HomeMy WebLinkAbout08/10/2010ZONING ADMINISTRATOR HEARING • MINUTES August 10, 2010 CONDITIONAL USE PERMIT NO. 2008-32 10:08 a.m. Vince Fregoso, Zoning Administrator, called to order the public hearing in the City Hall Ross Annex Conference Room 2001. Also in attendance were: applicant, Lonnie Moore, owner of The Dolce Group, Adam Palmer, Managing Partner of Geisha House, SAPD Mike McCoy, loft residents Philip Ra, Oneal Carson, Ryan Rivera, Principal Planner Sergio Klotz, Deputy City Attorney Ryan Hodge, and Recording Secretary Martha Ramirez. Phillip Ra submitted a written communication. Sergio Klotz presented the staff report and recommendation. Modification is to allow dancing at the establishment; requested to delete Condition No. 16 from the conditions of approval. Applicant submitted Exhibit 6 showing the dance area at the Geisha House on the first floor. • Public Comments: Mr. Ra indicated he would like to have the letter presented as written. Mr. Fregoso called for a recess at 10:14 a.m. to allow staff to read the letter submitted by Philip Ra. Public hearing reconvened at 10:21 a.m. Lonnie Moore commented on the ancillary income associated by allowing the dancing requirement at the establishment, expressed willingness to cooperate with neighborhood and the community, also indicated that the restaurant was open for lunch and dinner. Adam Palmer referred to Mr. Ra's letter indicated that the Geisha House restaurant caters to the local area. Oneal Carson, loft resident, spoke in support of the Geisha House. Philip Ra, loft resident, voiced concerns with overtlow of public attending the restaurant, noise impacts and public loitering. SAPD McCoy commented on the low number of public complaints regarding noise. Mr. McCoy commented on issues listed in Mr. Ra's • letter such as lunch truck and events held on parking lot are the property owner's responsibility and not the Geisha House Restaurant. SAPD McCoy indicated noise complaints have been addressed, and security in the • parking lot was reconsidered by the Geisha House. Recommended Police Conditions: Conditional use permit being modified but dancing cannot occur until a dance permit has been obtained and live entertainment condition has to be removed from the ABC license application. Public hearing was closed. The Zoning Administrator adopted a resolution approving Conditional Use Permit No. 2008-32 with modified conditions. Deleted Condition No. 16 regarding public dancing on the premises and added Condition No. 28 stating two state licensed uniformed security guards shall be located in the parking lot from 8:00 p.m. until 30 minutes after closing, whenever dancing is held at the restaurant. Mr. Klotz stated that the item will be presented as a Consent Item at the Planning Commission public hearing on August 23, 2010 at 6:30 p.m. at City Hall Council Chamber.
