Filed by Nabile Anz of Azure Plaza Partners, LLC to allow a residential care
facility for the elderly and change the zoning for a portion of the lot from Single
Family Residential (R1) and Multiple Family Residential (R3) to General
Commercial (C2) zoning for property at 1600 East First Street.

RECOMMENDED MOTION:
Recommend that the City Council:
1. Adopt an ordinance approving Amendment Application No. 2010-01.
2. Adopt a resolution approving Conditional Use Permit No. 2010-15 as
conditioned.
Principal Planner Vince Fregoso presented the staff report and recommendation.
Commissioner Betancourt inquired about specific tree identifications. Nabile Anz,
representing the applicant, indicated specific trees and shading will be further
developed.
No written communications were received. The public hearing was opened.
Nabile Anz, representing the applicant, spoke with regards to the landscape and
urged the commission's approval.
The public hearing was closed.
MOTION:
Recommend that the City Council:
1. Adopt an ordinance approving Amendment Application No. 2010-01.
2. Adopt a resolution approving Conditional Use Permit No. 2010-15 as
conditioned.
3. Planning Commission requested that the complete landscape plan be
provided to the Commission for review and final approval prior to
issuance of permit.
Commissioner Betancourt recommended that the applicant consider the use of
large canopy trees, layering of landscape materials, use of water efficient plants,
potential use of gray water and the use of flowers, herbs and vegetables in some
of the garden areas for the benefit of the residents.

2. CONDITIONAL USE PERMIT NOS. 2010-13 AND 2010-14
Emilia Keushkerian of Automated Laundry Systems, Inc is requesting approval of
conditional use permits to allow acoin-operated Laundromat facility within an
existing commercial building and to allow parking in the Two Family Residence
with B Suffix zone (R2-B) at 827 South Main Street, Suite B, located in the
Commercial South Main (CSM) zoning district.

Senior Planner Verny Carvajal presented the staff report and recommendation.
No written communications were received. The public hearing was opened.
Applicant Emilia Keushkerian commented on the graffiti concerns stated there
will be a full-time attendant during hours of operation; surveillance cameras are
setup at the exterior/interior and all entrances; the offices have monitors during
hours of operation. She stated the attendants are trained on upkeep of
Laundromat and emphasized the exterior cameras will provide protection with
gates in front and to the rear of the building. If graffiti damaged, the window will
have the film replaced. She stressed that the Laundromat is continuously
• attended.

MOTION:
1. Adopt a resolution approving Conditional Use Permit No. 2010-13 as
conditioned.
2. Adopt a resolution approving Conditional Use Permit No. 2010-14 as
conditioned.
3. Added Planning condition: Natural stone or matching stone veneer shall be
installed to match existing stone as found along the Main Street elevation.
The applicant shall. submit the proposed stone to the Planning Division for
final review and approval
4. Added Planning condition: All proposed signs shall be consistent with the
style, design and materials of the existing Main Photo sign found on the
Main Street elevation. All signs shall be approved under separate permit.
5. Added Planning condition: The exterior storefront glass shall be kept free
from graffiti and/or etching. The glass shall be treated with anti-etching film
or a similar protective coating or constructed of glass material that is
resistant to etching. All graffiti shall be removed within 48 hours; this
includes the removal of any painted or marked graffiti, as well as etchings.

3. CONDITIONAL USE PERMIT N0.2010-16
Filed by Bill Mason to allow the existing drive-through window at Arsenio's
Restaurant to operate 24-hours located at 751 South Harbor Boulevard, Building
H, in the North Harbor Specific Plan (SP2) zoning district.

RECOMMENDED MOTION:
Adopt a resolution approving Conditional Use Permit No. 2010-16 as
conditioned.
Principal Planner Vince Fregoso presented the staff report and recommendation.
Commissioner Yrarrazaval commented on the 25% of window coverage with
signs; recommended step up enforcement of policy. Staff will notify Code
Enforcement to monitor periodically as well as the Police Department.
No written communications were received. The public hearing was opened.
Dave Lopez, Riverview West resident, spoke in support of the project.
Bill Mason, architect for the owner, stated that his applicant has agreed to limiting
the use of the outdoor menu speakers after midnight, but would like the
opportunity to have the matter reconsidered after one year.
The public hearing was closed.
Commissioner Acosta commented on the 24-hour speaker box requested at this
point. Executive Director Trevino indicated it would cause more neighborhood
concerns and stacking issues. There would be compatibility problem and unlikely
the request would extend beyond the midnight hour for operation.
Bill Mason inquired as to when the applicant could operate 24-hours. Staff
indicated an appeal would be required for further consideration.
MOTION:
1. Adopt a resolution approving Conditional Use Permit No. 2010-16 as
conditioned. No further conditions regarding the extension of the intercom
box beyond midnight hour for operation.
2. Planning Commission changed Police Condition No. 1 -Any graffiti painted
or marked upon the premises or on any adjacent area under control of the
licensee(s) shall be removed or painted within 24 hours of being applied.
