At the time of the interview, was in custody at the Orange County, Central Men’s Jail. The following is a summary of the interview: On July 30, 2013, at approximately 1430 hours, was walking out of Nady’s liquor store just west of the McDonalds Restaurant on the northwest corner of South Harbor Boulevard and West McFadden Avenue, in the city of Santa Ana. As was walking out of the liquor store, he heard ARELLANO call his friend, a “fag.” responded back to ARELLANO and made a derogatory comment to him, but did not recall what he said. ARELLANO walked up to and they both met on the sidewalk adjacent to Nady’s liquor store. ARELLANO began removing his sandals and took a “Karate” type stance. A physical fight between them ensued and and ARELLANO fought with each other until both of them were in the west bound lanes of West McFadden Avenue. ARELLANO punched rendering him unconscious. When regained consciousness, a short time later, he was lying on his face in the first lane of traffic on McFadden Avenue and ARELLANO was kicking and hitting him over his body. When the altercation ended, and ARELLANO went their own way. ’s right foot and wrist were injured during the altercation with ARELLANO. said “a piece of meat” came off of his foot as a result of the altercation in the street. never had any prior contact with ARELLANO prior to their altercation with each other. was not a witness to the shooting incident.
