Upon arrival, I spoke to the manager, , who told me the following: The tenant in Room 1007, later identified as Freddie DeAngelo Washington, had been staying in the room, as mentioned earlier, for the past 14 days and a total of approximately $1000 dollars (A copy of total charges was provided at a later time). Freddie refused to pay even when made multiple attempts to receive payment for their services, but ultimately, Freddie continued to disregard them and made no attempt to pay, stating, "I'm not going to leave; call the cops on me." Furthermore, stated he wanted Freddie arrested and would be willing to sign a private person arrest form for trespassing if Freddie refused to leave the property. After confirmed that he had seen Freddie approximately 30 minutes ago inside the room, Officer Ibarra and I went to Room 1007 to attempt to speak to Freddie. Officer Ibarra attempted multiple door knocks and announcements asking Freddie to come to the door and talk to us. Freddie refused to answer and did not open the door; I drew my duty weapon and kept it pointed at the hotel door in case Freddie decided to lunge out at the officers. allowed us to open the door; given the circumstances, the door was opened using the master key provided by an employee. Once Officer Ibarra opened the door, Freddie stated, "Like I said, I hope you have a good reason to open my door." Officer Ibarra notified me Freddie was sitting in a chair in the northeast portion of the room. Due to the uncertainty of Freddie's mental state and disregard for Officers. I maintained my department-issued duty weapon drawn on Freddie for the safety of myself and my partners. It should be noted Officer Ibarra had his department-issued AXON Taser (Non-lethal option) drawn on Freddie when we determined he would not comply with commands. Even so, we continued attempting to get Freddie to comply, asking him to exit the room, but he ultimately refused, stating, "I don't need to go anywhere," and accusing Officers stating, "Break in some more, why don't you." Officer Ibarra reiterated and provided Freddie with another opportunity to grab his property and leave without being arrested for trespassing. Freddie replied, "Great," and remained seated, showing no effort to leave. Freddie erratically stated, "You guys have been coming to the walls and coming through my phone and everything." "That's why I'm fucking crazy and insane, got everybody looking at me like I'm a fucking nut." Even so, Officer Ibarra and I attempted to negotiate and convince Freddie to leave the room willingly. Freddie refused and began lighting up what appeared to be a cannabis cigar due to the pungent aroma of marijuana. For the safety of my partner and me, additional officers were requested to maintain officer safety and scene safety. Officer Corpus arrived on scene and continued attempting to negotiate and de-escalate the situation, reassuring Freddie we were there to help him. Freddie stated he did not feel safe and was asked how we could make him feel safe, to which he responded, "Shut my fucking door and let me talk to my lawyer." After approximately 13 minutes of non-compliance and complete disregard to Officer commands, CPL Biebrich, Officer Hernandez, Rodriguez, Corpus, Ibarra, and I developed a game plan in order to detain Freddie safely. Officer Ibarra and I cleared the room, and Officers Rodriguez, Corpus, and Hernandez went hands-on. Freddie immediately resisted throwing his body backward toward the Officers, dropping all his weight. Freddie still refused to comply, pulling his arms toward the center of his body, preventing officers from putting his hands behind his back and keeping officers from applying handcuffs. Once I observed Officers go hands-on and Freddie resisting arrest, I holstered my duty weapon and assisted with the detainment of Freddie, grabbing his left arm. Freddie immediately lunged towards me, driving me back into the bed mattress and pinning me and my right hand between him and the mattress. I saw Officer Corpus deliver a strike to Freddie, which appeared to be effective because only then was I able to pull my right arm away from under Freddie, allowing me to reposition myself. Freddie continued to fight, yelling and pulling his hands away from his back, ignoring all the Officers' commands. After a short period, Officers put Freddie on the ground and placed him on his stomach. At this time, I released my hold on Freddie's right arm and transitioned to pinning both his legs to the ground with my arms and legs, maintaining both legs between my legs and holding them in position to keep Freddie from kicking me and my partners. Officer Rodriguez grabbed his left arm, and Cpl Biebrich grabbed his right arm. After full detainment, Officer Rodriguez handcuffed Freddie, and I kept control of his legs. Officer Ibarra made multiple attempts to persuade Freddie to walk downstairs; Freddie responded, "You can