On Tuesday, July 30, 2013, at approximately 1530 hours, Orange County District Attorney
Supervising Investigator MARK GUTIERREZ contacted me regarding an officer involved shooting,
involving the Santa Ana Police Department. GUTIERREZ requested I respond to the 600 block of South
Harbor Boulevard, in the City of Santa Ana. GUTIERREZ told me that the officer involved shooting at that
location was a fatal shooting incident.
I arrived at the location at approximately 1555 hours. At the shooting incident scene, I met with
investigators from the Orange County District Attorney’s Office and investigators from the Santa Ana
Police Department (SAPD) and Orange County Sheriff/Coroner, who were present to assist in the
investigation.
At 1631 hours, SAPD Acting Sergeant OLIVER GRANT conducted a briefing of the known
circumstances surrounding the incident for the personnel involved in the investigation.
Following the briefing, Orange County District Attorney Supervising Investigator GUTIERREZ
assigned me to conduct a canvass and interview potential witnesses in the business complex where the
shooting incident had taken place. The scene had been secured by members of the Santa Ana Police
Department. SAPD Investigator DOMINGO CABRERRA was assigned with me to conduct the interviews.
Each of the interviews was audio recorded on a digital recorder.

On July 30, 2013, at approximately 1500 hours, was working in her store selling furniture. A
customer had left earlier and she was alone in the business. was seated at her desk in the western
portion of the business. said she heard a woman’s voice coming from the parking lot of the business
complex. then heard what she believed to be a gunshot from outside of her business. This drew her
attention, but she could not see outside of her business. said her view was partially blocked by
furniture and by her limited vision. said she does not see well at distance. VU heard a man yelling
something and he sounded angry. said she could not understand what the man was saying but got
the impression he was very angry. did not get up and look outside.
related that shouting, yelling, and fighting are common place in the shopping center.
said that there are a lot of homeless people with mental problems in the area and it is very common for
them to be engaged in disputes and fights.
told us that she has a video surveillance system and directed us to the system. said that
she could not pull recorded material from the system, and provided me with the telephone number of a
man named who was responsible for the system and could remove images from it.

On July 30, 2013, told us that he was gone from work when the incident happened.
told us that earlier in the day he had seen two of the homeless individuals, who live behind the
store, engaged in a fist fight near the McDonald’s restaurant. said that it was common for the
homeless people to be engaged in fights in the parking lot.

Investigator requested assistance with interviewing a customer at the
Laundromat, at 632 South Harbor Boulevard. We contacted who was doing her laundry while
watching her five year old daughter, told us (in Spanish) that she had arrived

at the laundry after the shooting incident had taken place; but before the crime scene tape was placed
up. So, her vehicle was now stuck in the crime scene. said she did not witness the shooting
incident.

On July 30, 2013, arrived for work at 0900 hours. has a desk at the front
of the insurance office, with a view to the parking lot. noticed two of the homeless men
engaged in some kind of dispute, along the west side of the furniture business. believes that
one of the men involved in the dispute was the man who eventually had the confrontation with the
police.
At approximately 1230 hours, noticed two men engaged in a fist fight in the parking
lot. believed that one of those men was also the man who eventually got into the
confrontation with the police. That second fight was near the McDonald’s and had spilled out onto
Harbor Boulevard. While the men were fighting in the roadway, a bus had to stop to avoid them and
began blowing its horn.
At approximately 1505 hours, was seated at his desk, when he saw a police car
parked west of the furniture building. then saw a man run across the parking lot; whom he
recognized as one of the local homeless men. further recognized the homeless guy as the
man who had been involved in the earlier fights. did not see a police officer or anyone
chasing the homeless man across the parking lot. said he tried to figure out what the man
was running from and looked to the north and saw the police car.
The homeless man ended up entering JUGO’S Juice Shop at the corner. A police car stopped in
the parking lot and a female police officer, with a pony tail exited. She was wearing a distinctive police
uniform and was clearly a police officer. The female police officer walked toward the juice shop and
ordered the man out. said he heard the officer tell the man to get down on the ground.

reiterated that he heard the female officer giving the man commands including to, “Get on
the ground fucker.” The man then shouted to the officer, “What you going to do bitch.” Three men
who were standing at the corner of the parking lot had moved into his view and he could not see down
the walkway. heard a loud single gunshot and heard the man gasping for air.
then moved and saw the female officer putting on gloves and patting the man down. Another police
officer then pulled his car into the parking lot.
described the man who was shot and involved in the fights as being approximately 28
years old, with brown hair, wearing a black short sleeved tee shirt and jeans.

On July 30, 2013, arrived at work late because she had a doctor’s appointment.
At approximately noon, saw two men involved in a fist fight near the McDonald’s
restaurant. recognized one of the combatants as the man whose body she saw later in
front of juice shop. said he was fist fighting with another man that she had not seen
before. They were fighting in the roadway and a bus was honking at them to get out of Harbor
Boulevard. continued on to work at the insurance company. desk was
located directly behind with a partially blocked view of the parking lot.
At approximately 1500 hours, observed a police car pull across the parking area
with its emergency lights on. She wanted to go see what was going on but was on the
telephone with a customer. Shortly thereafter she heard a gunshot. She got up and walked
outside, but her view was blocked by other spectators who were standing at the corner of the
building. She eventually saw the body on the ground and recognized it as being the homeless
man who frequents this shopping center and had been in the earlier fight.

As was looking at the scene, she noticed that the police officer standing next to
the body was a female officer. knew that she was an officer by her distinctive police
uniform. saw another police officer, a Hispanic male, approach the scene on foot, and
that officer asked the crowd if they had seen anything. said that she told him that she
had not seen what had happened.
