On September 10, 2012, at approximately 0512 hours, I conducted an audio digital
recorded interview of regarding the Santa Ana Police Department
officer involved shooting related to MARCELINO VALENCIA ALMANZA.
On September 10, 2012, at an unknown early morning hour, was inside the
hotel room where she, her husband, , and her juvenile son,
, were residing. The hotel, , was located at Street,
Santa Ana, on the northeast corner of the intersection of South Bristol Street and West
Segerstrom Avenue. and her family were occupying room number . Room number
was located on the second floor of the hotel, on the south side of the hotel, facing West
Segerstrom Avenue. The rooms south facing window provided an unobstructed view into the

rear parking area of 3005 South Bristol Street, which was located on the south side of West
Segerstrom Avenue.
who was looking out of the hotel room window, alerted that there was
something suspicious taking place in the parking area behind 3005 South Bristol Street.
responded to the window and observed a silver Jeep parked behind the building,
facing northbound towards the hotel. could not see any occupants inside the Jeep at
that time.
recognized the vehicle as a vehicle she and had seen earlier the
previous day in the parking lot of the hotel. The vehicle was occupied by a male subject that
appeared to be under the influence of drugs. The subject laughed an evil laugh at
and as they left their vehicle in the parking lot. recalled the first four digits of
the Jeeps license plate as being
Next to the vehicle, against the east wall of the building, could see a male
subject in a wheelchair, who was later identified as . was
familiar with and knew him by the nickname , since he was known for
dealing illegal drugs in the area. was aware that frequented the area behind
3005 South Bristol Street to sell drugs.
asked to call the police. refused, stating she was tired, and
provided with her cell phone, which contained the non‐emergency telephone number for
the Santa Ana Police Department (SAPD). called the non‐emergency SAPD telephone
number and reported the suspicious activity. enlightened the call taker to the possibility
that the sale of illegal drugs might be involved, since he was also familiar with illegal drug sales
regularly taking place at that location.

As waited for the police to arrive, he complained to that police patrol
units had passed the location without checking on the subjects. asked to
respond to the front of the hotel to check to see if a police officer arrived and was waiting in
the parking lot.
responded to the hotel parking lot, but was unable to locate a police officer.
returned to the hotel room. As walked to the hotel room, she observed,
from the hallway balcony, the headlights of the Jeep flashing off and on towards the hotel.
was unable to see any occupants inside the vehicle at that time, but was still able to
see next to the building. went inside the hotel room and told that the
police had not yet arrived and that she had seen the vehicles headlights flashing.
began to watch from the window of the hotel room and observed a police
patrol unit driving slowly eastbound through the parking lot, south of 3005 South Bristol Street.
The patrol vehicle rounded the southeast corner of the building and began to drive northbound
towards the location of the Jeep. The police patrol unit parked southeast of the Jeep, with its
spotlight illuminated and pointed towards the Jeep. A police officer stepped out of the vehicle
and yelled out to the subjects that were by the Jeep. was unable to hear what the
police officer said, because the hotel room window was closed.
Approximately five seconds after heard the police officer yell out, she heard
four or five gunshots, Pop, pop, pop, pop. could not see the police officer when the
gunshots were fired. Immediately after the gunshots rang out, a male subject, who was later
identified as MARCELINO VALENCIA ALMANZA, ran from the drivers side of the Jeep, rounded
the front of the vehicle and collapsed onto his stomach in front of the vehicle. ALMANZA
shouted, Stop, stop and then lay still. The police officer moved from beside his patrol unit in

a northeast direction. The police officer stopped and began to approach ALMANZA in a
northwesterly direction. The police officer approached within approximately 10 feet of
ALMANZA, then backed off. The police officer had his gun drawn at that time.
watched the scene as approximately 20 police patrol units arrived to assist.
did not see any of the police officers have physical contact with ALMANZA.
estimated the closest any of the police officers approached ALMANZA was 15 feet.
Although recognized the Jeep as the vehicle she had seen earlier the previous
day, she was unable to identify ALMANZA as the same subject she had seen inside the vehicle
at that time.
advised that had video recorded a portion of the incident using her
laptop. provided consent to SAPD Detective GUS MOROYOQUI to obtain a copy of
the video from the laptop. A copy of the video was later obtained at MOROYOQUIs direction.
During the interview, described her observations using an overhead
photograph of the location. Notes were made on the photograph to document
observations. A copy of the photograph is attached at the end of this report.