kiss my ass. That's what you can do." Cpl Biebrich determined the maximum restraint device (WRAP) would be necessary given Freddie's uncompliant state. Once all Officers were ready, the maximum restraint device was applied, where I assisted with applying the lower ankle restraint and tightening the lower torso straps, restraining all of Freddie's lower and upper movement. During this altercation, my department-issued Axon Body-worn camera was knocked off the center of my chest and placed back on when it was safe to do so. After the scene was safe and Freddie was in custody, signed a private person arrest form for violation of PC 602 (o). also stated he was desirous of prosecution for defrauding an Innkeeper and provided a copy of unpaid hotel expenses charged to Freddie. I calculated all unpaid charges, excluding all taxes and surcharges. The total amount of unpaid room stay was $966, making the charge of Defrauding an Innkeeper a felony - PC 537(a)(2). CSI forensic specialist Davila arrived on the scene and photographed Freddie and all Officers involved. The private person's arrest form and receipt regarding charges for hotel services were booked into Santa Ana police evidence. Sgt. Mercer was advised of all circumstances. Sgt Mercer was also the acting Watch Commander and approved the charge of PC 148(a)(1). Ultimately, Freddie was transported to Santa Ana Jail, where he was positively identified by a New York Driver's license and booked for Penal Code 537(a), Penal Code 148(a)(1), and Penal Code 602(o). On 01-16-2025, at approximately 1040 hours, I was advised by Correctional Officer Carrillo #3918 that Freddie refused to provide DNA to them and would be charged for Penal Code 298.1(a). I responded to the Holiday Inn located at 1600 East 1st Street to photograph the scene. RODRIGUEZ #3967 Incident Date/Time: Occurred: 01/15/2025 13:00 Location Occurred: 1600 East 1st Street Santa Ana PD 2025-01014 Report by Davila, Sarah 3975 1 of 3 I arrived at approximately 1315 hours and met with Sergeant MERCER #3077 who requested photographs of the interior of room #1007 where the incident occurred, the suspect, Freddy WASHINGTON, and Officers MONDRAGON #3893, BIEBRICH #3570, CORPUS #3721, and F. RODRIGUEZ #3967. Sergeant MERCER advised WASHINGTON was transported to the Orange County Global Medical Center prior to my arrival. I met with Officer F. HERNANDEZ, and he advised his tie came off during the incident and his tie bar clip was damaged. I met with Officer MONDRAGON #3893, BIEBRICH #3570, CORPUS #3721, and F. RODRIGUEZ #3967 who were all wearing Santa Ana police uniforms. There was an unknown white colored substance on the front of Officer CORPUS’ uniform shirt, right sleeve, and left sleeve. There was an unknown white substance on the front of Officer MONDRAGON’S uniform shirt and his right sleeve. An apparent tear was in Officer MONDRAGON’S right sleeve near the elbow. Both of Officer MONDRAGON’S knees were red. Officer F. RODGRIGUEZ had an unknown white substance on the front of his uniform shirt, left sleeve, and both pant legs. The clip on Officer F. RODGRIGUEZ’S tie was bent, and his tie bar clip was broken. Officer BIEBRICH had an unknown white substance on the front and back of his uniform shirt, and on the front side of his pants. His right glove was torn around his ring finger and there was an apparent tear on the front half of his uniform shirt. I took overall, midrange, and close-up photographs of the officers and walked to room #1007. Room #1007 was on the tenth floor of the hotel. The room was furnished and filled with various items in the bathroom, bedroom area, and balcony. The room appeared untidy. I photographed the room and left the scene. I drove to OC Global, located at 1001 North Tustin Avenue and arrived at approximately 1339 hours where I met with Officer MONDRAGON #3893, Officer CORPUS, and WASHINGTON at bed D of the emergency room. Officer MONDRAGON #3893 advised that an injury on WASHINGTON’S right elbow was there prior to the incident. When I met with WASHINGTON he did not advise of pain. WASHINGTON was handcuffed with his hands behind his back, sitting on a gurney wearing a black shirt, and black helmet. WASHINGTON’S feet were restrained in a yellow wrap. I took overall, midrange, and close-up photographs of WASHINGTON and cleared the location at approximately 1348 hours. All fifty-nine (59) photographs were uploaded into the Digital Image Management System (DIMS). It should be noted that during the investigation, my department-issued Axon 3 body-worn camera was activated and recorded certain points of my investigation; it was later uploaded to the SAPD database. First Street in The City of Santa Ana, County of Orange reference a subject (Freddie Washington) defrauding an innkeeper and refusing to leave the hotel room. The following is my involvement in taking Freddie into custody. Several officers responded to the scene after