Narrative:
On Friday, April 7, 2023, at approximately 1930 hours, Orange County District Attorney (OCDA) Supervising
Investigator STAN BERRY contacted me regarding an officer-involved (OIS) involving the Santa Ana Police
Department (SAPD). BERRY requested I respond to the area of West Bishop Street and South Rosewood Avenue,
in Santa Ana, to assist with the investigation.
I arrived at approximately 2055 hours, and met with investigators from the OCDA, SAPD, and Orange County Crime
Lab (OCCL) who were present to assist in the investigation.
At 2131 hours, SAPD Sergeants MATT WHARTON and LUIS BARRAGAN conducted the briefing of the known
circumstances surrounding the incident for the personnel involved in the investigation.
Following the briefing, BERRY requested SAPD Detective MICHAEL GIBBONS and I to supervise the processing of
the scene by the OCCL.
At approximately 2213 hours, the following OCCL personnel processed the crime scene under OCCL FR #23-

SCENE DESCRIPTION
The weather was clear with a high of 61 degrees and a low of 57 degrees. The shooting occurred at approximately
1841 hours, during the hours of daylight on the street in front of 523 South Rosewood Avenue. The scene was
cordoned off with yellow and red police tape and uniformed SAPD personnel were stationed to prevent access to
and preserve evidence within the scene. SAPD Officers GABRIEL CARDONA , BRODERICK GOENS and CARLOS
CORREA maintained a log documenting all personnel entering and exiting the scene.
523 South Rosewood Avenue was a single-family residential home. It was the third house north of West Bishop
Street along the east side of the street. The residence was described to have gray-colored stucco walls with white
trim, white window trims, and a gray shingle roof. The numbers "523" were displayed on a white wooden pole in the
patio to the front of the residence.
South Rosewood Avenue was a north / south composite asphalt roadway with raised concrete curbs and concrete
sidewalks on both east and west sides. There are driveway aprons leading to each residence on the street.
VEHICLES IN SCENE
There were ten (10) civilian vehicles and three (3) SAPD vehicles within the scene. The vehicles are described as
follows:
Vehicle #1 - 2006, silver, Toyota Tacoma, California license . The registered owner was ,
. The vehicle was parked facing north along the east curb of S
Rosewood Avenue. The vehicle was parked in front of 531 S Rosewood Ave. The driver side door was open.
Vehicle #2 - 2007, gray, Chevrolet Tahoe, California license The registered owner was
. The vehicle was parked facing north along the east curb
of S Rosewood Ave. The vehicle was parked in front of 527 S Rosewood Avenue.
Vehicle #3 - 2021, black and white, Ford Explorer, California exempt license 1607880, Unit #851 (Equipment ID#
60314). Registered to the city of Santa Ana, Ca 92701. The vehicle was parked facing north on S Rosewood
Avenue parallel to vehicle #2. The engine was running. The vehicle arrived after the OIS occurred.
Vehicle #4 - 2015, black and white, Ford Explorer, California exempt license 1478141, K9 Unit #890 (Equipment ID#
59998). Registered to the city of Santa Ana, CA 92701. The vehicle was parked facing north on S Rosewood
Avenue parallel to vehicle #5. The engine was running. A police K9 dog was in the back seat. The vehicle arrived
after the OIS occurred.
Vehicle #5 - 2011, black and white, Ford Crown Victoria, California exempt license 1408784, Unit #816 (Equipment
ID# 59898). Registered to the city of Santa Ana, Ca 92701. The vehicle was parked facing north on S Rosewood
Avenue north of vehicle #2 and south of vehicle #6. The engine was running and the emergency lights were on (the
lights were later turned off as it interfered with the crime lab photos). Both the driver side and front passenger doors
were fully opened. Inside the vehicle were two straight stick batons tucked between the ceiling of the car and the
cage. There was a shot gun secured in the gun rack located between the driver and front passenger. The shot gun
was labeled "837" in white paint. In the trunk were black gear bags and tactical vests. The vehicle was at the scene
at the time of OIS. The vehicle was photographed and released to SAPD.
Vehicle #6 - 2003, black, GMC Yukon XL, California license 8LLY741. Registered to ,
. The vehicle was parked facing north along the east curb of S Rosewood
Avenue. The vehicle was parked parallel to the driveway apron for 523 S Rosewood Avenue just south of vehicle
#7. The vehicle's engine was running and the front passenger door, driver side rear passenger door and rear hatch
door were fully opened. The vehicle was on scene at the time of the OIS. There did not appear to be any damage
made to the vehicle as a result of the OIS. The vehicle was released to SAPD. Officer NICKOLAS CAVENDISH had
the vehicle towed to B&D Tow at the conclusion of the scene investigation.
Vehicle #7 - 2013, silver, Volkswagen Passat, California license . Registered to ,

527 S. Rosewood Avenue.
There were two (2) cartridge cases with a head stamp of "Hornady 9mm Luger" located in the passenger-side
exterior windshield well of vehicle #5. Both cartridges were labeled EM #13.
A black, 9mm handgun with no serial number and missing trigger guard was located in the east gutter of S.
Rosewood Avenue just east of the rear passenger-side tire of vehicle #6. There was a black magazine containing
cartridges seated in the handgun. The handgun did not have a cartridge in the chamber. The hand gun was labeled
as EM #14.
There was an apparent bullet hole (ABH) on the right side front bumper (beneath the headlight) of vehicle #12, it
was labeled EM #A. There was an apparent strike mark on the right A pillar of vehicle #12, it was labeled EM #B.
The following items were located under vehicle #12 and labeled EM #15:
•two (2) bullet fragments
•one (1) metal fragment
There was a bullet jacket fragment located in the east gutter in front of 511 S. Rosewood Avenue near vehicle #11,
it was labeled EM #16. There was a bullet core located in the grassy area in front of 510 S. Rosewood Avenue, it
was labeled EM #17. A bullet core was located on the sidewalk in front of 506 S. Rosewood Avenue, it was labeled
EM #18.

EVIDENCE COLLECTED
OCCL Forensic Scientist FELICIA BURKE collected the following items of evidence under the listed evidence
markers:
•EM1 - one (1) cartridge case head stamped "Hornady 9mm Luger"
•EM2 - one (1) cartridge case head stamped "Hornady 9mm Luger"
•EM3 - one (1) cartridge case head stamped "Hornady 9mm Luger"
•EM4 - one (1) Glock 9mm magazine with a six (6) round capacity with cartridges
•EM5 - one (1) cartridge case head stamped "Hornady 9mm Luger"

A final sweep of the scene was conducted in an attempt to locate any additional evidence. No additional evidence
was located. At approximately 0520 hours, I turned control of the scene over to SAPD Detective GIBBONS.
