RECORDING SECRETARY REPORT Pursuant to the Brown Act, the December 26, 2005 Cancellation Notice for the Regular Meeting was posted on the door of the City Hall Council Chambers at 22 Civic Center Plaza on December 22, 2005 at 8:03 a.m. Pursuant to the Brown Act, the December 12, 2005 Agenda for the Regular Meeting was posted on the door of the City Hall Council Chambers at 22 Civic Center Plaza on December 9, 2005 at 8:03 a.m. RECOMMENDATION: Instruct the Commission Secretary to enter posting into the minutes. Planning Commission Minutes 1 January 9, 2006 C. MINOR EXCEPTION NO. 2005-08 Filed by Connie Jones for relief from the front yard fence height requirement to allow a 42" wrought iron fence in the Two-Family Residence (R2) zone at 1601 West Second Street. RECOMMENDATION: Receive and file the staff report approving Minor Exception No. 2005-08. Commission discussion ensued regarding purpose of fence, safety exit, and color of fence. COMMISSIONER COMMUNICATION DISCLOSURE (REGARDING AGENDIZED PROJECTSI No comments were made. PROCEDURAL RULES PUBLIC HEARINGS 1. VARIANCE NO.2005-66 AND VARIANCE NO. 2005-67 (Vince Fregoso} Filed by Nexus Companies to allow a variance for a reduction in parking and required setbacks in conjunction with a 900 square foot addition to an existing retail center in the Specific Development No. 76 (SD-76) zoning district at 2 East Hutton Centre Drive. PUBLISHED IN THE ORANGE COUNTY REPORTER: December 30, 2005 PUBLICLY NOTICED: December 29, 2005 RECOMMENDATION: 1. Adopt a resolution approving Variance No. 2005-66 as conditioned to allow a reduction in parking. 2. Adopt a resolution approving Variance No. 2005-67 as conditioned for a reduction in setbacks. Senior Planner Vince Fregoso presented the staff report and recommendation. Commission discussion ensued regarding exterior materials, parking spaces at Lake Towers to accommodate patrons/retail/residents and pedestrian traffic. The public hearing was opened. Public Comments (for items not on the agenda) Judy Edge (Sandpointe resident) requested the relocation of the unsightly five- foot pedestal installed at the parkway entry at Main/Murphy streets. Also she mentioned that at Timber/Sunflower, Nexus will consider another pedestal installation, she would like a review by the Planning staff. Vic Edge (Sandpointe resident) commented on unsightliness of pedestal and suggested having the pedestal relocated to Main Street closer to the wall so as to be less obtrusive at the neighborhood entry. Planning Commission Comments Commissioner De La Torre • No comments Commissioner Cribb • Requested review of signage at Santiago Car Wash on 17t"~/Santiago • Commented on land use opportunity (retail) at Main/McFadden, northwest corner • Commented on discussion for a moratorium on alcoholic rehabilitation centers • Requested landscape improvement at Greenville/MacArthur with existing chain-link fence • Requested further discussion regarding low income infill rehabilitation projects • Commented that City should try to retain French School at Temple Beth Shalom that is looking for permanent location Commissioner Betancourt • Commented that Planning Commission should hold a study session on "Green" building concepts and the LEED rating system Commissioner Gartner • No comments Commissioner Lutz • Recommended security surveillance at fountain recently installed at Artists Village on Second Street, have signage to deter vandalism • Provided news articles for the commission from Denver's Clyfford Still Museum and Loft Living in Sacramento Planning Commission Minutes 3 January 9, 2006 Vice Chairman Leo • No comments 5. Excuse of Absences Commissioner Cribb made a motion to excuse the absence of Commissioner Rodriguez, motion was seconded by Commissioner Lutz and unanimously approved by the Commission. 6.