Freddie failed to comply with several commands given by Officer Mondragon and I, too walk out of the hotel room peacefully and surrender. A plan was formulated to take Freddie into custody. I made entry into the room and cleared the bathroom that was close to the door of the hotel room. As I cleared the bathroom, officers passed by me to take Freddie into custody, which was deeper into the room. As they were attempting to take Freddie into custody, I can see that Freddie was pulling away from officers. At one point, Freddie was pulling away from officers and moving in my direction toward the room ’s door. Fearing that Freddie would pull away and run out of the room, I temporarily held Freddie’s head down on the bed. I placed my hand on the back of Freddie’s head as he violently thrashed his body and head in different directions. This was also done to prevent Freddie’s head from clashing with the Officer’s heads that were in close proximity of Freddie’s head. Freddie was eventually placed in handcuffs. Freddie was still violently thrashing his body telling us that he wouldn't peacefully stand up and walk out with us, so the decision was made to place him in a department approved maximum restraint device, named WRAP. I assisted by buckling the vest that is used to secure Freddie’s torso from moving. For further details on the arrest see Officer Mondragon’s arrest report under this same case number. While were were conducting follow up for a hit and run investigation, were heard over the radio of officers requesting additional units regarding a subject inside a hotel room not compliant. Upon hearing the radio broadcast, we responded to the location to assist, 1600 E. 1st Street, City of Santa Ana and County of Orange. While driving to the location, we looked at the comments of the call which stated, "GUEST IN ROOM 1007 HAS NOT PAID IN A COUPLE OF DAYS AND IS REF TO LEAVE...FREDDY WASHINGTON NFI". Once we arrived, we were escorted by the manager to the 10th floor and directed to the location of other officers. I observed officers at the end of the hall at the threshold of the hotel room #1007, talking to a Male Black, later identified as Freddy Washington. Washington was seen sitting on a chair at the far end of the room adjacent to the sliding windows of the balcony talking on a cellphone and with officers. Washington was given several commands to comply with officers and come out of the room, however Washington refused. While we waited for Corporal Biebrich #3570, Officer Corpus #3721 continued to talk to Washington to build rapport, but was agitated, uncooperative with any directions given and wanted police to leave. Once Corporal Biebrich arrived, a plan was formulated to enter the room to apprehend Washington. I was designated as the less lethal and assigned to the taser. Once we all had our roles, we entered the room and officers made contact with Washington. Washington continued to sit on the chair at the end of the room and once we closed the distance, Washington looked toward us and yelled "I'm on the phone, what are you doing". Santa Ana PD 2025-01014 Report by Hernandez, Jesse 3716 1 of 2 contact with Washington, Washington began to actively resist officers by not providing his arms to officers in order to take him into custody. I told Washington to stop, however he did not listen and continued to actively resist. I broadcasted to dispatch and informed them officers were involved in a fight. After informing dispatch officers were involved in a fight, Washington continued to actively resist by thrashing his body and making it difficult for officers to place handcuffs on him. By this time, Washington and officers were on the hotel room floor fighting with Washington. I informed Washington to stop or he would be tased. I placed my department issued taser on his right thigh in an effort to get compliance but did not tase him. Although Washington stopped thrashing his body, he was uncooperative and not following instructions given to him by officers. I told Washington to stop fighting and get on his stomach but there was no response. At this moment, officers were arranging themselves while keeping control of Washington limbs due to small space and all of Washington's belongings scattered around the room. Once again, I told Washington to stop fighting or he would be tased. Washington replied, "I'm not fighting". I then told Washington to give us his arm and Washington replied "No". Based on his response it was apparent, Washington did not comply with our directions and continued to resist by not placing his arms behind his back. Officers were able to overcome Washington's resistance and place handcuffs on him. Upon placing Washington in custody, I requested for medics to our locations and a supervisor. While we waited, Washington continued to be verbally aggressive toward officers by yelling profanities. Based on Washington's attitude toward us and