B. RECORDING SECRETARY REPORT
Pursuant to the Brown Act, the June 11, 2007 Agenda for the Regular Meeting
was posted on the door of the City Hall Council Chambers at 22 Civic Center
Plaza on June 7, 2007 at 3:27 p.m.
RECOMMENDATION:
Instruct the Commission Secretary to enter posting into the minutes.

PROJECTS)

WORK STUDY SESSION
D. DISCUSSION OF TOWN & COUNTRY PROJECT AT 555 EAST MEMORY
STREET
Associate Planner Ann Ni provided an overview of the Park View at Town and
Country Manor project and introduced Douglas Pancake, Principal with Irwin
Pancake Architects.
Mr. Pancake provided a presentation on the proposed 11-story building that
would contain 174 senior independent living units.
Commission discussion ensued regarding the Spanish Baroque style for the
building design, preference for seam metal roof with traditional design, avoidance
of mixed .design, enhanced landscaping that include large canopy trees,
crosswalks, pedestrians lights and circulation path to City Place as well as Main
Place Mall. Commission also encouraged notification to the neighborhood and
inquired about other projects similar to this in Orange County. Discussion
evolved regarding connectivity with parks, walking area, convalescing and/or
nursing-care unit, entry fees adjustment for senior affordability and in lieu park
fees.

hours operation for EI Torito restaurant at 2800 North Main Street, Suite 868.

Assistant Planner Carlos Rodriguez provided the staff report and
recommendation.

Applicant Art Rodriguez spoke in support of the project; indicated that extension
of operating hours only apply to Friday/Saturday. Requested waiving Police
Condition No. 9 that required the cash register to be visible from the street.
The public hearing was closed.
Police Officer McCoy waived Police Condition No. 9.

2. ZONING ORDINANCE AMENDMENT NO. 2007-02 AND CONDITIONAL USE
PERMIT NO. 2007-07
Filed by Advanced Real Estate Services, Inc., to allow a zoning ordinance
amendment to add transient/residential hotel use as a conditionally permitted use
in the General Commercial District in the North Harbor Specific Plan (SP-2)
zoning district and a conditional use permit to convert the existing California
Palms to a transient residential hotel at 801 and 901 South Harbor Boulevard.

RECOMMENDATION:
Recommend that the City Council:
1. Approve and adopt the Negative Declaration for Environmental Review No.
2004-158.
2. Adopt an ordinance approving Zoning Ordinance Amendment No. 2007-02.
3. Adopt a resolution approving Conditional Use Permit No. 2007-07 as
conditioned.
Associate Planner Ann Ni provided the staff report and recommendation.
Commission discussion ensued regarding lease options, rental of furnished or
unfurnished units, clarification on architectural design, and transient-resident
residential use. Commission also received clarification on the developer's
requirement to pay a fair share contribution for traffic signal improvements.
Public Works representative Taig Higgins provided information regarding traffic
signal survey.
The public hearing was opened.
Applicant Robb Cerruti spoke in support of the project.
Commissioner Mill requested that staff contact the bakery property owner to
clean up the property located to the south of Harbor Boulevard on Kent Street.
Commissioner Alderete inquired about efforts to address remaining unpermitted
transient occupancy hotels throughout the city.

MOTION: Recommend that the City Council:

recommendation.
Commission discussion ensued regarding definition of premium concept and
similar stores in the area.
The public hearing was opened.

Applicant Mike Easton spoke in support of the project.
Commission inquired about sorting merchandise. Mr. Easton mentioned that
sorting is off-site to maintain better quality, while using wholesale product out of a
distribution center.
Randy Taylor of Goodwill of Orange County confirmed selling new product from
contracted merchandise (overstocked or did not sell).
Chair Leo confirmed that store will not be taking used-goods at this facility; store
is not a donation center rather a retail store.
The public hearing was closed.
Chief Assistant City Attorney Kaufman modified Planning Condition No. 3 (Exhibit
A page 4 of 6).

MOTION: Adopt a resolution approving Conditional Use Permit No. 2007-12 as
conditioned. Modified Planning Condition No. 3 -There shall be no outside
storage, outdoor sale, or collection of goods inside or outdoors at the subject
property. All temporary outdoor sales and activities shall be in compliance with
Section 41-195 of the Santa Ana Municipal Code.

Karen Haluza stated that a memo dated June 25, 2007 was included in the
Commission's packet in response to their request to address outreach efforts in
Heninger Park with regards to permit requirements, the Specific Development
zoning designation and historic preservation to residents of Heninger Park and to
realtors.

Chair Leo
Requested a memo on the background of transient hotels to be provided
to the Planning Commission.
Recommended notification to other non-compliant motels to encourage
them to be in compliance with existing ordinance.

• Requested that the Public Works Agency and Cal Trans review the traffic
backup entering SR22 on Bristol Street, to improve traffic light
synchronization.
7. Excuse of Absences
Chairman Leo made a motion to excuse the absences of Commissioners De La
Torre, and Munoz. The motion was seconded by Commissioner Betancourt and
unanimously approved by the Commission.
