On Monday, October 22, 2012, at 2241 hours, I was contacted by Orange County District
Attorney (OCDA) Supervising Investigator RON SEMAN, regarding a Santa Ana Police
Department (SAPD) officer involved shooting. Supervising Investigator SEMAN asked me to
respond to the area of 520 West Walnut Street, Santa Ana and assist in the investigation.
At approximately 0005 hours, on October 23, 2012, I arrived and met with investigators
from the Orange County District Attorney’s Office, Santa Ana Police Department and the
Orange County Crime Lab (OCCL) personnel.
At approximately 0037 hours, Santa Ana Police Sergeant JIM ARMSTRONG conducted a
briefing of the shooting incident. At the conclusion of the briefing, Supervising Investigator
SEMAN assigned me to partner with SAPD Detective JIM GARCIA and conduct canvass
interviews. Detective GARCIA and I began our canvass at approximately 0053 hours. The
following interviews were audio digitally recorded. Please refer to the audio recordings for full
and complete details of the interviews.

I spoke to who is a Spanish Speaker. told me that when
she arrived home, she walked up to the front of her residence with her family. heard
the rear gate to her residence rattle. husband, and son
, walked along the south side of their residence and toward the rear to investigate the
noise. While they were at the side of the residence heard yelling, but she could not
remember what the person was yelling. called her son and husband to come back to
the front door, where she was standing. husband opened the front door. Once
inside the residence, heard 2 or 3 gunshots. She said the family lay on the living room
floor for protection. When the shooting stopped, she and her husband looked out a rear
window. The window overlooks the rear yard. The window was located just south of the rear
door. said she saw a police officer on the ground in the rear yard of her residence. The
police officer was holding someone down, but she could not see the individual the police officer
was holding down. said the subject being held down was complaining. The police
officer and the subject were to the rear of a “Camaro” that was parked in her driveway. The
vehicle was parked along the south wall and several feet from the rear of the residence.
told me there were several police officers in the alley to the rear of her residence, at
her rear gate. saw two police officers jump the rear chain link fence and assist the
police officer that was in the rear yard with the subject. saw the officers in the alley

cut the lock that secured the rear gate and enter the rear yard of the residence. did
not witness the shooting incident.
I spoke to , who is a Spanish speaker. told me that when he
arrived home, he heard his rear gate moving. He walked to the south side of his residence and
toward the rear yard to investigate. saw a man in the rear yard near the south fence
and next to a vehicle parked in his rear yard. He also saw police officers on the other side of
the rear chain link fence, standing in the alleyway. said he heard his wife call him.
wife was at the front door waiting for him to open the door. went back to
the front of his residence, opened the door, and went inside his residence with his wife and
son. Immediately after entering, he heard 2-3 gunshots. and his family lay on the living
room floor for protection. When the shooting stopped, stood up and walked through
his house to the rear of his residence and looked out a rear window. The window overlooked
the rear yard. saw a police officer and a subject that was on the ground. saw
one police officer next to the subject, but could not remember if there were more police
officers inside the yard. saw more police officers in the alleyway behind the rear
fence. The officers then cut the lock and entered the rear yard.
I spoke to , who is a Spanish speaker. told me he was in
the kitchen of the residence when he heard the rear fence. looked out the kitchen
window to the back yard. saw a subject near the trash cans that were along the
south fence line and next to a truck that was parked in the rear driveway. said the

subject he saw appeared to have been urinating behind the trash can. could not see
the subject’s entire body. heard the voice of a male yell in Spanish, “there he is,
there he is!” said he saw police officers on the other side of the fence, in the
alleyway. said the subject ran from the trash cans and to the rear of the vehicle that
was parked in the driveway of the residence. further told me he saw a police officer
shoot the subject from the alley side of the fence. said the police officer told the
subject in a loud voice, “don’t move, your hand”, to which the subject complied. The subject
then ran and the police officer fired his gun. said the police officer was in the alley on
the outside of the rear fence and the subject was inside the rear yard.
then told me that he did not see the police officer fire his gun and shoot the
subject. said he turned around, away from the window and walked to the
refrigerator. When he turned away, he heard several gunshots. then looked out
another rear window and saw that police officers were in the yard near the subject. Detective
GARCIA asked how his vision was in his right eye. told us that he has poor
vision. also told Detective GARCIA that the police officers told the subject, “Police
don’t move.” said he believed the subject was drunk because the subject appeared
to be staggering.
I spoke to who is a Spanish speaker. was in the garage in bed
watching television when he heard the fence move. then heard screams, but he
could not remember what was said. After the screams, heard 3-4 gunshots.
did not get up to investigate. did not witness the shooting incident.