to avoid further altercation, we utilized a restraining device known as the "WRAP". Once the restraining device was brought to the room, I assisted by placing the ankle restraint on his ankles and maintained control of them as the "WRAP" was installed. Scene: On Wednesday, 01/15/2025, Officer J. Hernandez #3716 and I, Officer F. Rodriguez #3967 were in police uniform driving a distinctly marked black and white Santa Ana Police vehicle assigned to Traffic Division. At approximately 1253 hours we responded to the Holiday Inn Express, located at 1600 East 1st Street, City of Santa Ana, County of Orange, reference a non-compliant subject inside of a hotel room. Comments on the call noted the following: GUEST IN ROOM 1007 HAS NOT PAID IN A COUPLE OF DAYS AND IS REF TO LEAVE...FREDDY WASHINGTON NFI". Additionally, officers on scene broadcasted over the radio the subject was non-complaint with their verbal commands. Observations: Upon arrival, I made my way up to the tenth floor of the Holiday Inn Express, Room #1007. I made contact with Officers Corpus #3721, Mondragon #3893 and Ibarra #3178. The officers were standing outside of Room #1007 giving the suspect, later positively identified as Freddie Deangelo Washington, verbal commands to comply with police. I observed Washington continuously be uncooperative with lawful verbal commands. Additionally, I observed Washington be argumentative with officers and unwilling to come to a solution to resolve the incident. Suspect Contact: Before making entry into Room #1007, officers coordinated a plan to apprehend Washington. My role in the apprehension of Washington was to physically detain Washington. At that time, we made entry into the room, and Washington was seated on a chair towards the back of the hotel room. Upon entry, there was an open door immediately to the left. As officers cleared the room to the left, I approached Washington and grabbed Washington's right arm. I ordered Washington to place his hands behind his back and Washington did not comply with my commands. Simultaneously, Washington resisted me as I grabbed his right arm. At that time, I grabbed a hold of Washington and pulled him out of the chair he was seated on. Washington fell forwards towards the bed located in the middle of the hotel room. I pulled Washington down onto the floor and restrained his right arm with both of my hands. At that time, an officer restrained his left arm. With both of Washington's arms restrained on the ground, I was able to successfully handcuff Washington's right arm. Once Washington's right arm was handcuffed, I grabbed his left arm, and I was able to handcuff Washington's left arm. It should be noted, the entire time I was attempting to restrain and detain Washington, he was combative and resisted being placed in handcuffs. Officers were able to overcome Washington's resistance and successfully effect the arrest of Washington. Restraint Device: After Washington was successfully placed in handcuffs, I restrained Washington by placing my knee on his left arm. Due to Washington still being uncooperative and combative with officers as he was lying on the floor restrained. A "WRAP" restraint device was applied on Washington. I assisted in the application of the WRAP restraint device. My role in the WRAP restraint device was to apply the restraint device that secured Washington's legs at the knees. Additionally, I placed the upper body restraint device on Washington. After successfully restraining Washington, I assisted in sitting him up and tightened the straps on the restraint device. Additionally, I placed the protective helmet around Washington's head. OCFA: After the application of the WRAP restraint device was applied on Washington, he was carried onto a gurney to be assessed, treated and transported to OC Global Medical Center by OCFA paramedics. Officers J. Mondragon and I. Ibarra were on scene and requested additional units due to dealing with a combative individual who was being non-compliant with officers’ commands. Upon arrival, I saw a male who was later positively identified through his CDL as Freddie Washington sitting on a desk chair inside of room 1007. I saw Freddie was smoking what appeared to be a marijuana cigarette and appeared to be on the phone. In an effort to de-escalate the situation, I took over all commands. At that time, I began speaking to Freddie in a calm demeanor asking him to comply with our commands. Freddie at times would respond, but multiple times, in an aggressive manner, Freddie would yell obscenities towards all officers on scene. Multiple times, I tried explaining to Freddie that we did not want to hurt him and only wanted to speak with him regarding the issue. At one point, Freddie told me he did not want to speak with me and only wanted to speak with his lawyer. It should be noted, the entire hotel room was in disarray. There were multiple items scattered throughout the