THIS FIRST AMENDMENT to the above-referenced agreement is entered into on this 18th day of
September,2025, by and between the City of Fountain Valley,a municipal corporation duly organized
and existing under the Constitution and laws of the State of California(hereinafter"Agency"), and the
City of Santa Ana, a charter city and municipal corporation duly organized and existing under the
Constitution and laws of the State of California(hereinafter "City").
RECITALS
A. The parties entered into an Agreement No. N-2023-170 dated July 1,2023 ("Agreement")by
which City agreed to house detainees held in custody by the Fountain Valley Police
Department for violation of California Penal Code §647(f),relating to being under the
influence of alcohol, drugs or other controlled substance(hereinafter"§ 647(f)detainees").
The Agreement runs through June 30, 2026 and is current and in effect.
K The parties now seek to amend the Agreement to include the housing of detainees charged
under Penal Code §647(f)with citable misdemeanor warrants, with certain exceptions.
The Parties therefore agree:
I. Section 2,Scope of Services, is hereby amended to read as follows:
City agrees to provide for the housekeeping, safekeeping and subsistence of§647(f) detainees of
Agency, including those with citable misdemeanor warrants in accordance with this Agreement.
This provision excludes detainees with citable warrants involving violence,a firearm, or resisting
arrest.
2. Except as modified by this First Amendment,all other terms and conditions of the Agreement
shall remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to the Agreement on
the date and year first written above.
