand an existing mini-warehouse facility, commonly referred to as self-storage, and revise the existing conditions of approval at 212-280 N. Sullivan and 2602 W. Fifth streets (“Project”). B. The Project’s site consists of three parcels, developed as self -storage facilities over time. The 2602 W. Fifth Street parcel was developed circa 1974 with seven one-story steel frame metal storage buildings through administrative approval, without requiring a CUP. C. On July 17, 1972, the Santa Ana City Council adopted Ordinance No. NS-1123, requiring a Conditional Use Permit for commercial uses, including enclosed storage, within the Light Industrial (M1) district. D. On January 24, 1977, the Planning Commission approved CUP No. 76 -38 for expansion of a self -storage facility at 280 N. Sullivan Street, authorizing construction of several one-story buildings, office, and manager’s residence. The City Council affirmed the approval on February 22, 1977. E. On April 15, 2002, the City Council adopted Ordinance No. NS-2494, establishing additional restrictions on certain uses, including new self-storage facilities within proximity to arterial streets, freeways, and freeway intersections. The Ordinance provides for case-by-case evaluation of the proposed uses, in order to achieve greater consistency with the General Plan goal of promoting land uses that enhance the City’s economic and fiscal viability while ensuring that impacts of development are mitigated. F. Pursuant to Section 41-472.5(p) of the Santa Ana Municipal Code (“SAMC”), a CUP is required for self-storage uses provided that no conditional use permit shall be granted unless a written finding is made that the parcel on which the Resolution No. 2025-XX Page 2 of 11 use is proposed is not within five hundred (500) feet of an arterial street (as defined in the city's circulation element) or freeway, or within one thousand (1,000) feet of a freeway intersection. The Ordinance provides for discretionary consideration to ensure alignment with City land use objectives and to address potential impacts as appropriate. G. Pursuant to SAMC Section 41-649, any modification to an approved conditional use permit, variance, or minor exception requires refiling of a new application. H. The existing self-storage facility authorized under CUP No. 76-38 for the site remains valid under its original approval, despite the separation criteria in SAMC Section 41-472.5(p), which requires a minimum distance from arterial streets and freeways, applying to all new CUP applications. I. On March 27, 2024, the Applicant submitted a Development Project application for the proposed expansion of the existing self-storage facility. J. On September 25, 2025, the Project was determined to have met the requirements and conditions of the City’s Development Review Committee (DRC) to complete the Development Project review process. K. On December 8, 2025, the Planning Commission held a duly noticed public hearing for CUP No. 76-38-MOD-1. L. The Planning Commission of the City of Santa Ana determines that the following findings, which must be established in order to grant a CUP pursuant to SAMC Sections 41-649 and 41-638, have been established for CUP No. 76-38-MOD-1 for expansion of an existing self-storage facility at 212-280 N. Sullivan and 2602 W. Fifth streets: 1. That the proposed use will provide a service or facility which will contribute to the general wellbeing of the neighborhood or community. The Project will directly benefit the neighborhood by updating an existing self-storage facility with a modern, secure, and climate-controlled building that meets the needs of local residents and businesses. The Project supports residents in higher-density areas that may otherwise lack sufficient onsite storage facilities. The new design and improved landscaping along Sullivan and Fifth streets will make the area more visually attractive, while allowing the business to continue serving as a land use buffer, helping to maintain a transitional use between adjacent residential and nearby sensitive receptors from existing industrial activity in the vicinity. These improvements address the community’s growing demand for storage while improving the visual appearance of the neighborhood, in line with the City’s goals for housing diversity, investment, and good urban design. 2. That the proposed use will not, under the circumstances of the particular Resolution No. 2025-XX Page 3 of 11 case, be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity. The Project incorporates a range of design and operational features to ensure it will not be detrimental to the health, safety, or general welfare of people living or working nearby. The new design and landscaping along Sullivan and Fifth streets will make the area more attractive, while the facility itself serves as a quiet, well-maintained buffer between residential and industrial uses. The majority of self-storage units in the new building will be accessed from the interior with exterior -accessible units and new loading areas at the rear, along the west of the building, away from the adjacent residence and right-of-way. The facility is designed to maintain a quiet environment for the surrounding community, due to the minimal outdoor activity and lack of truck deliveries required for businesses like industrial and active commercial uses. Enhanced landscaping and shielded lighting will reduce visual and noise disturbances, while the building’s layout and setback from the street will avoid any new circulation or safety issues for neighbors. Together, these measures ensure the Project is a compatible and safe addition to the community, without negatively affecting the well-being of nearby residents or workers. 3. That the proposed use will not adversely affect the present economic stability or future economic development of properties surrounding the area. By modernizing the self-storage facility and enhancing the streetscape with attractive architecture and landscaping, the Project will support the economic stability of the area, help increase property values, and encourage further investment. The upgraded, climate -controlled storage units will meet both current and future needs of local residents and businesses without introducing new incompatible uses. These improvements will beautify Sullivan and Fifth streets, making the area more appealing for residents and investors, while supporting the revitalization efforts and vision of the zoning district it is located. The Project will help maintain a stable, vibrant local economy in line with the City’s economic development and beautification goals. 