HomeMy WebLinkAboutOIS2012-003_Initial Response and Canvass - DeGraffenreid_pdf_REdacted S.A. 12‐022 Investigator:     K Degraffenreid  Approved By:   Date of Report:  October 10, 2012 Date:  10/11/12 Page 1 of 7 ORANGE COUNTY DISTRICT ATTORNEY’S OFFICE BUREAU OF INVESTIGATION SUPPLEMENTAL REPORT   CASE NAME: ALMANZA, MARCELINO VALENCIA CLASSIFICATION: OFFICER INVOLVED SHOOTING  ( NON‐ FATAL) TYPE: INITIAL RESPONSE‐ CANVASS INTERVIEWS AGENCY:   SANTA ANA POLICE DEPARTMENT On Monday, September 10, 2012, at approximately 0110 Hours, I was contacted  by Orange County District Attorney (OCDA) Supervising Investigator RON SEMAN regarding a Santa Ana  Police Department (SAPD) officer involved shooting, which occurred at 3005 South Bristol Street in the city of Santa Ana.  Investigator SEMAN requested  I respond and assist in the investigation. At approximately 0214 hours, I arrived and met with investigators from the Orange County District Attorney’s Office, the Santa  Ana Police Department and Orange County Crime Lab personnel. At approximately 0255 hours, SAPD Sergeant MATTHEW SORENSON conducted a briefing of the known circumstances surrounding the incident for personnel involved  in the investigation. Supervising Investigator SEMAN directed me to team with SAPD Detective DAN AGUILAR to conduct canvass interviews of potential witnesses that live in the immediate area of the incident. Just north of 3005 South Bristol Street is a multi unit hotel called  , located at . This hotel rents rooms to patrons for extended  periods of time. Detective AGUILAR and  I conducted audio digital recorded interviews of the individuals who S.A. 12‐022 Investigator:     K Degraffenreid  Approved By:   Date of Report:  October 10, 2012 Date:  10/11/12 Page 2 of 7 had rented units which faced southbound.  The following is a summary of the individuals’ statements: SANTA ANA, CA  92704  CELL #(714)‐     DOB:   was inside of her room with her husband  and children when she heard four to five gun shots.  When she looked out the window, she saw police vehicles arriving to the scene.   DOB:  Per  , her husband  has a hearing impairment and only speaks Marshallese.  translated for her husband  who stated that he did not hear or see anything related to the incident.   DOB:   was asleep in the room and did not hear or see anything related to the incident. , SANTA ANA, CA 92704 CELL # (818)     DOB:       was asleep and  did not hear or see anything related  to the incident. , SANTA ANA, CA 92704  Per Studio Inn Manager,  , this room was vacant.   , SANTA ANA, CA 92704 CELL # (714)   DOB:     was in his room when he heard the sound of seven gun shots. The first five shots were consecutive and then there was a pause, followed  by two more.   heard S.A. 12‐022 Investigator:     K Degraffenreid  Approved By:   Date of Report:  October 10, 2012 Date:  10/11/12 Page 3 of 7 a  male screaming out for help, but did  not see who was screaming.  After 30 seconds, the police cars began arriving to the scene.     DOB:     was inside of the room, but did  not see or hear anything related to the incident. , SANTA ANA, CA 92704    Per Studio Inn Manager,  , this room was vacant.   , SANTA ANA, CA 92704 CELL# ( 714)     DOB:     was in her room when she heard five gun shots, a pause for a couple of seconds and then two more gun shots.  She then heard sirens and  looked outside to see police vehicles pulling up. She observed  four officers entering the parking lot and  an officer wheeling out a man in a  wheelchair.    added  that the man in the wheelchair is often seen in the parking lot behind  the businesses at 3005 South Bristol Street.   DOB:       CELL# (714)     heard five gunshots and  after a three to five second pause, he heard two more gun shots.   looked  outside and  observed  a silver, Toyota Avalon near the payphones at the gas station located to the west of the  . The Avalon was blacked  out and drove through the gas station and  then north bound on Bristol Street.  described  the driver as a male Hispanic with a white T‐shirt and  plaid  shorts. , SANTA ANA, CA 92704 CELL# ( 714)   DOB:     was in his room at midnight when he heard  five gun shots, a pause of about five seconds and then two more gun shots. When he looked outside he saw a police S.A. 12‐022 Investigator:     K Degraffenreid  Approved By:   Date of Report:  October 10, 2012 Date:  10/11/12 Page 4 of 7 vehicle pull behind  3005 South Bristol Street. The officer exited his vehicle and walked in front of it.   DOB:   was in the room with   and heard police officers arrive to the scene. , SANTA ANA, CA 92704 CELL# None   DOB:   was in room  when he saw police lights drive up to the scene. When he looked outside he saw a crime scene van and a jeep parked across the street. , SANTA ANA, CA 92704 CELL# (714)‐   DOB:   was asleep in his room when he heard four gun shots and  then saw bright lights.   