Refer to their forensic reports, documented under RI-242982, for further details. WEATHER & LIGHTING Upon my arrival at the scene on 12/01/24 at 2017 hours, the weather was clear and dry. The temperature was 55°F,  as recorded on the weather app on my iPhone. Lighting was provided by streetlights and fixed lighting from surrounding businesses. SCENE The scene was located on Broadway, on the west sidewalk just south of 116 N Broadway (Casa Linda Furniture). Along the east side of Broadway, directly across from the scene, is Guadalajara Furniture, located at 117 N Broadway Broadway is a north-south asphalt-paved roadway with one lane of travel in each direction. A painted double yellow line extends approximately 100 feet north from 1st St before transitioning to a raised concrete median that continues to 2nd St. A raised concrete curb and concrete sidewalk exist on each side of the roadway. The Artists Village Apartments (300 W 2nd St) has a driveway entrance on the west side of Broadway leading to a covered parking lot. On the northwest corner of the building is a small alcove with an outward-opening metal door leading to an internal stairwell for 300 W 2nd St. The north wall of the alcove, shared with Casa Linda Furniture (116 N Broadway), displayed several apparent bullet strike marks, individually marked by forensic personnel with labels “A”  through “JJ.” There is metered street parking on the east side of Broadway. Three vehicles were parked in the metered stalls: 1.     White 2005 Chevrolet Van (CA license ), parked in front of 117 N Broadway. A food vending trailer, approximately 10 feet long and 6 feet wide with no identification, was parked behind the van but not connected. The van was unoccupied. 2.     Purple 2008 Mitsubishi 4-Door Sedan (CA license ), parked north of the white van. The vehicle was unoccupied. 3.     Green 2004 Chevrolet Tahoe Z71 (CA license ), parked on the east curb line of Broadway in front of 125 N Broadway. The vehicle was unoccupied. A marked Santa Ana Police vehicle (2020 Ford Explorer, CA license 1600677, vehicle unit #860) was stopped in the southbound lanes of Broadway, facing northwest, at the southeast corner of 116 N Broadway. The police vehicle’s driver-side window was rolled down, with a ballistic shield resting on the driver’s seat. The Unitrol was set to the second position, activating solid red and blue emergency lights. The vehicle’s overhead emergency light bar and forward-facing red lamp were functioning properly. I was asked to respond to the scene for a briefing by Sgt. L. Barragan. 2018 Hours – Sgt. Barragan provided preliminary information to detectives from the Homicide Unit, CA DOJ investigators, and forensic personnel. I was assigned to document the scene with CA DOJ Investigator J. Genens. 2019 Hours – I observed the crime scene secured with tape, SAPD vehicles, and uniformed personnel preventing entry. 2020 Hours – I walked the scene as CA DOJ Forensic personnel scanned and photographed the area. Santa Ana PD 2024-26142 Report by Speakman, Britain 3360 4 of 5 2313 Hours – Photographs of SAPD unit #805, the 40mm less lethal device, and its interior and exterior were taken.   Monday, December 2, 2024 0037 Hours – CA DOJ forensic personnel began evidence documentation and collection, including 3D scanning and measurements. 0306 Hours – The scene was released to SAPD Sgt. P. McClasky. Crime scene tape was removed, and the area was reopened to normal traffic. This concluded my involvement in the investigation. Author: Speakman, Britain 3360 BWC NOT Activated BWC Inactive Reason: NA Santa Ana PD 2024-26142 Report by Speakman, Britain 3360 5 of 5 On 12/01/2024, at approximately 1732 hours, Officer M. Marignoli #3858 and I, Officer N. Valdenor #3849 were assigned to patrol in the West End District in the City of Santa Ana, County of Orange. I was driving a clearly marked black and white Santa Ana Police vehicle and wearing a marked Santa Ana Police uniform. We arrived on scene at approximately 1736 hours. It shall be noted that during the incident my department-issued Axon 3 body worn camera (BWC) was activated and recording. All statements made below are summarizations of the facts and circumstances that shall not be taken as all-encompassing of the event. For exact dialogue and sequence of events see BWC footage. This is a supplemental report covering our actions when we responded to assist officers who were in an officer involved shooting (OIS). The incident occurred in the area of 200 N Broadway in the City of Santa Ana, County of Orange. Upon arrival, we were immediately tasked with establishing yellow and red caution tape south of the incident and in the area of 100 N Sycamore Street. We left the scene at approximately 1819 hours. Burkey #3792, wearing a distinct police uniform and driving a marked black and white Santa Ana Police patrol vehicle. At approximately 1733 hours, we responded to the area of N. Broadway, and W. 2nd Street in reference to an officer involved shooting incident. Officer Burkey and I arrived at approximately 1736 hours. On arrival, Officer Burkey and I began setting up crime scene tape in the area of N. Broadway and W. 4th Street. After setting up crime scene tape, I was tasked with holding scene security at the intersection of N. Broadway and W. 2nd Street. At approximately 1823 hours, I was relieved of my position and signed out from the crime scene log. This concluded my assistance in the incident. Officer D. We were driving a clearly marked black and white Santa Ana Police vehicle and wearing our marked Santa Ana Police uniforms.   