HomeMy WebLinkAbout2007-40• RESOLUTION NO. 2007-40 KO -11/19/07 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA DENYING NEIGHBORHOOD PROJECT REVIEW NO. 2007-13 TO ALLOW THE DEMOLITION OF AN EXISTING ONE-CAR GARAGE AND THE CONSTRUCTION OF ANEW 539 SQUARE FOOT TWO-CAR GARAGE AT 919 SOUTH PARTON STREET LOCATED IN THE SPECIFIC DEVELOPMENT 40 ZONE (SD-40) (HENINGER PARK) BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Planning Commission of the City of Santa Ana hereby finds, determines and declares as follows: A. The property owner is requesting approval of Neighborhood Project Review No. 2007-13 to allow the demolition of an existing one-car garage and the construction of a new 539 square foot two-car garage at 919 South Parton Street which is located within the Specific Development 40 Zone (SD-40) (Heninger Park). B. Neighborhood Project Review No. 2007-13 was sent to the Heninger Park Architectural Review Committee for review, but no comments were received from the Heninger Park Architectural Review Committee. C. Santa Ana Municipal Code Section 41-593.5(c) requires the Planning Commission to review all plans within a Specific Development Plan area to ensure that the project is in conformity with the approved Specific Development. D. On November 26, 2007, the Planning Commission conducted the necessary review pursuant to Santa Ana Municipal Code Section 41-593.5(c). E. After considering all of the evidence submitted, the Planning Commission finds and determines that Neighborhood Project Review No. 2007-06 is consistent with both the Heninger Park Design Guidelines and the Citywide Design Guidelines in regards to architectural style and method of operation. Resolution No. 2007-40 Page 1 of 4 • 1. The proposed design incorporates the unique structural and design characteristics of the Craftsman Bungalow architectural style. 2. Although the project involves the demolition of the existing one-car garage, the proposed two-car garage will incorporate key defining elements that are found on the existing single-family residence, like consistent roof pitch, materials, exterior finishes and color. 3. The proposed garage door is of a design that matches the single-family residence. F. In accordance with the California Environmental Quality Act, the proposed project is exempt from further review pursuant to Section 15301, Class 1 and Section 15303, Class 3. This Class 1 exemption allows for the demolition and removal of individual small structures, including garages. In addition, this Class 3 exemption allows for the construction of new accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences. Categorical Exemption Environmental Review No. 07-154 will be filed for this project. Section 2. The Planning Commission hereby approves Neighborhood Project Review No. 2007-13. This decision is based upon, but is not limited to: the Request for Planning Commission Action dated November 26, 2007 and exhibits attached thereto, and the public testimony, all of which are incorporated herein by this reference.