DOB:   was in her room when she heard four gun shots. She looked outside the window and saw police car lights and observed three police officers. Additional officers then began to arrive on scene. , SANTA ANA, CA 92704 CELL 714‐   DOB:   was sleeping in his room when he was awoken by sirens.  did not see or hear anything related to the incident.  SANTA ANA, CA 92704 CELL# 714‐     DOB:   was asleep at the time of the incident and did not see or hear anything related to the incident. S.A. 12‐022 Investigator:     K Degraffenreid  Approved By:   Date of Report:  October 10, 2012 Date:  10/11/12 Page 5 of 7 , SANTA ANA, CA 92704 CELL# (714)     DOB:   heard two to three gun shots and  then police sirens.   stated that his air conditioning was on in his room and it was difficult to hear things outside.  SANTA ANA, CA 92704 CELL# (714)     DOB:   was inside of her room when she heard  gun shots.   stated  it was more than one, but she was not sure how many. She then heard someone yelling, but she could not understand what they were saying.  did  not look out her window at any time. , SANTA ANA, CA 92704 CELL# (714)      DOB:    was asleep in his room when he heard  a “thump” on the street at about 12:30 or 1:00.  He opened  his curtain and  saw police cars on the street.  SANTA ANA, CA 92704 CELL# (714)     DOB:   was asleep in her room with her granddaughter,   She was awakened  by two gun shots. She then heard sirens.   DOB:     looked outside of her window and  saw police cars across the street. She saw someone pushing a man in a wheelchair next to the block wall. She also saw someone lying on the ground  to the rear of the building at 3005 South Bristol Street. That person had three police officers with them, and their feet were moving back and  forth on the ground. , SANTA ANA, CA 92704 CELL# (714)       DOB:  S.A. 12‐022 Investigator:     K Degraffenreid  Approved By:   Date of Report:  October 10, 2012 Date:  10/11/12 Page 6 of 7  was in his room with his friend  . He went to sleep at 2330 hours and  did  not hear or see anything related to the incident.   DOB:   was in the room with  . She went to sleep at 2200 hours and took her “Psych” meds which make it difficult for her to wake up.  did  not hear or see anything related to the incident. , SANTA ANA, CA 92704 Home# 714‐   DOB:   is a  security guard  and  works from 6pm to 6am Sunday through Wednesday.   was not home during the incident. , SANTA ANA, CA 92704 CELL# (714)       DOB:   was in her room with her husband    went to sleep at approximately 2130 hours. At around  midnight she heard gun shots.   DOB:   was in his room and heard a commotion outside of his room. looked under the door jam of his front door, and  observed someone in a wheelchair waiting for the elevator.   went back to sleep and  was woken by his wife who had heard gun shots.  looked out of his window and saw the police and a man in a wheelchair across the street. , SANTA ANA, CA 92704 CELL# (714)         DOB:  S.A. 12‐022 Investigator:     K Degraffenreid  Approved By:   Date of Report:  October 10, 2012 Date:  10/11/12 Page 7 of 7  was inside of his home at midnight when he heard two to three gun shots and then a pause of about one minute, followed by another gunshot sound.  then heard sirens.    was not able to see into the alley from his home.     DOB:   was in her bed inside of her home when she heard the sound  of three gun shots fired  consecutively. She then heard a male screaming, but could not understand what he was saying.    then heard ambulance and  fire truck sirens.   did not look outside as the sounds of the gun shots seemed to be coming east of her home. , SANTA ANA, CA 92704 CELL# (714)         DOB:   was in her home and asleep in her bed when she heard six consecutive gun shots. She looked outside, to the rear of her home and  only saw police lights. She did not hear any voices. The back wall of her property prevented her from seeing into the alley where the incident occurred. I noticed that   had a mounted  security camera over her front door. I asked her if she also had a camera to the rear of her property. She said yes, but that the camera system was disconnected  at the moment and was not recording.      DOB:  CELL: 714‐  was asleep when he heard two gun shots and a pause of about three seconds, followed by three more gun shots.  He heard  paramedics and  looked  outside, but only saw the lights of the paramedics. The back wall of his home, prevented him from seeing into the alley where the incident occurred.
