Prior to any questioning, FULCHER advised GUILLEN of his Miranda rights; after which, GUILLEN stated he understood his rights and wished to speak about the circumstances surrounding the incident. During the approximately one hour long interview, FULCHER asked GUILLEN questions related to his involvement in the robberies that occurred at the Santa Ana High School. The following is a summary of GUILLEN’s statement related to his involvement with the SAPD officers and how he sustained a gunshot wound to his left thigh: On October 22, 2012, between 1500 and 1900 hours, GUILLEN worked on installing a stereo system in a friend’s vehicle. Once GUILLEN completed the installation, he called his girlfriend, , and made arrangements to get together with her later that evening. At approximately 2000 hours, GUILLEN met with . GUILLEN spent the remainder of the evening in company. At some point during the evening, GUILLEN and found themselves walking eastbound on West Myrtle Street from South Raitt Street, in the city of Santa Ana. GUILLEN and walked to the area of the Santa Ana High School, which was located at the east end of West Myrtle Street. The east end of West Myrtle Street terminated at the high school campus athletic fields. GUILLEN noted that there was a function taking place at the high school that evening. GUILLEN believed the function may have been a football game, but he was not sure. GUILLEN and stayed at the high school for approximately fifteen minutes, prior to walking to the McDonalds restaurant, located somewhere on Main Street in Santa Ana. GUILLEN and entered the restaurant, ordered their food and then exited the restaurant. As GUILLEN exited the restaurant, he felt a burning in his left thigh. GUILLEN immediately knew he had been shot. SA 12-026 Investigator: ANDREW ROSS Approved By: Date of Report: 10/24/12 Date:10/24/12 Page 3 of 4 GUILLEN and walked from the McDonalds restaurant to the area of Ross Street and the Santa Ana High School campus, where he was picked up by an ambulance and taken to Western Medical Center – Santa Ana. GUILLEN denied using alcohol or narcotics that evening. GUILLEN denied involvement in the robberies that took place in the area of the Santa Ana High School and denied being in possession of a firearm that evening. GUILLEN initially denied being in the company of anyone other than however, he later disclosed that he was also in the company of a friend by the name of “ .” GUILLEN refused to provide any additional information regarding GUILLEN’s statement was inconsistent during FULCHER’s questioning. When FULCHER brought the inconsistencies to GUILLEN’s attention, GUILLEN was unable to clarify the reason for the inconsistencies and was adamant that he was telling FULCHER the truth. Once FULCHER had completed his questioning of GUILLEN, I asked GUILLEN questions related to the officer involved shooting. The following is a summary of the statement GUILLEN provided at that time: GUILLEN and were walking eastbound on the south side of First Street, west of Ross Street, in the city of Santa Ana. Prior to reaching Ross Street, GUILLEN and turned right and found themselves at the northeast entrance to the Santa Ana High School facility. The northeast entrance to the high school is located at the intersection of Walnut Street and Ross Street. GUILLEN and entered the high school and began walking through the facility. GUILLAN and were using the high school as a shortcut to get to the area of Flower Street and Bishop Street. As GUILLEN and walked through the high school, a male subject ran westbound past them. GUILLEN described the SA 12-026 Investigator: ANDREW ROSS Approved By: Date of Report: 10/24/12 Date:10/24/12 Page 4 of 4 subject as a light-skinned, Hispanic, with a shaved head. The subject was approximately 5’-11” tall and was wearing a grey sweatshirt, checkered shorts and long white socks. GUILLEN identified the subject as a possible gang member from “Townsend.” As the subject ran past GUILLEN and , GUILLEN heard three or four gunshots. GUILLEN felt burning in his left leg and fell to the ground. GUILLEN immediately knew he had been shot. GUILLEN began to yell for assistance and hid behind a parked vehicle that was nearby. GUILLEN did not know what happened to but believed she left the area after the shooting, possibly to return to her residence. While waiting for assistance, GUILLEN was approached by a SAPD officer who held him at gunpoint. GUILLEN did not recall being given commands by the police officer. GUILLEN assumed he was being held at gunpoint because the police officer thought he was in possession of a firearm. GUILLEN was immediately handcuffed. GUILLEN advised that his contact with the police happened after he was shot. GUILLEN did not recall seeing any police officers at the scene, until after he had been shot. GUILLEN believes he was mistakenly shot during a gang related shooting and does not know the identity of the person responsible for shooting him in the thigh. GUILLEN believes the subject who ran past him in the high school may have been responsible for the shooting; however, GUILLEN did not see the subject in possession of a firearm nor did he recognize him as someone he knew.
