2115 Hours
I was contacted at home by Detective Sergeant J. Rodriguez #2638 of the Santa Ana Police Department
Homicide Section who informed me that an officer involved shooting incident occurred at 1800 S. Evergreen
Street in Santa Ana. Sergeant Rodriguez requested I respond and assist with the investigation.
2208 Hours
I arrived at the scene and staged on the south perimeter.
2245 Hours
I checked in with Officer J. Peralta #3602, who was maintaining the crime scene personnel log.
2325 Hours
Sergeant O. Lizardi #2629 provided a briefing concerning the officer involved shooting and the status of the
initial investigation by patrol officers. Present were Detectives from the Santa Ana Police Department
Homicide Unit, Orange County District Attorney Investigators and the Orange County Crime Lab.
I was later paired up with Investigator C. Gonzales and assigned to interview potential witnesses.

I exited the scene and returned to the police department.

0136 Hours
Orange County District Attorney Investigator C. Gonzales and I interviewed Santa Ana Police Detective G.
BODNAR #3337 in an interview room located on the 3rd floor of the police department. Investigator
Gonzales audio recorded the interview and the following is a synopsis of said interview.

Detective assigned to the department¶s Gang Suppression Unit. Detective BODNAR works Sunday through
Wednesday with flexible hours between 12:30 PM and 11:30 PM.
Detective BODNAR was working a two man car with Detective Corporal D. ALCALA. Corporal ALCALA
was driving a marked black and white police vehicle as Detective BODNAR sat in the front passenger seat.
Their call sign for tonight was Sierra 21 Alpha (S21A). They were both wearing distinct police uniforms.
Detective BODNAR said that they were conducting citywide gang suppression working their way to Cedar/
Evergreen Streets area, which are claimed by the Delhi and Locotes Criminal Street gangs. Delhi and
Locotes gang fight over control of the area. He has patrolled that particular area in the past and knows that
these two particular gangs are involved in shootings, robberies, gang members armed with firearms, and
stolen vehicles.
Detective BODNAR stated that this evening, he and Corporal ALCALA were in their marked police vehicle
traveling northbound in the east alley of 1600 to 1700 block of Cedar Street, when he heard three (3)
gunshots coming south of them in the alley. Corporal ALCALA stopped the patrol car. BODNAR peaked
his head out the front passenger window and looked south in the alley. He observed a civilian vehicle
traveling north in the alley swerve to the west part of the alley. At the same time, he heard one of his other
partners transmit over the police radio (Green 4) that they were in a foot pursuit of a suspect. He believed
that ³Shots Fired,´was transmitted over the police radio.
Detective BODNAR stated that they continued north in the alley and exited out onto Edinger Avenue, as he
was attempting to find out the officer¶s location on their MDT. Corporal ALCALA drove east on Edinger to
south on Standard. They then drove west on Occidental to the east alley of Cedar Street. BODNAR exited
the marked patrol car and observed that Detectives E. SOLORIO and E. MARTINEZ had someone at
gunpoint. He observed that a male suspect had been shot. Once the male suspect had been handcuffed,
BODNAR searched the male suspect. He stated that the male (Oscar PENALOZA) was the same person
he and his team had arrested in the same area a week prior for possession of a firearm.
Detective BODNAR stated that he did not hear anything strike their patrol car or near them but he believed
that the gunshots were directed at them. He said that there was a gap between the shots that he heard in
the alley.
Investigator Gonzales showed Detective BODNAR an aerial map of 1800 S. Evergreen. Detective
BODNAR marked the map as to where they were when he heard the gunshots. He also marked the
direction they traveled when they drove out of the alley. Investigator Gonzales retained the aerial map.
We concluded the interview.
Investigator Gonzales provided me with a copy of the audio recording, which I later booked into SAPD
Evidence.