room making it hard for officers to confirm if any weapons were in Freddie’s immediate reach. Officer Mondragon informed me that hotel staff had agreed to sign a private person's arrest form and desired prosecutions for violation of PC 602 (o). After multiple attempts to get Freddie to leave on his own, and his refusal to do so, and his continued defiance. Officers entered the room to effect an arrest. Due to the fact that the room had not yet been searched for weapons, or additional suspects, multiple officers entered the room together. Initially, my responsibility was to assist Officer F. Rodriguez on the arrest team. Upon approach, Freddie was sitting on the desk chair and continued to speak with someone on the phone, ignoring all officers’ commands. At that time, I saw Freddie clinch both of his hands and began bringing them towards his waist band in an active effort to resist arrest. In an attempt to help Officer Rodriguez, I tried to grab Freddie’s right arm. At that time, using his right arm, Freddie threw a back hand punch which struck me in the lower torso region. In an effort to gain compliance and overcome Freddie’s resistance, using my right elbow, I delivered an elbow strike towards Freddie’s head, striking him in the head. After assessing my strike, I saw it had no effectiveness and Freddie continued to actively resist arrest and began to stand up, causing all officers to lose leverage and began falling towards the bed. At this point, I could continuously feel Freddie clinching his muscles and attempting to bring his hands towards his unsearched waistline. Officers continued trying to control Freddie’s arms, but were met with continued resistance, causing all parties to begin falling onto the bed. At one point, I saw Officer Mondragon fall back onto the bed and was pinned down due to Freddie falling on top of him. Due to the fact that Freddie had not been searched for weapons, my knowledge of knowing suspects commonly carry weapons in their waistbands, and Officer Mondragon’s duty weapon being easily accessible to Freddie who was lying on top of him, I delivered a right elbow to the back of Freddie’s head, in an effort to gain compliance. At that time, I assessed to see if my strike was effective, to which it was not. Due to the ineffectiveness of my strike, I proceeded to deliver one last right elbow to the back Freddie’s head. I believed I slightly struck Freddie in the upper portion of his back head. Shortly after, I could see officers gain leverage and begin to control Freddie’s movements. Due to the constrictive and small area and the amount of officers on scene, I pulled back from my position to allow officers to take Freddie to the floor. While on the floor, officers were able to place Freddie’s hands behind his back. At that time, I gave Officer Rodriguez my handcuffs to place on both of Freddie’s wrist. Due to Freddie’s continued defiance and combativeness, a decision was made to place him into an agency approved restraining device to keep him from harming himself or officers on scene. Once Orange County Fire Authorities arrived on scene, I assisted by carrying Freddie by the legs and carrying him onto the gurney. This concluded my actions during today’s incident. On the above date and time, I heard Officer J. Mondragon #3893 request a supervisor to his location for an uncooperative male. Below is a synopsis of my involvement in investigation. I responded to assist and read the details of Officer Mondragon’s call at the Holiday Inn Express at 1600 E. 1st St. The call comments said the guest in room 1007 had no paid in a couple of days and was refusing to leave the premises. When I arrived on the 10th Floor, Officer Mondragon was at the open door to room 1007 along with Officer F. Corpus #3721, Officer I. Ibarra #3178, Officer J. Hernandez #3716, and Officer F. Rodriguez #3967. Officer Mondragon said he had spoken to a representative of the property who desired prosecution for trespassing and was willing to sign a private person’s arrest form for violation of PC 602(o). Officers had been giving commands in a calm voice since my arrival, and continued to do so, to the male inside room. I looked inside the room and a saw a male Black, later positively identified through a DMV photo as Freddie Washington, seated in a chair in the southeast portion of the room. Although he appeared to shout back at the Officers, seemingly acknowledging there were there an speaking to him, he refused to obey commands and leave the room. All Officers entered room 1007 to effect an arrest on Freddie. Santa Ana PD 2025-01014 Report by Biebrich, Joseph 3570 1 of 3 After being contacted while seated, I could see Freddie pull away from Officers and move his hands towards the front of him and near his unsearched waistband. Freddie then stood up and moved away from the Officers, and towards door, which was towards me. As Officers struggled to overcome Freddie’s