Pursuant to the Brown Act, the October 27, 2008 Cancellation Notice was posted
on the door of the City Hall Council Chambers at 22 Civic Center Plaza on
October 22, 2008 at 3:11 p.m.
Pursuant to the Brown Act, the October 13, 2008 Agenda was posted on the door
of the City Hall Council Chambers at 22 Civic Center Plaza on October 10, 2008
at 9:06 a.m.
RECOMMENDATION:
Instruct the Commission Secretary to enter posting into the minutes.

Filed by Tamara Fenner, to allow a Type 21 Alcoholic Beverage Control license
for the off-premise consumption of beer, wine and distilled spirits at the Rite Aid
Drug Store at 115 North Harbor Boulevard located in the North Harbor Specific
Plan No. 2 (SP-2) zoning district.

RECOMMENDATION:
Confirm the Zoning Administrator's action approving Conditional Use Permit No.
2008-31 as conditioned.

Principal Planner Sergio Klotz presented the staff report and recommendation.

The public hearing was opened.
Park Santiago resident Art Pedroza expressed concerns about the market
viability of the proposed project, potential for traffic impacts on the Park Santiago
neighborhood, lack of outreach in Spanish and the potential for shade and
shadow impacts from the proposed towers to the neighborhood.
Bill Hammerstein, the applicant's representative, outlined the outreach process
that has been conducted during the previous eight years of the project's
entitlement.
Commissioner Betancourt commented on sustainability of project, installation of
bicycle racks and consideration of landscape trees on roof deck(s).
Mr. Hammerstein commented on the auction held on November 8, 2008.
Construction Engineer Les Vlieger addressed sustainable building projects.
Commissioner Mill requested assurance that units would not be converted as
rentals. Mr. Hammerstein stated rentals would not be productive.

STAFF AND COMMISSION COMMENTS
Planning Manager Haluza asked that Commissioners refrain from engaging in
supplemental discussion of Agenda items during the Planning Commission
Comments section of the meeting in order to ensure that members of the public
interested in a particular agenda item have the opportunity to be present for any
discussion of that item.

• Commented on Mother's Market opening at City Place.
• Requested an update on Northgate Market at 17t" & Bristol Street.

• Looks forward to working on the Historic Resources Commission.

• Requested an update regarding larger retail stores affected by the economic
downturn in the City.

5. Excuse of Absences
Motion was made by Commissioner Mill to excuse the absences of
Commissioners Alderete and Yrarrazaval. The motion was seconded by
Commissioner Betancourt and unanimously approved by a vote of 4:2.
