RECORDING SECRETARY REPORT Pursuant to the Brown Act, the June 22, 2009 Cancellation Notice for the Regular Meeting was posted on the door of the City Hall Council Chambers at 22 Civic Center Plaza on June 17, 2009 at 8:19 a.m. Pursuant to the Brown Act, the June 8, 2009 Notice for the Regular Meeting was posted on the door of the City Hall Council Chambers at 22 Civic Center Plaza on June 4, 2009 at 4:02 p.m. RECOMMENDATION: Instruct the Commission Secretary to enter posting into the minutes. Planning Commission Minutes 1 July 13, 2009 C. MINOR EXCEPTION NO. 2009-03 (Alejandro Flores) Filed by Antonio Alvarez, to allow a reduction in the required off-street parking requirement in order to expand the Cancun Juice restaurant at 2302 South Bristol Street, Unit D, located in the General Commercial (C2) zoning district. RECOMMENDATION: Confirm the Zoning Administrator's action approving Minor Exception No. 2009-03 as conditioned. D. CONDITIONAL USE PERMIT NO. 2009-14 (Matt Foulkes) Filed by John Chu, to allow a Type 41 ABC license (on-premise sale of beer and wine) at the Shabu Shabu restaurant at 1945 East Seventeenth Street, Unit 108, located in the Arterial Commercial (C5) zoning district. PROCEDURAL RULES PUBLIC HEARINGS CONDITIONAL USE PERMIT NO. 2009-11 Filed by Larry La Bonte, to obtain a conditional use permit to allow the expansion of Wintersburg Presbyterian Church at 2000 North Fairview Street, located in the Agriculture (A1) zoning district. PUBLISHED IN THE ORANGE COUNTY REPORTER: July 1, 2009 PUBLICLY NOTICED: July 1, 2009 RECOMMENDATION: 1. Approve and adopt the Mitigated Negative Declaration and Mitigation Monitoring Program, Environmental Review No. 2008-180. 2. Adopt a resolution approving Conditional Use Permit No. 2009-11 as conditioned. Assistant Planner Matt Foulkes presented the staff report and recommendation. No written communications were received. PUBLISHED IN THE ORANGE COUNTY REPORTER: July 1, 2009 PUBLICLY NOTICED: July 1, 2009 RECOMMENDATION: Withdrawn. 3. Public Comments (for items not on the agenda) Costo S. So voiced concerns with increase in crime at Bishop Manor Condominiums, located at 1000 East Bishop Street. Chief Assistance City Attorney Kaufman indicated his letter will be forwarded to the City Task Force. STAFF AND COMMISSION COMMENTS 4. Staff Comments No comments were made. 5. Planning Commission Comments There were no outstanding action items resulting from Commissioner Comments. 6. Excuse of Absences Commissioner Betancourt made a motion to excuse the absence of Commissioner Turner.