resistance, he was pushed towards the bed. The mattress was pushed slightly off, exposing the boxspring. Freddie was laid over the bed, but he placed one of his feet on the exposed boxspring, bracing against it and preventing Officers from moving Freddie to the ground to be handcuffed. During this struggle, I saw Freddie’s left arm come free and was unattended. I grabbed his arm with my hands to control it and prevent him from reaching for any weapons on his unsearched person, or anywhere in the disheveled and unsearched hotel room. Eventually, Freddie was moved backwards off the bed, and onto the floor. Freddie was on his left hip and his left shoulder was on the ground. I controlled his right arm while Officer Rodriguez gained control of Freddie’s right wrist and moved it behind his back. I then took control of Freddie’s wrist as we moved him into the prone position. I held Freddie’s right wrist behind his back until Officers were able to bring Freddie’s left behind his back and placed him into handcuffs. Freddie appeared to be kicking and buck as Officers moved Freddie onto his left side and held him to the ground. Based on still be combative, despite being in handcuffs, I returned to my patrol vehicle to obtain the WRAP restraint device. I decided the application of the WRAP would be necessary to protect Freddie from harming himself or other Officers. WRAP Restraint Application I removed the ankle restraint and handed it to Officer Mondragon who applied it. I then prepared the leg wrap portion of the device and began to stage it. While Freddie was still in the prone position, I placed the leg wrap portion of the device on the ground to the right of Freddie. Officer Mondragon lifted Freddie’s legs off the ground briefly, and I placed the device under his knees while Officer Rodriguez pulled it to the other side, and Officer Mondragon immediately lowered Freddie’s legs onto the device. I then connected the three buckles, closing the device around Freddie’s legs, and tightened them. Officers then briefly rolled Freddie onto his left side, allowing me to further tighten the three straps on the leg device before he was placed back in the prone position. The upper body restraint was then laid over Freddie’s back. The other Officers then completed the entire application of WRAP. I checked and said out loud that Freddie had a gap between his chest and the restraint, he was sitting up straight, and he could, and was, breathing. OFCA arrived on scene and attempted to check Freddie’s vitals. FALK ambulance arrived to transport him to Orange County Global Medical Center. I assisted other Officers by grabbing the WRAP handle near Freddie’s ankles and lifting him onto the gurney. This concluded my involvement in the incident. J. Santa Ana PD 2025-01014 Report by Mercer, Brian 3077 1 of 2 On 1-15-25 at approximately 1300 hours, I overheard over the radio officers were struggling with a suspect at 1600 E. 1st Street #1007 (Holiday Inn Express) so I responded to their location. I arrived at the location and contacted the officers who were on scene. I contacted the on-scene supervisor, Cpl. Biebrich #3570, who advised me that they had a use of force taking a suspect into custody for trespassing. I confirmed at this time no officers were injured. Officers on scene and/or involved in the use of force were Cpl. Biebrich #3570, Officer Mondragon #3893, Officer Ibarra #3178, Officer Corpus #3721, Motor Officer Hernandez ##3716, and Officer Rodriguez #3967. All officers had their respective BWCs activated during the call for service. As I walked into room 1007, the suspect had been placed in the WRAP Immobilization Device. I inspected the application of the device and determined it was correctly applied. The suspect, Freddie Washington, was arguing with the officers and still being uncooperative. Washington was removed from the room and placed on a gurney, which was outside in the hallway. I interviewed Washington outside of Miranda and asked if he was injured and if he wanted medical attention. Washington complained that his wrists and face hurt, but I saw no signs of injury. I had to asked Washington several times if he wanted medical attention and eventual he agreed. Washington was transported to OC Global Medical Center to be evaluated and cleared for booking. CSI was requested to document the officers who were involved in the use of force uniform appearance. Additionally I requested CSI Davila to take photos of the condition of the room and to respond to the hospital and document any injuries that Washington might of sustained as a result of the use of force. I checked the area and there were no cameras inside the room and there were no independent witnesses to the use of force. MY BWC was activated during the duration of my time on scene. Later in the shift Officers Corpus and Mondragon reported injuries which had happened while taking the suspect into custody.
