and front of his apartment's door. From this position, there is no direct line of sight into the
garage and alley.
While speaking to Alejandro, I had to repeat my questions to him several times and he would
respond to my questions in a defensive manner. I noticed he had the distinct odor of an
alcoholic beverage emitting from his person and blood-shot watery eyes. I asked Alejandro
about his condition and he admitted to having been drinking last night.
Apartment #7
Abel Silva told us he was asleep in his bedroom when he was awakened by the sound of the
gunshots. She heard about 10 gunshots. She did not go outside to investigate the gunshots.
Abel explained his sister, Priscilla Silva, was also home at the time of the gunshots. However,
Pricilla left the apartment at about 1000 hours and we were unable to get a statement from her.
Apartment #8
Ruth Villapando told us she was asleep in her bedroom when she was awakened by an
unknown number of loud noises. She did not go outside to investigate the sound.
Samuel Villapando told us he was asleep in his bedroom when he was awakened by the
unknown number of loud noises. He did not go outside to investigate the sound.
Priscilla Villapando told us she was asleep in the living room when she was awakened by the
sound of the gunshots . She heard about 10 gunshots. She did not go outside to investigate the
gunshots.
Jeramiah Villapando told us he was asleep in the living room when he was awakened by the
gunshots. He heard about 10 gunshots. He did not go outside to investigate the gunshots .
Apartment #9
This apartment was vacant.
Apartment #10
Apartment #10 is on the furthest east, second floor, apartment at this address. This
apartment is the closest to the garage and east alley of Townsend Street. Apartment number
#10 has a kitchen window that faces east and down on the garages and east alley . The
distance from this apartment's kitchen window to the crime scene was about 50 feet.
Yolanda Castro told us she was in the apartment's courtyard, pushing a grocery cart, toward
her apartment. As she did this, Yolanda heard the sound of an unknown number of gunshots
coming from the direction of the alley. Upon hearing the gunshots, Yolanda ran up the
staircase and into her apartment.
Once in her apartment, Yolanda looked out of her kitchen window. From the window, Yolanda
saw a female on the ground, face down, in the center of the alley. Yolanda described the
woman laying on the ground with her head pointing east and her feet pointing west. Yolanda
stated that the woman had both her hands underneath her body.

Yolanda told us there were two uniformed police officers at the scene. Yolanda explained that
the first officer was standing in the middle of the doorway to garage #S's open door. The
second officer was standing to the rear of a Honda Accord (CA. license plate #3EEG413). The
Honda was parked east of the apartment building . Yolanda stated that she could hear both
officers yelling something, in English, to the female. Yolanda does not speak English.
Yolanda described the female as wearing a white top, with one tan boot. Yolanda identified the
female's second boot just inside of garage #5. The second boot was visible from the kitchen
window.
Erick Bustamante told us he was asleep in his bedroom when he was awakened by the
sound of an unknown number of gunshots. After being awakened, Erik went to the kitchen and
looked out from its east facing window. From the window, Erik saw an unknown female on the
ground, face down, in the center of the alley. Erik described the woman laying on the ground
with her head pointing east and her feet pointing west. Yolanda stated that the woman had
both her hands underneath her upper body.
Erik told us there were two uniformed police officers at the scene. Erik explained that the first
officer was standing just outside of the doorway to garage #5. The second officer was standing
to the rear of a Nissan Exterra (CA. license plate 5FKD303). The Nissan was parked east of
the apartment building. Erik stated that he could hear both the officers yelling, "Stay still, don't
move."
Yvette Bustamante told us she was asleep in her bedroom when she was awakened by the
sound of an unknown number of gunshots. Shortly after hearing the gunshots, Yvette heard
her mother knocking on the home's front door. Yvette opened the door for her mother and
allowed her in . Yvette stated she did not go to the kitchen window or go outside to investigate
the gunshots.
Fernando Bustamante told us that he slept through the sound of the gunshots and was told
about the incident by his family. He did not go outside to investigate the gunshots.
1406 Hours
Investigator Wood and I cleared the scene and returned to the station .
Once I was back that the police station, I was asked to return to the scene to assist in the
search of the garage #5 at 805 S. Townsend Street.
1443 Hours
I arrived to the scene of the Officer Involved Shooting. I entered the scene from the south
perimeter and checked in with Officer Ribeiro #3224 who was maintaining a crime scene
personnel log.
During the search of the garage, I located a black leather purse. This purse was located along
the garage's west wall, approximately 3 feet south of the doorway.
The purse contained women's toiletries, two cellular phones, a memory card, and a memory
stick. I contacted the residents of apartment #5 and showed them this purse. All of the
apartment's residents stated that they did not recognize the purse and it did not belong to
them . I subsequently collected the purse for safekeeping .