It shall be noted that during the incident my department-issued Axon 3 body worn camera (BWC) was activated and recording. All statements made below are summarizations of the facts and circumstances that shall not be taken as all-encompassing of the event. For exact dialogue and sequence of events see BWC footage.   Let it be known, my BWC had not battery power left from day shift patrol and turned off in the middle of the interviews.   This is a supplemental report covering my actions during an Officer Involved Shooting investigation that occurred in the area of 2nd Street and Broadway.   We arrived in the area of 4th Street and Broadway at 1736 hours and assisted in securing the scene and closing off traffic south bound on Broadway.   I later made contact with two witnesses inside the Guadalajara Furniture Store located at 117 North Broadway. The first witness identified herself as years old. made the following statements regarding the incident:   Prior to the incident, was in the parking lot located on the north east corner of 1St Street and Broadway. She observed a male that she described as Hispanic, approximately six feet tall, and bald, wearing unknown clothing. She stated the male arrived in a brown vehicle and exited and appeared suspicious walking up and down Broadway and talking on a cell phone. She stated it appeared he was looking for someone. She told me the male then got back into his car and left the area. She did not see the male return. She told me she then entered the store and only heard two gun shots, however did not see the incident. This concluded statements.   I contacted another juvenile who was inside the store at the time and identified herself as , years old. She told me that she was inside the store in the back during the incident and did see or hear anything that had occurred. This concluded her statements.   I later cleared the scene at 1848 hours.   This concluded my actions during this investigation.   E. At 1737 hours, I responded to the area of 200 N. Broadway to assist with an officer involved shooting that occurred. The following is a synopsis of my involvement in this incident. Refer to my department issued Axon body worn camera for full details. Upon arrival, I assisted with securing the scene by blocking off 2nd Street, west of Broadway, with yellow caution tape. Contact with Manager at Casa Linda Furniture: While on the perimeter, I contacted , who identified himself as the Manager of Casa Linda Furniture (116 N. Broadway St.) which is the business located on the southwest corner of 2nd St. and Broadway. told me the following: A customer entered the business and advised him that there was a male subject outside with a rifle. told his Assistant Manager () to call the police. While police were being contacted, heard multiple "pop" sounds, that he believed were gunshots. could not recall how many shots he heard, but said it was more than 4. advised me that there are security cameras near the parking structure of the building. can only access the video surveillance from inside of the business, but he locked his keys inside while he was escorted out by officers. advised me he was going to attempt to contact another employee to bring keys to the business so he can access the cameras. did not have the keys yet to enter the business at the time I was relieved. Officer J. Lee contacted the Assistant Manager and obtained her statement. Refer to his supplemental report for further. At 1823 hours, I was relieved by Officer Caro and signed out with the scene scribe. This concluded my involvement in this incident. Officer C. Castro #3942 and I were working patrol and driving a marked black and white police vehicle. We were both wearing distinct Santa Ana Police uniforms. This is my supplemental report covering my actions when we responded to assist officers who were in an officer- involved shooting (OIS) that had occurred in the area of 200 N Broadway in the City of Santa Ana, County of Orange. Upon arrival, we were immediately tasked to establish a perimeter and set up yellow caution tape on 2nd Street, west of Broadway. While officers were escorting people out of Casa Linda Furniture (116 N Broadway), I guided people outside the yellow caution tape holding down the west perimeter on 2nd Street. I then spoke with the reporting party, Interview with stated she was the assistant manager for Casa Linda Furniture and had called the police when a customer returned to the store to tell her a guy was loading a rifle in the street outside. looked at the live feed cameras facing the parking structure entrance just south of the business and did not see anybody. While checking cameras, she also contacted the Santa Ana Police Department to report what the customer had told her. While on the phone with the Santa Ana Police dispatch, she heard five to six loud sounds outside, and she immediately fled to the basement. was unable to provide me with further. I remained in the perimeter until Officer Castro relieved me from my position at 1920 hours. This concluded my involvement in the incident.
