MINUTES RECOMMENDATION: Approve the minutes of the regular meeting of November 27, 2006. B. RECORDING SECRETARY REPORT Pursuant to the Brown Act, the November 27, 2006 Agenda for the Regular Meeting was posted on the door of the City Hall Council Chambers at 22 Civic Center Plaza on December 22, 2006 at 11:22 a.m. RECOMMENDATION: Instruct the Commission Secretary to enter posting into the minutes. C. MINOR EXCEPTION NO. 2006-10 Filed by Joe Calderon requesting to allow asix-foot encroachment into the required front yard setback in the Two Family Residential (R2) zoning district located at 1238 South Clara Street. Planning Commission Minutes 1 December 11, 2006 RECOMMENDATION: Confirm the Zoning Administrator's action approving Minor Exception No. 2006- 10. D. PERIODIC REVIEW OF CONDITIONAL USE PERMIT NO. 2005-03 Update on Abel Food Service located at 2520 South Birch Street. D * * * END OF CONSENT CALENDAR BUSINESS CALENDAR E. COMMISSIONER COMMUNICATION DISCLOSURE (REGARDING AGENDIZED PROJEDCTS) Commissioners Cribb and Gartner spoke with Mr. William Beaubeaux regarding signage at 100 Main Street, Item 2 Variance No. 2006-14. Commissioner Betancourt abstained on Item 1 Conditional Use Permit No. 2006- 20 and Variance No. 2006-13 as well as Item 2 Variance No. 2006-14. D PROCEDURAL RULES PUBLIC HEARINGS 1. CONDITIONAL USE PERMIT NO. 2006-20 AND VARIANCE NO. 2006-13 (Continued by the Planning Commission November 13, 2006 to November 27, 2006 and continued November 27, 2006 to December 11, 2006.) Filed by Caribou Industries on behalf of 5 Goodyear LLC, to allow a parking lot in the Midtown Specific Plan (SP-3) zoning district and vary from the setback standards at 202 East Seventeenth Street. PUBLISHED IN THE ORANGE COUNTY REPORTER: November 3, 2006 PUBLICLY NOTICED: November 3, 2006 RECOMMENDATION: 1. Adopt a resolution approving Conditional Use Permit No. 2006-20 as conditioned to allow a parking lot. 2. Adopt a resolution approving Variance No. 2006-13 as conditioned to allow a reduction in landscaped setbacks. Senior Planner Vince Fregoso stated the applicant requested a continuance due to changeover in personnel. VARIANCE NO. 2006-14 (Continued by the Planning Commission November 27, 2006 to December 11, 2006.) Filed by Caribou Industries, to obtain a variance from the sign code for Original Mike's restaurant and allow an additional wall sign on the north elevation at 100 South Main Street. Planning Commission Minutes 2 December 11, 2006 PUBLISHED IN THE ORANGE COUNTY REPORTER: November 17, 2006 PUBLICLY NOTICED: November 17, 2006 RECOMMENDATION: Adopt a resolution approving Variance No. 2006-14 as conditioned. Senior Planner Vince Fregoso presented the staff report and recommendation. The public hearing was opened. Commissioner Lutz commented that the existing window decals on the building are peeling off. William Beaubeaux indicated he was coordinating the replacement of the decals with an artist. Julie Stroud expressed concern with potential damage to the building that might result from mounting the sign on the brick facade. Thomas Gordon provided a photograph of the Santora Building showing building damage resulting from the removal of a sign. The public hearing was closed. MOTION: Adopt a resolution approving Variance No. 2006-14 as conditioned. Added a condition that the restoration of the building exterior, including the repair of holes in the bricks resulting from the installation of building signage, shall be subject to the provisions of the Secretary of the Interior Standards. All repair work must be reviewed and approved by the Planning Division. Planning Commission Comments Commissioner Cribb • Requested further clarification to the response from Public Works regarding the North Main Street/Memory Lane/Walkie Way synchronization with the traffic lights when no cars/pedestrian are present as well as the inadequate freeway ramp signage. Commissioner Lutz • Recommended that the grain silo discussed at the Historic Resources Commission should be considered for inclusion on the historic register. • Inquired about a request for a bail bonds operation at 801 North Ross. Commissioner Gartner • Thanked staff for their assistance and quick response to complaints regarding unpermitted work on the Maharajah House. Planning Commission Minutes 3 December 11, 2006 • Announced that his son won 1St Place in the Junior Drag Racing Championships. Commissioner Betancourt • Agreed with Commissioner Cribb regarding further review of the traffic flow on SR5 and prioritizing the review of the freeway entry signage. Vice Chairman De La Torre • Recommended review of 2006 Commission's goals and objectives, Renaissance Plan and the affected policy issues with the new commissioners. • Informed Planning Commission that the meeting for December 25, 2006 was cancelled; meeting will resume January 8, 2007. 6. Excuse of Absences Commissioner Cribb moved to excuse the absence of Chairman Leo and Commissioner Lutz seconded the motion; the Commission unanimously approved. COMMISSION TRAINING 7. AB1234 Ethics Training City Assistant City Attorney Kaufman conducted a training session for Commissioners Cribb, Vice Chairman De La Torre, Commissioner Betancourt and Commissioner Gartner. 1 1 8.