I cleared the scene and returned to the station.
The black purse was later submitted into the Santa Ana Police Departments Evidence Unit for
safekeeping.

I was contacted by Sergeant J. Esparza # 1568 of the Santa Ana Police Department Homicide Section
who infonned me that an officer invol ved shooting incident occurred at 800 South Townsend Street.
Sergeant Esparza requested I respond and assist with the investigation as well as assist with contacting
additional SAPD detective personnel in order to assist with said investigation.
1100 hours
I arrived at the SAPD station and familiarized myself with the circumstances of the O1S prior to leaving
the station for the crime scene.
1128 Hours
I arrived at the scene and checked in with Officer R. Ribeiro #3224, who was maintaining the crime
scene log.
1129 Hours
Sergeant P. Craft #2979 briefed me on the circumstances of the officer involved shooting. After the
briefing, I was assigned to assist with the crime scene investigation and did so after coordinating with
the case agent, Detective L. Rodriguez #2408, Detective R. Wilson #3023 and DA Investigator D.
Fulcher.
1224 Hours
I cleared the scene and returned to the Santa Ana Police Department.
1248 Hours
I attended the officer processing which was conducted in an interview room, located in the Santa Ana
Police Department Professional Standards Bureau. Present in the room were Orange County District
Attorney Investigator Bradley Tanner, Santa Ana Police Sgt. J. Gonzalez #2593, SAPOA Attorney D.
Goldwasser, Detective D. Cabrera #2385, Officer S. Esquivel #3295, OCSD Forensic Specialist
Laurabeth Camacho #8651 and I.

OCSD Forensic Specialist Camacho photographed Officer S. Esquivel #3295. Officer S. Esquivel #3295
was wearing a Santa Ana Police Department uniform, which had Santa Ana Police patches on both the
right and left sleeve. His uniform consisted of a Police Officer badge on his left breast, his name tag on
his right breast, Sam brown duty belt, which contained his holstered service weapon, Taser X26 serial
#X00-660-726, handcuff case, key holder, collapsible baton, portable radio, Oleoresin Capsicum spray
holder, and ammunition pouch. Officer S. Esquivel #3295 was wearing prescription glasses and his feet
were adorned with Black Danner boots. Officer S. Esquivel #3295 was not equipped with a back-up
weapon at the time of the processing.
Officer Esquivel did not have any injuries, nor did his uniform have any indication of wear or damage
caused by the incident.
Officer Esquivel carries a department issued Glock 21 45 caliber semi-automatic handgun with serial
#HA Y924. There was a Streamlight TLR-1 gun light, serial #C4-35250509 l 2, attached to the gun. He
carries 3 department issued gun magazines and each magazine holds 13 cartridges. On duty, the gun is
loaded with one cartridge in the chamber and 13 cartridges in the magazine. During the cartridge count,
the handgun contained one alluminum .45 caliber Winchester hollow-point cartridge in the chamber and
one ( l) alluminum .45 caliber Winchester hollow-point cartridge in the magazine. The two magazines
on the duty belt each contained 12 alluminum .45 caliber Winchester hollow-point cartridges. Each
cartridge had a head stamp of ·•Winchester 45 S&W.
Forensic Specialist Laurabeth Camacho collected Officer S. Esquivel's duty weapon and magazines and
packaged them for further processing. For details, refer to Camacho's forensic report under FR #13-
48764.
Officer S. Esquivel #3295 was temporarily issued a duty handgun.
At 1306 hours, the processing of the officers was completed.
