GUTIERREZ requested I respond to 805 South Townsend Street, in the city of Santa Ana, to assist in the investigation. At approximately 1013 hours, I arrived at the incident scene and met with investigators from the Orange County District Attorney’s Office and the Santa Ana Police Department. At approximately 1050 hours, SAPD Sergeant PHIL KRAFT conducted a briefing of the known circumstances surrounding the incident for the personnel involved in the investigation. At the conclusion of the briefing, GUTIERREZ teamed me with SAPD Detective RASHAD WILSON and assigned me to supervise the processing of the scene by Orange County Crime Lab personnel. SCENE DESCRIPTION The scene was described as follows: The weather was warm, overcast, and dry. The shooting incident occurred during hours of daylight. The scene was cordoned off with crime scene tape. Uniformed Santa Ana Police Department personnel were stationed to prevent access and preserve evidence within the scene. The cordoned off area included an interior perimeter and an exterior perimeter. Both perimeters were cordoned off by yellow police line tape. The interior perimeter consisted of the east alley of the 700 and 800 blocks of South Townsend Street between 729 South Townsend Street and 802 South Townsend Street. The exterior perimeter included the east alley of South Townsend Street between Monte Vista Avenue on the north and an east/west intersecting alley at 900 South Townsend Street. The shooting incident occurred in the east alley of 800 South Townsend Street between 805 South Townsend Street and 809 South Townsend Street. The east alley of the 800 block of South Townsend Street is a north/south public access alley between South Townsend Street on the west and Raitt Street on the east. The alley is bordered on the south by an intersecting east/west alley and on the north by Monte Vista Avenue. The roadway was a composition asphalt surface with depressed off-center concrete drainage. On the east side of the alley, were blue and gray colored, wood frame and stucco type construction, single and two-car garages. The garage doors were gray in color and face west into the alley. The garages were associated with apartment buildings on Raitt Street. The garages were separated by east/west running asphalt surfaced driveways to access parking lots east of the garages and adjacent to multi-unit apartment buildings. On the west side of the alley were 13-015 Investigator: DEAN FULCHER Approved By: Date of Report: 06/25/13 Date: 07/08/2013 Page 3 of 9 east/west asphalt driveways bordered on the north and south by tan colored, wood frame and stucco type construction, single and two-car garages, attached to multi-unit apartment building 805 South Townsend Street on the north and 809 South Townsend Street on the south. There was an Edison pole (#1301146E) at the north side of the interior perimeter on the east side of the alley near 729 South Townsend Street. There was an Edison pole (#1301145E) at the south side of the interior perimeter on the east side of the alley near 809 South Townsend Street. A damaged street light was affixed to the top of the pole. There was a green trash dumpster on the west side of the alley against the east wall of the garage for 809 South Townsend Street. Painted, in white, on the south side of the green dumpster was an identifying number, 809. Painted, in white, on the south side of the green dumpster was an identifying number, 805. The southeast garage for 805 South Townsend Street (#1) was open. This garage was an approximately 8’ X 10’, tan colored, wood frame and stucco type construction, single car garage. The door was a tan, hinged, wood door. There were no vehicles in the garage, which contained chairs, tables, bicycles, luggage, and other miscellaneous items. All other garage doors appeared to be closed and locked, with the exception of the northeast garage door of 805 South Townsend Street. The lock to the northeast garage door for 805 South Townsend Street had been cut by Santa Ana Police Department personnel. The lock was lying, in two pieces, in the driveway south of the garage door. VEHICLES IN SCENE There were two police vehicles and five civilian vehicles within the inner perimeter. This vehicle was driven by (SAPD) Officer GARY AYALA. This vehicle was parked facing northbound in the alley, with the driver side wheels just east of the concrete drain. The vehicle’s engine was off with the head lamps, spot lights and overhead emergency lights off. There was a .40 caliber Ruger PC4 carbine rifle, serial number 480-06193, locked in the rifle rack between the driver and passenger seat. The rifle had 11 rounds (maximum capacity) of Winchester .40 S&W ammunition in the magazine, the chamber was empty. There was an extra magazine, in a nylon holder, attached to the stock of the rifle. The magazine contained 11 rounds (maximum capacity) of Winchester .40 S&W ammunition. The vehicle contained no other weapons and no audio video recording equipment. • Vehicle #2 – Ford, Crown Victoria, Santa Ana Police Department unit #854, vehicle license number 1226270. This vehicle was driven by (SAPD) Officer SAUL ESQUIVAL. This vehicle was parked facing northbound in the alley, approximately 3 feet south of Santa Ana Police Department unit #880. The vehicle’s engine was running with the head lamps, spot lights and overhead emergency lights off. There was a .40 caliber Ruger PC4 carbine rifle, serial number 480-06219, locked in the rifle rack between the driver and passenger seat. The rifle had 11 rounds (maximum capacity) of Winchester .40 S&W ammunition in the magazine, the chamber was empty. There was an extra magazine, in a nylon holder, attached to the stock of the rifle. The magazine contained 11 rounds (maximum capacity) of Winchester .40 S&W ammunition. The vehicle contained no other weapons and no audio video recording equipment. • Vehicle #3 – 2003 Nissan Extera, 4 door, silver, The registered owner was . This vehicle was parked facing westbound in the driveway south of the northeast garage of 805 South Townsend Street. The vehicles doors were locked. • Vehicle #7 – 2007 GMC Sierra, pick-up, silver, The registered owner was . This vehicle was parked facing eastbound, in the driveway, north of the southwest garage of 805 South Townsend Street. The vehicles doors were locked. SCENE EXAMINATION I conducted an examination of the scene with Orange County Crime Lab personnel. We located a total of 57 items of evidence that were documented, photographed, and collected. These items were identified by Evidence Marker (EM) tags. We also identified seventeen possible bullet strikes that were marked by Evidence Tags (ET), A-P, and photographed. A Plumbtesmo Test conducted on (ET) A and G tested positive for the presence of lead. A total of 235 digital photographs were taken by OCCL Forensic Specialist JEANNIE TRAN. KOMAN sunglasses located under SAPD unit #880 near the driver side rear wheel. • EM #34 - Cartridge casing, head stamp “WINCHESTER 40 S&W,” located under SAPD unit #880 near the driver side front tire. • EM #35 – Possible copper fragment located on the west side of the alley south of the green trash dumpster marked “805.” • EM #36 – Possible bullet fragment located in the alley east of Edison pole # 1301145E. • EM #37 – Possible copper jacket fragment located on the west side of the alley, north of the south wall of the garages for 801 South Townsend Street. • EM #38 – Possible lead bullet located along the east side of the alley north of Edison Pole #1301145E. • EM #39 – Possible bullet fragment located along the west side of the alley south of the driveway for the garages for 729 South Townsend Street. • EM #40 – Possible lead bullet located along the west wall of the northeast garage for 805 South Townsend Street. At 1620 hours, OCDA Investigator ED WOOD relieved me and supervised the remaining processing of the scene. At 1635 hours, a silver Chevy Camaro was removed from the northwest garage of 805 South Townsend Street to allow OCCL personnel access to the garage to obtain photographs and the collection of evidence items. At 1735 hours, WOOD turned control of the scene over to Santa Ana Police Department personnel.