On October 24, 2012, at approximately 1750 hours, I spoke to ,
who is a Spanish speaker. said she was in bed in her bedroom located on the
second level of her residence, when she heard two gunshots. said she heard
someone complaining of pain. did not hear any yelling or screaming prior to
hearing the gunshots. stayed in her bedroom. said her bedroom
overlooks Birch Street. did not witness the shooting incident.
On October 24, 2012, at approximately 1750 hours, I spoke to , who
is a Spanish speaker. told me he was in his bedroom watching television on the
second story of his residence, when he heard 2 gunshots. then heard someone
complaining of pain. did not hear anyone yelling or screaming prior to the
gunshots. was with his wife, . ’ bedroom
overlooks Birch Street. did not witness the shooting incident.
On October 24, 2012, at approximately 1800 hours, I spoke to , who is a
Spanish speaker. told me that he was asleep in his second story bedroom.
bedroom overlooks Birch Street. heard one gunshot and someone screaming after the
gunshot. then heard police sirens. looked out his bedroom window and saw
police vehicles and ambulances on Birch Street. did not witness the shooting incident.

On November 1, 2012, at approximately 1915 hours, I conducted a telephone interview
who is a Spanish speaker. told me he was asleep in his upstairs
bedroom and was awakened by two gunshots. did not hear any yelling or screaming
before or after the shooting incident. did said he went back to sleep after he was
awakened by the gunshots. said he was then awakened by his brother and
interviewed by a uniformed Santa Ana Police Officer.
On November 1, 2012, at approximately 1915 hours, I conducted a telephone interview
with . said she was in her downstairs bedroom when she heard two
gunshots. did not hear screaming or yelling before or after the shooting incident.
On October 24, 2012, at approximately 1800 hours, I spoke to , who is a
Spanish speaker. was not home at the time of the shooting incident.
On October 24, 2012, at approximately 1800 hours, I spoke to , who is a
Spanish speaker. told me she was in the kitchen when she heard two loud noises
followed by someone yelling, asking to help. thought the loud noises were caused by
someone banging boards together. did not hear any yelling or screaming before the loud
noises.

On October 24, 2012, at approximately 1800 hours, I spoke to .
said she was in her bedroom watching television when she heard 6 rapid fire gunshots.
Following the gunshots, heard the sound of a vehicle “burn rubber “or screeching tires.
then heard someone screaming in pain, but she could not understand what was being
said.
On October 31, 2012, at approximately 0600 hours, I spoke to .
told me he was in his bedroom when he heard 3 gunshots followed by a pause,
then heard 3 more gunshots. heard someone screaming in pain after the gunshots.
told me he heard the sounds of a vehicle burning rubber after the gunshots.
On October 31, 2012, at approximately 0600 hours, I spoke to .
told me she was in the kitchen when she heard three gunshots followed by a short pause and
then 3 more gunshots. looked out the kitchen window into the rear yard of 210 S. Birch
and saw three uniformed police officers “creeping up” to a guy on the ground. said one
of the police officers had his gun drawn. told me there was enough light for her to see
the activity in the rear yard. She also told me she heard a helicopter overhead and saw the
spotlight from the helicopter illuminating the rear yard. said the subject on the ground
was screaming as the police officers walked up to him. Once the police officers approached the
subject, they rolled him onto this stomach, handcuffed him and removed his clothing.

was upstairs in bed when she heard yelling in English followed by a gunshot. did not
know how many gunshots she heard or what the person yelling was saying.
On October 23, 2012, I spoke to , who is a Spanish speaker.
told me he was upstairs getting ready for bed when he heard four gunshots. did not
hear any yelling or screaming before or after the shooting incident.
On October 23, 2012, I spoke to , who is a Spanish speaker. was
upstairs watching television when he heard one gunshot. did not hear yelling or
screaming before or after the shooting incident. heard a helicopter overheard and
sirens.
On October 23, 2012, I spoke to . told me he was asleep during the
shooting incident and was awakened by the police sirens. grandmother told him
someone had been shot.

On October 23, 2012, I spoke to . said she was
upstairs when she heard the “cops” yelling, “Stop!” She then heard 4 gunshots.
said she heard someone yelling, “I’m dying”. then exited her residence and stood
to the front of her residence.
