They do not design wheelchair ramps so we waived the Professional Liability and Builder's Risk for this agreement. However, we did push back on the pollution liability requirement. 1 The contractor provided the attached letter requesting waivers of professional liability, builder's risk, and pollution liability. The initial contract and up-to-date renewals have also approved this exemption. Please note that the last work performed for City of Santa Ana under this contract was in January 2025. We can provide the coverage on an as-needed basis when a task order is awarded to CPE, but I do not think it is fair to require non- standard coverage and add'I insurance expenses related to that when there are no task orders ongoing/assigned/scheduled upcoming to our team at the moment. Respectfully, would you please review and reconsider? Let me know if we need to schedule a meeting to discuss further in order to successfully renew our agreement. He agreed to waive the Builder's Risk and Professional Liability since CPE does not design the wheelchair ramps for this project. However, we are still requiring the Pollution Liability for this agreement. Please see attached for his reasoning. Both the previous letter and the updated letter reflect the same reasoning as to why you are requesting a wavier of the Pollution Liability. For the Professional Liability, can you please sign the attached Affidavit of Exemption for Professional Liability for project #21-095? We also have not received an Affidavit of Exemption for Professional Liability for project 26-6009 (attached is the email from your insurance provider mentioning that the Affidavit will be sent separately).