4. That the proposed use will comply with the regulati ons and conditions specified in Chapter 41 (Zoning) of the SAMC for such use. The Project complies with applicable development regulations in Chapter 41 of the Santa Ana Municipal Code, including M1 standards for floor area ratio, height, and parking. A five-foot landscaped strip will be provided along Fifth Street consistent with CUP No. 76-38 condition of approval, in lieu of the current 10-foot requirement. 5. That the proposed use will not adversely affect the General Plan of the Resolution No. 2025-XX Page 4 of 11 city or any specific plan applicable to the area of the proposed use. The facility expansion is consistent with the General Plan land use designation, supports several General Plan goals and policies, and aligns with the vision for the West Santa Ana Boulevard Focus Area. The Project encourages economic growth by creating jobs and attracting investment, while its design ensures compatibility with the surrounding neighborhood and enhances the area’s physical character. Land Use Element Approval of the proposed Project is consistent with the General Plan land use designation of Flex-1.5, which is intended to support context- appropriate development on sites with existing compatible uses. The Industrial/Flex designation allows a mix of clean industrial and creative uses, including office-industrial flex spaces, small-scale clean manufacturing, research and development, retail, artist galleries, and live-work units. The expanded self-storage facility aligns with this intent by enhancing neighborhood vitality and providing a neighbo rhood- serving amenity for local residents. Economic Prosperity Element The Project supports Goal EP-1 by creating and retaining local jobs through the expansion of the self-storage facility. It also furthers Goal EP-3, which promotes a business-friendly environment, by modernizing an existing business and demonstrating ongoing investment in the community. These help foster a positive climate for business growth and retention. Consistent with Policy EP-3.7, the Project encourages further development and investment in Santa Ana’s community. Housing Element By modernizing and expanding the self-storage facility and upgrading the on-site manager’s apartment, the project addresses a unique housing need by providing on-site residential accommodations for facility staff, thereby supporting Goal HE-2 of providing diverse housing by upgrading the on-site manager's apartment and offering secure, on-site storage amenities for residents in higher-density areas that may otherwise lack such facilities onsite. The Project’s provision of secure storage supports residents in higher-density housing by addressing space limitations, thereby complementing the City’s efforts to foster a diverse and livable community. Resolution No. 2025-XX Page 5 of 11 Urban Design Element The proposed Project advances the Urban Design Element by improving the physical character and livability of the area, consistent with Goal UD- and Policy UD-1.1. The new three-story building is designed to be compatible with the scale of surrounding development, supporting Goal UD-2 and Policy UD-2.2. Landscaped buffers and site planning help ensure the Project serves as an effective transition between residential and non-residential land uses. Additionally, the Project enhances the streetscape along Sullivan and Fifth streets with improved landscaping, fulfilling Goal UD-3 by creating visually appealing, and sustainable travel corridors that contribute to a positive community image. Section 2. Pursuant to the California Environmental Quality Act (CEQA) and the CEQA Guidelines, the Project is exempt from further review, pursuant to Section 15332 (Class 32) of the CEQA Guidelines (In-Fill Development Projects), because the Project is consistent with the applicable General Plan land use designation and applicable General Plan policies, as well as with applicable zoning designation and regulations. Moreover, the proposed development occurs within the City limits on a project site of no more than five acres; the Project site has no value as habitat for endangered, rare or threatened species; approval of the Project would not result in any significant effects relating to traffic, noise, air quality, or water quality; and the site can be adequately served by all required utilities and public services. Based on this analysis, a Notic e of Exemption, Environmental Review No. 2024- 21, will be filed for this Project. Section 3. The Applicant shall indemnify, protect, defend and hold the City and/or any of its officials, officers, employees, agents, departments, agencies, authorized volunteers, and instrumentalities thereof, harmless from any and all claims, demands, lawsuits, writs of mandamus, referendum, and other proceedings (whether legal, equitable, declaratory, administrative or adjudicatory in nature), and alternative dispute reso lution procedures (including, but not limited to arbitrations, mediations, and such other procedures), judgments, orders, and decisions (collectively “Actions”), brought against the City and/or any of its officials, officers, employees, agents, departments, agencies, and instrumentalities thereof, that challenge, attack, or seek to modify, set aside, void, or annul, any action of, or any permit or approval issued by the City and/or any of its officials, officers, employees, agents, departments, agencies, and instrumentalities thereof (including actions approved by the voters of the City) for or concerning the project, whether such Actions are brought under the Ralph M. Brown Act, California Environmental Quality Act, the Planning and Zoning Law, the Subdivision Map Act, Code of Civil Procedure sections 1085 or 1094.5, or any other federal, state or local constitution, statute, law, ordinance, charter, rule, regulation, or any decision of a court of competent jurisdiction. It is expressly agreed that the City shall have the right to approve the legal counsel providing the City’s defense, and that Applicant shall reimburse the City for any costs and expenses directly and necessarily incurred by the City in the course of the defense. City shall promptly notify the Applicant of any Action brought and City shall cooperate with Applicant in the defense of the Action. Section 4. The Planning Commission of the City of Santa Ana, after conducting the public hearing, hereby approves Conditional Use Permit No. 76-38-MOD-1, as conditioned in Resolution No. 2025-XX Page 6 of 11 Exhibit A, attached hereto and incorporated herein, to expand an existing self-storage facility at 212-280 N.
